I will say that from the outset it is very hard for me to advise with complete certainty what the right course of action is, as often there will have been a lot of work undertaken already, and nuanced arguments behind the various decisions taken already. However, in order to try to provide some clarity and assist you in finding a way forward I have put together a few thoughts below. In terms of the manner in which the planning consultant was procured, this isn’t something that ourselves, or indeed a neighbourhood planning examiner would be concerned with or would look at in any detail. But this does not preclude other parties taking an issue with the it so it depends how comfortable you feel as a Parish Council, I haven’t heard this raised as an issue by any other PC’s that have employed a planning consultant but of course I don’t know the details of how they commissioned a consultant. Likewise the consultants performance is something I believe only the client can truly judge and so dependent upon the arrangement you have with them, I would suggest it is in your power to retain or release the consultant as you see appropriate. One area that does concern me somewhat, is that you have noted that there may have been some inconsistencies with how the site selection process has been conducted. This of course will be an area that could be rigorously scrutinised through the statutory consultations and the examination particularly given that different land owners are involved. Because of this, I would certainly recommend that the PC take stock of the situation and investigate the depth of any issues/inconsistencies. When you have a firm grasp (you may already) of exactly what has happened, it may be useful for us to have a phone call to start so that I can understand a bit more about what is going on. Following that, if we need to sit down and have a meeting we can do so. I would emphasise that I believe that the consultants performance and initial procurement is a separate issue to that of the neighbourhood planning process and the work the Parish Council has already undertaken. I would therefore reassure you that it is unlikely that any issues will mean that we need to start with a blank-canvas. The Neighbourhood Planning Team have produced a draft plan and this was voted through the PC by a narrow margin of 4 to 3 with one abstention. The plan recommends that Haileybury College should develop a piece of their greenbelt land. On further and deeper examination it appears that there have been a number of inconsistencies with the process. These include unrecorded meetings and phone calls by members of the team with Haileybury’s management and consultants. The Neighbourhood Planning Consultant was employed by the PC, with no selection procedure and no contract, and with no other alternative services tendered for. This consultan'ts performance is questionable as on one occasion she wrote to a rival developer and gave them factually incorrect information which would have impacted their bid. The proposal made by the Planning Team will deliver no community benefits whatsoever and this is one of the objectives for neighbourhood planning. The Parish Council has met to discuss this and has agreed to go no further without some sort of second opinion. We may have to, in the worst case, start the process all over again, fire the consultant, refer the consultant to the appropriate body and to externally audit the whole process. We are in a very difficult position and need help.
