MashpeeWampanoag Tribe lRrn9 2012-RES-025 RESOLUTION TO APPROVE THE MASHPEE WAMPANOAG TRIBE'S LAND INTO TRUST APPLICATION AS AMENDED WIIEREAS, the MashpeeWampanoag Tribe (the "Tribe") is a federally-recognizedIndian tribe with a duly-enactedConstitution; WffiREAS, the governing body of the Tribe is known as the MashpeeWampanoag Tribal Council (the "Tribal Council"); WIIEREAS, Article VI, $ 2.A. of the Constitutionof the MashpeeWampanoag Tribe (the "Constitution"),provides that the Tribal Council is empoweredto promoteand protect the health,peace, morals, education, political integrity,economic security and general welfare of the Tribe and its members; WIIEREAS, the Secretaryof the Departmentof the Interior (the "Secretary") has the authority pursuantto Section5 of the Act of June18, 1934,as amended,25U.S.C. $ 465 to acquirelands for Indian tribes,and provides that suchlands shall be acquiredin the nameof the United States in trust for the tribe; WIIEREAS, the Tribe achievedfederal recognition, effective May 16, 20f.7,andremains without a federallyprotected land base,trust lands,or a reservation; WHEREAS, the Tribe previouslysubmitted to the Bureauof Indian Affairs ('BIA"), Eastern RegionalOffice, a fee-to-trustapplication on August30, 2010,amended on July 13,2010, for the acquisitionin tnrst of landsin the Town of Mashpee,Massachusetts and furtherincluding landsin Middleboroughand Fall River, Massachusetts(collectively, including subsequent amendmentsas may be required,the "Application"), someof which wereplanned for usein the Tribe's expectedclass II or classIII gamingfacility to be conductedunder the Indian Gaming RegulatoryAct ("IGRA"); WffiRBAS, the Tribe desiresto amendthe Applicationto removethe Fall River and Middleborough,Massachusetts, parcels and to addone or moreparcels in Taunton, Massachusetts,which parcelstogether the Tribe plansto be its initid reservationlands, and the 483 GreatNeck Rd, South, Mashpee,MA 02649 (508)477-0208 (508)477-1218 hx 'ffi" Mashpee WampanoagTribe ?nrr9 Applicationshall continue to includethe Mashpee,Massachusetts, parcels, whose proposed uses havenot changed;and WHEREAS, the Tribal Council finds it in the bestinterests of the Tribe andits Tribal members to submit the Applicationto the BIA and to authorizethe Chairmanof the Tribal Council to submit the sameas may be amended. NOW THEREFORE, BE IT RESOLYED, that the Tribal Council herebyapproves the Application,and authorizesthe Chairmanof the Tribal Council to submit the Applicationas amendedto the BIA and to submitsuch further amendments, revisions, or supplementsthereto as may be required. All resolutionsor partsof resolutionsinconsistent with this resolutionarc repealed.This resolutionis effectiveimmediately and shallcontinue pursuant to the authorityvested in the Tribal Council pursuantto Article VI, $ 2.A. of the Constitution.
