The Sale will be held under the auspices of the Cheshire Support Group of the Rare Breeds Survival Trust, and vendors will be subject to the Regulations and Conditions laid down at the time of entry. 2. Although every effort has been made to verify pedigree animals, unless there is a dispute no contact will be made with the Breed Society. Pedigree Certificates must be sent with entries. 3. Immediately upon arrival in the market all stock must be presented for inspection by a veterinary surgeon and a further inspection by a panel appointed by the Cheshire Group. Vendors should ensure that all stock is in the market and have been passed on by the inspection panel and veterinary surgeon between 7.00am and 9.00am on Saturday 22nd September 2012. The market premises will be secured from 8.00pm on Friday 21st September 2012 until 7.00am on Saturday 22nd September 2012 but vendors must note that at all times their stock remains at their own risk until such time as the hammer falls. Thereafter the risk passes to the purchaser (subject to Conditions of Sale) and it is incumbent upon either the vendor or the purchaser, as the case may be, to ensure that each and every animal is the subject of suitable insurance. 4. In the event of a dispute, the decision of the veterinary surgeon and/or the inspection panel (without recourse to a referee) will be final and binding upon all parties. Any stock disqualified for whatever reason must be withdrawn from the sale and removed from the market premises forthwith, at all times remaining the responsibility of the vendor. UNDER NO CIRCUMSTANCES WILL SUBSTITUTE ANIMALS BE ALLOWED 5. a) All female sheep are warranted to be sound in mouth, udder, and correct for breeding. This warranty runs for 1 hour after the end of the day's sale and any complaints should be notified to the auctioneers' office within this time limit. b) All rams are warranted to be capable of, and effective at, natural service. c) All bulls 10 months old or over are warranted by the vendor to be capable of, and effective at, natural service. d) Except where inconsistent with the above, the National Conditions of Sale, approved by the Livestock Auctioneers' Association are applicable, wherein are also stated limits of time in which complaints have to be lodged. e) The General Conditions of Sale, also applicable, are printed elsewhere within this catalogue. f) Intending purchasers should note that time is the essence in respect of all Conditions of Sale and in respect of any of these conditions it is the stated intention of each vendor that any compensation should in no circumstances exceed that stated - purchasers will be deemed to have purchased in full knowledge of this. 6. a) All stock will be sold in guineas (multiples of 105p). All poultry and waterfowl will be sold in £s PER BIRD. b) Vendors may stipulate a reserve price which must be notified in writing to the auctioneers no later than 9.00am on the day of sale. c) In the case of animals failing to reach the reserve price fixed by the vendor, half commission may be charged on the amount of that reserve price. 7. a) No stock entered in the catalogue may be sold prior to the auction, whether on the day of sale or before. Any stock not forward without a certificate from a qualified veterinary surgeon giving a valid reason for such non-appearance will be deemed to have been sold privately. In the event of a private sale before the auction, the vendor will be liable to pay full commission plus taxes based on an estimated value set by the auctioneers, who shall be sole arbitrators. The vendor may also be held liable, directly and not through the auctioneers as his agents, for any claims of whatsoever nature arising from any intending purchaser or purchasers who may prove such claims valid, in connection with the non-appearance at the auction of the stock in question. b) Any transactions whereby animals are sold privately after the sale must be notified to the auctioneers and full commission will be charged on all such transactions. 8. Vendors of sheep and goats are required to supply the relevant documentation supporting their Maedi Visna/CAE status. Vendors of cattle are likewise required to supply the relevant documentation supporting their EBL status. All documentation must be presented to the veterinary surgeon or auctioneers' representative before the animals are unloaded. 9. No stock may be removed from the sale pens without either a receipted account or an authorised pass. The plastic identity tag with each sheep and goat must be given to the market staff BEFORE any stock is loaded. 10. The pedigree certificate relating to each lot will, where possible, be handed to the purchaser at the time of settlement of their account. 11. The auctioneers will account to the vendors for the sale of their animals within 14 days of the date of the sale. 12. This sale is organised and directed by the Cheshire Support Group of the Rare Breeds Survival Trust, and the auctioneers accept no liability in respect of any claims whatsoever arising however. The descriptions are supplied by the vendors who alone are responsible for detail and accuracy. The auctioneers will not be answerable in respect of any errors which may occur in the catalogue. Alterations may be announced by the auctioneer immediately prior to inviting bids for that particular lot or lots. 13. No warranty, other than any stated above, is given or implied in any respect whatsoever. 14. If any questions or queries arise, which are not provided for in the above Conditions of Sale, the decision of the auctioneers shall be final and there shall be no appeal against that decision. 15. Intending purchasers of Wensleydale sheep should be conversant with the breeding and registration rules of the Wensleydale Longwool Sheep Breeders’ Association, which were revised at the 1995 AGM, particularly with regards to white sheep known to be carrying the black gene (WB sheep). They should also enquire from vendors whether a male has been recorded in the Ram Breeding Register. This involves a payment by a member of £10, and is additional to the registration fee.
