CERL Special Report 96/03 November 1996 Revised October 2000 US Army Corps of Engineers Engineer Research and Development Center The Environmental Assessment and Management (TEAM) Guide Kansas Supplement Revised October 2000 Environmental assessments help determine compliance with current environmental regulations. The U.S. Air Force, U.S. Army, Defense Logistics Agency (DLA), and Corps of Engi- neers (Civil Works) have adopted environmental compliance programs that identify compliance problems before they are cited as violations by the U.S. Environmental Protection Agency. Since 1984, the U.S. Army Construction Engineering Re- search Laboratory, in cooperation with numerous Department of Defense (DOD) components, has developed environmental compliance assessment checklist manuals. The Environ- mental Assessment and Management (TEAM) Guide was developed for use by all DOD components. Currently there are five participating DOD components: the Air Force, Air National Guard, Army, Civil Works, and DLA. These agencies have agreed to share the development and maintenance of this Guide. The Guide combines Code of Federal Regulations and management practices into a series of checklists that show legal requirements and the specific operations or items to review. TEAM Guide is supplemented by DOD component- specific manuals detailing DOD component regulations and policies. The Kansas Supplement was developed to be used in conjunction with the TEAM Guide, using existing Kansas state environmental legislation and regulations as well as suggested management practices. For any specific questions about, or interpretations of, the legal references herein, consult appropriate legal counsel. iii Introduction iv Introduction KANSAS SUPPLEMENT The Kansas Supplement to the U.S. TEAM Guide contains the protocols necessary for determining compliance with Kansas environmental regulations. This manual is a supplement to the U.S. TEAM Guide; the supplement does not replace the guide. The following Kansas agencies issue regulations and have responsibility in the areas indicated. • Antiquities Commission - administers the historic preservation requirements for archaeological/Native American sites. • Chief Engineer, Division of Water Resources, State Board of Agriculture - oversees dredging, floodplain, and dam management. • Department of Wildlife and Parks - protects threatened and endangered species of wildlife. • Department of Health and Environment - all spills of materials posing a threat to the environment (SARA Title III) must be immediately reported to the Department, as well as to the Division of Emergency Preparedness of the Adjunct General’s Office and local spill response teams. The Department may be reached at telephone number 913/296-1500. • Division of Environment, Department of Health an Environment - includes the following bureaus: • Bureau of Air and Radiation - is responsible for regulating the radiation control, air quality, right-to-know, radon, and asbestos programs • Bureau of Waste Management - regulates the disposal, treatment, and storage of waste, regardless of its origin • Bureau of Environmental Remediation - coordinates the state’s emergency response actions, as well as storage tank regulations, surface mining site rules, and the design and oversight of remedial activities • Bureau of Water - oversees programs regulating public drinking water, wastewater treatment facilities, liquefied petroleum storage, solution mining, underground injection, and water well drilling licensing. • Division of Water Resources, State Board of Agriculture -
