WRIGHT COUNTY PLANNING COMMISSION Meeting of: March 8, 2012 M I N U T E S – (Informational) The Wright County Planning Commission met March 8, 2012 in the County Commissioners Board Room at the Wright County Government Center, Buffalo, Minnesota. Chairman, Ralph Douglas, called the meeting to order at 8:00 p.m. with all Board members present. Sean Riley, Planning & Zoning Administrator, represented the Planning & Zoning Office. Greg Kryzer, Assistant County Attorney, was legal counsel present. MINUTES On a motion by Russek, seconded by Denn, all voted to approve the minutes for the February 9, 2012 meeting as printed. 1. MID-MINNESOTA HOTMIX, INC.- New Item LOCATION: 8779 Oliver Avenue NW – Part of the NE l/4 of Section 22, Township 121, Range 28, Wright County, Minnesota. (Southside Twp.) Tax #217-000-221100 OWNER: LAMCO LAND LLC Petitions for a Conditional Use Permit to locate a temporary hot-mix plant in the existing pit for the 2012 season . Operations to include related stockpiling and recycling of materials and include operations Monday-Saturday as regulated in Section 727 of the Wright County Zoning Ordinance. Present: Tim Ferrell A. Riley presented the maps of the property and a new “pictometry” aerial photo to show the current operations. The Commission is looking at a request to renew the hot-mix operation for the coming season. B. Ferrell explained there is no change to the request from previous years. Operations over the last two years included 50 operating days in 2011 and 56 in 2010. The plant operated on an average of three hours a day. This is the same plant located in the same place as before. C. Douglas noted the Commission had visited the site the previous year. Ferrell indicated the mining has not progressed. D. Riley questioned the Township response which indicates work on Saturdays was discussed. He asked if the previous condition to allow work on Saturdays when there is a rain day the same week would address their needs. Ferrell indicated they have always asked for consideration to work on Saturday, although they have not used them in the past. The provision used in the permit last year would suffice. Riley indicated the suggested motion reads the same as the previous year. E. Discussion on the material left to be mined. Ferrell estimated it would take 3-4 years to complete if they have the contracts. After that time, the asphalt plant would be moved somewhere else. Bakeberg moved to approve the placement of a temporary bituminous plant for the 2012 season only; and in accord with the plans submitted and the description provided by the applicant on the record. Weber seconded the motion. VOTE: CARRIED UNANIMOUSLY Planning Commission Meeting of: March 8, 2012 MINUTES – (Informational) P a g e | 3 2. STEVE L. BOSTER - New Item LOCATION: xxx Meridian Avenue N. (CSAH 12 N) – 10 acres – S 331.15 feet of NW l/4 of NW l/4 lying west of the East line of the West 80 acres of NW l/4, Section 18, Township 120, Range 25, Wright County, Minnesota. (Buffalo Twp.) Tax # 202- 000-182203 Property owner: Worth Petitions for a Conditional Use Permit to build and locate a large animal veterinary clinic on the property as regulated in Section 603.4 of the Wright County Zoning Ordinance. Property is zoned A/R Agricultural-Residential. Present: Steve Boster and Jamie Pribyl A. Riley reviewed the property location, zoning and land use maps were displayed to show the property was zoned A/R in 2004 and part of a four-lot subdivision. The Land Use Plan included this area for the “Transition” designation. The subject property is the south ten- acres and subdivision approval required the driveway be shared. The Conditional Use Permit requested is for a large-animal vet clinic. A site plan the applicant submitted shows how the site would be developed with the location of the building, parking area, sewer and well locations noted. Riley noted the property zone allows for construction of a house also. B. Boster stated a dwelling is not in their plan. He submitted an outline of the business for the Commission’s review. He noted their current location in the City of Buffalo cannot accommodate their need to haul a horse in for treatment. The business would include a small retail area with minimal daily traffic. He anticipates the busiest day might generate ten cars to the site. There are four vets to be employed that might park vehicles behind the building. Business hours would be 8 a.m. – 5 p.m. weekdays and 8 a.m. – Noon on Saturday. Douglas asked if there might be emergencies on Sunday. Boster explained most their work takes place on site. On occasion they may have one or two horses that would be brought to the hospital for treatment. This is primarily an equine facility, cattle would not come here. The current vet clinic would remain in Buffalo and service small animals and care of pets. That business is separate from this one. C. Denn commented on the changes over time. Monticello had a large animal hospital years ago. Boster agreed the animals they care for have transitioned from primarily cattle to horses. D. Pribyl – spoke of the necessity for a place to monitor horses on occasion. Sometimes a horse has to be put on an IV, etc. and the owners are willing to trailer the horses to the hospital. Douglas asked if there is not a lot of water used. Pribyl indicated there could be 20 liters an hour. Douglas asked if they would pick up the animal; Pribyl answered no, the owners would trailer them in. E. Bakeberg questioned whether the animal limits based on this zoning would be too restrictive. Riley explained the five animal units are allowed, and it depends on the type of animal. Planning Commission Meeting of: March 8, 2012 MINUTES – (Informational) P a g e | 4 F. Considerable discussion followed regarding the animal units allowed. Boster indicated it is more than adequate and he can see no need for a larger number. Weber – indicated they should anticipate potential growth. He felt five animal units seems too limiting. Riley stated that is not an option as the size of the property is the limiting factor. There have been discussions on this and the applicant is making a conscious decision by buying this size property in this zone. Pederson noted they might give some consideration for this use because the animals are not there constantly. Weber agreed to allow some flexibility. This is a condition of the conditional use permit, but suggested if the business grows, they could buy the adjacent ten acres. Riley stated the feedlot officer has thoroughly gone over the restrictions with the applicant and he has to assume they have given this careful thought. Boster indicated he does not feel five is too restrictive. He cannot foresee more than 3-4 horses coming over a month. Pribyl again stated most services they provide take place on the farm. She also noted this is not a surgical facility, nor do the animals come here for routine work or immunizations. G. Ross Danielson – owner of a large horse/training facility – spoke in favor and need for this service. He noted there are only two similar facilities in the State. This makes it difficult when they have a horse in need of medical care. H. Denn suggested they make certain the animal units are addressed from the start. Boster stated he appreciated the concern, but the restriction will not create a problem. I. Pederson moved to approve a Conditional Use Permit to build and locate a large animal veterinary clinic on the property in accord with the plans and narrative held on file with the following conditions: 1) all the proper permits are acquired before any part of the business starts operation on site; 2) all Feedlot requirements are met, including the maximum number of animals on site be no more than five animal units and the animals allowed for care are restricted to the animals described in Wright County Zoning Ordinance Section 302 (5) (b) as livestock; 3) all buildings, parking and animals must stay outside of the wetland and any alterations of the wetland must be permitted by Wright County Soil & Water Conservation District (SWCD); and 4) wetland protection procedures and storm-water management are completed in accord with the letter from SWCD. BROUGHTON - New Item LOCATION: xxx Grunwald Avenue NW – A 16.1- acre parcel located in Gov’t Lot 2, Section 12, Township 122, Range 27, Wright County, Minnesota. (Fish Lake – Clearwater Twp.) Tax #204-100-124301 Property owner: Gary Sobotta Petitions for a Conditional Use Permit as regulated in Section 604.4 of the Wright County Zoning Ordinance to locate a kennel to house up to 35 dogs and operate a breeding, training and boarding facility for “French Brittany” dogs. This is to be the applicant’s future home-site and a proposed 45’ x 100’ building to house the dogs is proposed on the far west side of the property. Present: Steve & Kristen Broughton A. Riley presented zoning, land use and air photo maps of the 16-acre property in question. The property location on Fish Lake is zoned AG General Agricultural and in the Land Use Plan for AG.
