THE BUCKINGHAMSHIRE COUNTY COUNCIL (CHILTERN DISTRICT)(CONSOLIDATION ORDER) 2005 Operational Date: 24 November 2005 Contents Page Preamble and Definitions 3 Section 1: No waiting at any time and no loading/unloading during 6 prescribed hours Schedule 1 Section 2: No waiting at any time 9 Schedule 2 Section 3: No waiting during prescribed hours 55 Schedules 3 – 11 Section 4: Limited waiting during prescribed hours 74 Schedule 12 Section 5: No loading and unloading during prescribed hours 91 Schedule 13 Section 6: Residents Parking - Parking Places with Permits 93 Schedule 14 Section 7: Parking bays for disabled badge holders only 100 Schedule 15 Section 8: No stopping except buses during prescribed hours 103 Schedule 16 Section 9: On Street Taxi Rank 105 Schedule 17 Section 10: No stopping on school entrance markings at any time 107 Schedule 18 Section 11: Orders revoked 109 Schedule 19 Section 12: Orders partly revoked 113 Schedule 20 1 2 THE BUCKINGHAMSHIRE COUNTY COUNCIL (CHILTERN DISTRICT)(CONSOLIDATION ORDER) 2005 Buckinghamshire County Council in exercise of the powers under Sections 1(1) and (2), 2(1) to (3), 3(2), 4(1) to (3), 32, 33, 35, 37, 38(1), 45, 46, 46A, 49, 51, 53, 63A, 65, 68, 69, 71, 101, 102 and 116, and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (“the Act”), and of all other enabling powers and having regard to Section 122 of the Act and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act, hereby make the following Order: 1 This Order may be cited as “The Buckinghamshire County Council (Chiltern District)(Consolidation Order) 2005” and shall come into operation on 24 November 2005. 2 The restrictions imposed by this Order shall be in addition to and not in derogation from any restriction or requirements imposed by any regulations made or having effect as if made under any other enactment. 3 In this Order: (a) “bus” has the same meaning given by Regulation 22(2) of the Traffic Signs Regulations and General Directions 2002; (b) “Council” means Buckinghamshire County Council or any person authorised on its behalf; (c) “disabled person’s badge” has the same meaning given by Section 142 of the 1984 Act; (d) “disabled person’s vehicle” has same the meaning given by Section 142 of the 1984 Act; (e) “goods” means goods of any kind whether animate or inanimate and includes postal packets of any description and the restocking of vending machines; and “delivering” and “collecting” in relation to any goods includes checking the goods for the purpose of their delivery or collection; (f) “motor cycle” has the meaning as in Section 136 of the 1984 Act; (g) “motor vehicle” has the meaning as in Section 136 of the 1984 Act; (h) “obstruction” in relation to the parking of a vehicle, means a parking position that prevents free flow of traffic along the carriageway, footway or cycleway, access to the carriageway or egress from the carriageway; (i) “owner” in relation to a vehicle means the person by whom such vehicle is kept and used; (j) “parking attendant” means a person authorised by or on behalf of the Council to supervise and enforce the restrictions imposed by this Order; 3 (k) “parking bay” means any area of a parking place which is provided for the leaving or waiting of a vehicle and indicated by markings on the surface of that parking place; (l) “parking disc” has the meaning given by Regulation 8(5) of the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000; (m) “parking place” means any area of a highway designated as a parking place by this Order; (n) “permit holder” means a person to whom a permit has been issued under the provisions of Section 10 of this Order; (o) “relevant position” means in respect of: (a) a disabled person’s badge issued on or after 1 April 2000: (i) the badge is exhibited on the dashboard or fascia of the vehicle; or (ii) in the case of a vehicle not fitted with a dashboard or fascia panel the badge is exhibited in a conspicuous position on the vehicle, so that the front of the badge is clearly legible from the outside of the vehicle. (b) a valid resident permit if: (i) in the case of a vehicle fitted with a front windscreen on the near side of and immediately behind the windscreen in a position so as to allow the details on the obverse face to be legible from outside the vehicle; or (ii) in the case of a vehicle not fitted with a front windscreen the permit is exhibited in a conspicuous position so as to allow the details on the obverse face to be legible from outside the vehicle. (p) “resident” means a person whose usual place of abode is at premises the postal address of which is in any street or part of any street described in the Schedule 14; (q) “resident permit” means a permit issued under the provisions of Section 6; (r) “resident permit holder” means a person to whom a resident permit has been issued; (s) “school entrance markings” means any area which is comprised within and indicated by a road marking complying with the Traffic Signs Regulations and General Directions 2002; (t) “taxi” has the same meaning as “licensed taxi” as defined in Section 13(3) of the Transport Act 1985; (u) “taxi rank” means any area which is comprised within and indicated by a road marking complying with diagram 1028.2 of the Traffic Signs Regulations and General Directions 2002; 4 (v) “traffic sign” means a sign of any size, colour and type prescribed or authorised under, or having effect as though prescribed or authorised under Section 64 of the 1984 Act; (w) “undertaker” has the same meaning as in Section 48 of the New Roads and Street Works Act 1991; (x) “valid permit” means a valid resident permit which is displayed together with a valid tax disc for that vehicle; (y) “valid tax disc” means the vehicle excise licence required to be displayed in the vehicle concerned in order for that vehicle to be legally used on a public road; (z) “vehicle” has the same meaning as “motor vehicle” in Section 136 of the 1984 Act. 5 Section 1: No waiting at any time and no loading/unloading during prescribed hours 1/01 Save as provided in Articles 1/02, 1/03 and 1/04 hereof no person shall, except upon the direction or with the permission of a police constable in uniform, a traffic warden or a parking attendant, cause or permit any vehicle to wait in the lengths of road specified in Schedule 1 to this Order. 1/02 Nothing in Articles 1/01 hereof shall render it unlawful to cause or permit any vehicle to wait for so long as may be necessary for the purpose of enabling goods to be loaded on or unloaded from the vehicle in any of the lengths of road specified in Schedule 1 to this Order at any time on any day except during the times specified in Column 6 thereto. 1/03 Nothing in Articles 1/01 hereof shall render it unlawful to cause or permit any vehicle to wait in any of the lengths of road specified therein for so long as may be necessary to enable: (a) a person to board or alight from the vehicle; (b) the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely: (i) building, industrial or demolition operations; (ii) the removal of any obstruction to traffic; (iii) the maintenance, improvement or reconstruction of the said lengths of road; or (iv) the laying, erection, alteration or repair in or on land adjacent to the said lengths of road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunication system as defined in the Telecommunications Act 1984. (c) the vehicle, if it cannot conveniently be used for such purposes in any other road, to be used in the service of an undertaker or of a water authority in pursuance of statutory powers or duties; (d) the vehicle to wait at or near to any premises situated on or adjacent to any of the said lengths of road for so long as such waiting by that vehicle is reasonably necessary in connection with any wedding or funeral; (e) the vehicle to be used for fire brigade, ambulance or police purposes; 1/04 Nothing in Article 1/01 hereof shall render it unlawful to cause or permit a disabled person's vehicle which displays in the relevant position a disabled person's badge, and a parking disc (on which the driver, or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait in any of the lengths of road referred to in the said Article for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting by the same vehicle in the same length of road) provided that such period lies entirely outside the period during which the restriction as to loading and unloading specified in Article 1/02 hereof applies. 6 SCHEDULE 1 No waiting at any time and no loading/unloading during prescribed hours Col 1 Col 2 Col 3 Col 4 Col 5 Col 6 Ref Street Name Area Side of Location Prescribed No Street hours 1 White Lion Amersham North From a point 22m west of 7am - 10am Road the centreline of its junction and 4pm - with Lime Tree Walk to a 7pm point 18m west of the centreline of its junction with Little Reeves Avenue 2 Broadway Amersham South From the eastern kerbline of 8am - 9am Old Town Whielden Street eastwards and 4.30pm for 43 metres - 6pm 3 Church Street Amersham East From its junction with Market 8am - 10am Old Town Square northwards for 19 and 4pm - metres 7pm 4 Church Street Amersham East From a point 19 metres
