“FOX FOOTY NUMEROLOGY” Game of Skill Competition CONDITIONS OF ENTRY 1. Competition and Promoter 1.1 By entering the “FOX FOOTY NUMEROLOGY” Game of Skill Competition (Competition) and in consideration for the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry. Information on how to enter and prize details form part of these Conditions of Entry. 1.2 The promoter of the Competition is FOX SPORTS Australia Pty Limited ABN 16 065 445 418 of 4 Broadcast Way, Artarmon NSW 2064 (Promoter). 2. Who may enter 2.1 Subject to paragraphs 2.2 and 2.3, entry into the Competition is open to all permanent residents of Australia. 2.2 The officers, management and employees (and immediate family members of officers, management and employees) of the Promoter, Mrs Mac’s Pty Ltd (Mrs Mac’s) and their respective corporations, affiliates and associated agencies are not eligible to enter the Competition. 2.3 Each entrant may submit an unlimited number of entries in the Competition Period (defined below), provided that each entry is unique. 3. Competition Period 3.1 The Competition commences at 9:00am Australian Eastern Standard Time (AEST) on 1 July 2018 and closes at 1:00pm AEST on 28 September 2018 (Competition Period). 3.2 The Competition will be divided into 3 Entry Periods as follows: Entry Period Entry Period Entry Period Judging Date Opens Closes July 9:00am AEST on 1:00pm AEST on 29 July 2018 1 July 2018 29 July 2018 August 9:00am AEST on 1:00pm AEST on 2 September 2018 30 July 2018 2 September 2018 Overall 9:00am AEST on 1:00pm AEST on 29 September 2018 1 July 2018 28 September 2018 3.3 Entries not received during the Competition Period or not completed in accordance with these Conditions of Entry will not be eligible to win. 3.4 If for any reason an Entry Period is not capable of running as planned, including due to the delay, postponement, or for any reason whatsoever, the Promoter reserves the right in its sole discretion to suspend, postpone or cancel the Entry Period. 4. How to enter Entry submission 4.2 Eligible entrants must, during an Entry Period, tweet an AFL-related photo which is interesting from a numerological or mathematical perspective and provide, in 248 characters or less, an explanation of the numbers or mathematics in the photo, using the hashtag #numerology, (each, an Entry). 4.3 Without limiting paragraph 10 below, by submitting an entry to the Promoter, each entrant acknowledges that the Promoter may (but does not guarantee that it will) read or display the entrant’s Entry on the the FOX SPORTS channels, including during the broadcast of ‘Bounce’ on FOX FOOTY and on FOX SPORTS’ social media platforms. 4.4 To be eligible to win a prize, the entrant must have a public Twitter account and must not remove their Entry from their account the end of the relevant Entry Period. Entries that are removed prior to this date will not be considered in the Competition. 5. Prizes 5.1 Judging of all entries received during the Competition Period will be conducted by the Promoter at 50 dorcas Street, Southbank VIC 3006 on the relevant Judging date outlined above. 5.2 The entrant who submitted the most creative and unique Entry during the relevant Entry Period (as judged by the Promoter in its sole discretion) in accordance with these Conditions of Entry will win a prize comprising: (a) July Tweet of the Month Prize A month’s supply of Mrs Mac’s pies, valued at a maximum of A$100; (b) August Tweet of the Month Prize A month’s supply of Mrs Mac’s pies, valued at a maximum of A$100; (c) Overall Tweet of the Year Prize i. A month’s supply of Mrs Mac’s pies, valued at a maximum of A$100; and ii. A$1,564 in cash. 5.3 The maximum total prize value is A$1,864 (including GST). 5.4 The prize winner will be notified in writing and on the relevant episode of ‘Bounce’ as follows: Prize Entry Period Opens July 29 July 2018 August 2 September 2018 Overall 28 September 2018 The prize winners must accept or reject their prize by 12:00pm Australian Eastern daylight Time (AEDT) on 29 October 2018. 5.5 The Promoter accepts no responsibility for any variation in the value of a prize and. The prize is not assignable, transferable or exchangeable. With the exception of the prize set out in paragraph 5.2(c)(ii), the prize is not redeemable for cash and must be taken as offered. If for any reason the prize winner does not take an element of the prize during the stated period and on the conditions stipulated by the Promoter or any third party that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize. 5.6 In the event that any element of the prize is not available, the Promoter reserves the right to substitute a prize of equal or greater value. 5.7 The prize winner is responsible for all expenses not specified in these Conditions of Entry. 5.9 The prize winner acknowledges that the prize is subject to additional terms and conditions imposed by third party prize suppliers, including Mrs Mac’s. The prize winner must become acquainted with any such additional terms and conditions prior to taking the prize. The Promoter does not accept responsibility and is not liable for any conditions imposed on the taking of the prize by any other third party prize supplier. At all times whilst participating in the prize, the prize winner and their companion are required to comply with the Promoter's policies and procedures, including in particular, any policies and procedures or reasonable direction in relation to work health and safety. 6. Unclaimed prizes If a prize is unclaimed by 12:00pm AEdT on 29 October 2018, it will be awarded to the entrant who submitted the next most creative and unique Entry out of all Entries on the Competition Shortlist (as determined by the Promoter in its absolute discretion). The unclaimed prize winner will be notified by writing on 29 October 2018. The process will be repeated every 24 hours until the prize winner is contacted and the prize is claimed. The prize remains the property of the Promoter until it is collected by the selected prize winner or unclaimed prize winner as the case may be. 7. Information for Prize Winner All entrants agree to provide the Promoter with identification and/or proof of age if selected as a prize winner. In accepting a prize, each prize winner agrees to the release set out below. The form of identification and/or proof of age are at the discretion of the Promoter. 8. Limitation of Liability 8.1 Except for any liability that cannot by law be excluded (including as set out under paragraph 8.3), the Promoter, their related corporations and associated agencies (and any of their personnel) exclude all liability for any loss (including any damage, claim (including any claim pursuant to workers' compensation legislation), injury, cost or expense) which is suffered or incurred by any entrant (including the prize winner and their companion) in connection with the Competition or a prize, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter, its related corporations and associated agencies (and any of their personnel); and (iii) any liability for personal injury or death. 8.2 No responsibility will be taken by the Promoter or its authorised agents for lost, ineligible, misdirected or late entries due to technical reasons or any other reason. Entries that are not genuine or are incomplete, late or in any way fraudulent will be declared void. 8.3 Nothing in these Conditions of Entry limits, excludes or modifies, or purports to limit, exclude or modify, the statutory implied guarantees/warranties as provided under the Competition and Consumer Act 2010 (Cth) and the ASIC Act 2001 (Cth), including the statutory consumer guarantees under the Australian Consumer Law, or similar laws in the States and Territories of Australia. 9. Privacy By entering the Competition, the entrant understands and agrees that the Promoter may use and disclose the entrant’s personal information to assist in conducting the Competition and communicating with the entrant in regard to news and updates and special offers from the Promoter and its related entities. Entrants in the Competition acknowledge that the Promoter may share an entrant’s personal information with the Promoter’s Australian and foreign related entities which may contact the entrant with marketing messages and special offers. Without limiting the foregoing, the Promoter may disclose the prize winner’s personal information to third parties for the purpose of fulfilling the prize. If an entrant elects to receive information from other third parties, the Promoter may also disclose the entrant’s personal information for that purpose. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth). Entrants may find out more information about how the Promoter collects, uses and discloses personal information by reading the Promoter’s Privacy Policy, which is available at http://www.foxsports.com.au/about-us/privacy. Entrants may access the personal information the Promoter holds about them by writing to the Promoter at the address set out below. If the Promoter limits or denies an entrant access to their personal information in certain circumstances, the Promoter will tell the entrant why access was limited or denied.
