Jithender, Ranga Reddy District has filed 2nd appeal dated 10-10-2018 which was received by this Commission on 10-10-2018 for not getting the information sought by him from the PIO / The Revenue Divisional Officer, Rajendranagar Division, Pillar No.167, Attapur Village, Rajendranagar Mandal, Ranga Reddy District and 1st Appellate Authority / O/o. the District Collector, Ranga Reddy District, Khairathabad Post,Lakdikapool, Hyderabad. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 03-08-2018 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application: TSIC The Public Information Officer has not furnished the information to the appellant. Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 04-09-2018 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. As per the records the 1st Appellate Authority has not taken action to hear the appeal and pass appropriate orders. As the appellant did not get the information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. On 30-1-2020 the case is called. The appellant is present. The Public Information Officer, RDO, Rajendranagar Division is absent. The Deputy Tahsildar, O/o the RDO, Rajendranagar is present. The appellant submitted that he did not receive the sought information from the PIO. No action is taken with regard to survey of land and fixing of boundaries. The Deputy Tahsildar filed affidavit of the Public Information Officer, RDO wherein the Public Information Officer submitted that through letter dated 01.10.2018 the appellant was informed that land acquisition work is under process and his request will be considered during the process of the work. The Public Information Officer further submitted that action is being taken in the matter by Tahsildar, Rajendranagar Mandal and the Tahsildar reported to have forwarded the application of the appellant to the Mandal Surveyor for survey/demarcation of the subject land and soon after demarcation, the sought information will be furnished to the appellant. The same fact was also informed to the appellant through endorsement dated 29.01.2020. Heard the parties and perused the records. The Commission observed that the appellant herein has applied to the RDO on 01.08.2018 but no action is taken in the matter even after a lapse of more than one year. The Commission directs the PIO to once again issue instructions to the Tahsildar, Rajendranagar Mandal to furnish the sought information to the appellant within three weeks from the date of receipt of this order and submit compliance report to the Commission. With the above direction, the appeal is closed.
