The deeds of trust are second mortgages; the borrowers are selling their property in lieu of foreclosure to pay off the first mortgage owed to DHCD, and the borrowers have requested a release of the deed of trust securing the second mortgage on the basis of a hardship (e.g., loss of income due to unemployment or illness). Borrowers will sign a promissory note in the amount of the outstanding principal of the second mortgage. BACKGROUND: In April 2011, DHCD’s Neighborhood BusinessWorks lent Limerick Pub, LLC $335,000. The borrower used the loan to finance the furnishings, fixtures and equipment for a start-up Irish-themed bar at 11301 Elkin Street, Wheaton. To secure this loan, DHCD took an interest in the furnishings, fixtures and equipment and an Indemnity Deed of Trust on two of the three principals’ residences: • 3101 Moore Lane, Kensington • 2711 McComas Avenue, Kensington Reference is made to Secretary’s Agenda Item 11 (April 17, 2013) in which the Board of Public Works approved DHCD’s recommendation to substitute for loan collateral an indemnity deed of trust on 6101 Granby Road, Rockville (a property owned by the third Limerick principal) for 3101 Moore Lane.
