Thursday, 23 November 2017] 381 No 50 – 2017] FOURTH SESSION, FIFTH PARLIAMENT REPUBLIC OF SOUTH AFRICA ____________ MINUTES OF PROCEEDINGS OF NATIONAL ASSEMBLY ____________ THURSDSAY, 23 NOVEMBER 2017 1. The House met at 14:00. 2. The Deputy Speaker took the Chair and requested members to observe a moment of silence for prayer or meditation. 3. [14:01] The Chief Whip of the Majority Party moved : That the House – (1) notes that the Parliamentary and Provincial Medical Aid Scheme Act, 1975 (No 28 of 1975) (Parmed) is the compulsory medical aid for retired and current members of Parliament and Judges; (2) further notes that members of Parmed are paying high tariffs; (3) acknowledges the need to enquire into the statutory requirement regarding compulsory membership for members of Parliament; and (4) subject to the concurrence of the National Council of Provinces, establishes an Ad Hoc Joint Committee to – (a) enquire into and make recommendations on: (i) the tariffs of members of the Parmed medical aid scheme; (ii) the need for, and possible options with regard to Parmed and other competitive medical aids for members of Parliament; (iii) the necessity of introducing amending legislation; and (iv) the impact on retired members of Parmed; MINUTES: NATIONAL ASSEMBLY NO 50 – 2017 382 [Thursday, 23 November 2017 (b) consult with the Judges and provincial legislatures; (c) consist of 11 members of the National Assembly, as follows: African National Congress 6, Democratic Alliance 2, Economic Freedom Fighters 1 and other parties 2; and, 9 members of the National Council of Provinces; (d) exercise those powers as set out in Joint Rule 32 that may assist it in carrying out its task; and (5) sets the deadline by which the Committee is to report to 30 March 2018. Agreed to. 4. FIRST ORDER [14:03] Consideration of legislative proposal to amend the Public Audit Act, 2004 (Act No 25 of 2004), submitted by Standing Committee on Auditor- General (Announcement, Tablings and Committee Reports, 16 November 2017, p 2). Ms Z S Dlamini-Dubazana, as a member of the Committee, introduced the legislative proposal. There was no debate. The Chief Whip of the Majority Party moved: That the House, in terms of Rule 273(3), give permission that the legislative proposal be proceeded with. Declarations of vote made on behalf of the Democratic Alliance, Economic Freedom Fighters, Inkatha Freedom Party, National Freedom Party and African National Congress. Motion agreed to. Permission accordingly given to the Standing Committee on Auditor- General to proceed with the legislative proposal. 5. SECOND ORDER [14:23] Election of Members of Pan-African Parliament. The Deputy Speaker announced that Ms T Modise (ANC); Inkosi Z M D Mandela (ANC); Ms A T Didiza (ANC); and Mr J S Malema (EFF) have been nominated to replace Mr C Nqakula (ANC), Ms T C Memela (ANC), Dr H Mateme (ANC) and Mr N F Shivambu (EFF) as members of the Pan-African Parliament. There were no further nominations. THIRD ORDER [14:24] Designation of Members to the Magistrates Commission. The Deputy Chief Whip of the Majority Party moved: That the House designate Inkosi E M Buthelezi to replace Prof C T Msimang to the Magistrates Commission: Agreed to. Inkosi E M Buthelezi accordingly designated to the Magistrates Commission. 7. FOURTH ORDER [14:25] Consideration of Budgetary Review and Recommendation Report of Portfolio Committee on Arts and Culture (Announcements, Tablings and Committee Reports, 24 October 2017, p 212). There was no debate. The Deputy Chief Whip of the Majority Party moved: That the Report be adopted. Declarations of vote made on behalf of the Democratic Alliance, Economic Freedom Fighters, Inkatha Freedom Party, National Freedom Party and African National Congress. Motion agreed to (Economic Freedom Fighters dissenting). Report accordingly adopted. 8. FIFTH ORDER [14:34] Consideration of Budgetary Review and Recommendation Report of Portfolio Committee on Economic Development (Announcements, Tablings and Committee Reports, 24 October 2017, p 133). There was no debate. The Chief Whip of the Majority Party moved: That the Report be adopted. SIXTH ORDER [14:42] Consideration of Budgetary Review and Recommendation Report of Portfolio Committee on Women in The Presidency (Announcements, Tablings and Committee Reports, 24 October 2017, p 40). There was no debate. Mr P J Mnguni moved: That the Report be adopted. Declarations of vote made on behalf of the Democratic Alliance, Economic Freedom Fighters, Inkatha Freedom Party, National Freedom Party and African National Congress. Motion agreed to (Economic Freedom Fighters dissenting). Report accordingly adopted. [14:50] Notwithstanding the absence of the Minister of Social Development in the House, the Deputy Speaker gave a ruling on the remarks made by the Minister during Questions to the Social Services Cluster on 1 November 2017, and announced that he would instruct her to withdraw the remarks when she is present in the House. Further, notwithstanding the absence of the Chief Whip of the Opposition in the House, the Deputy Speaker gave a ruling on the remarks made by the Chief Whip of the Opposition during the Second Reading of the Liquor Products Amendment Bill on 17 October 2017, and during Questions to the Social Services Cluster on 1 November 2017 and announced that he would instruct him to apologise when he is present in the House. The Deputy Speaker gave a ruling on remarks made by Mrs HO Mkhaliphi during Questions to the Social Services Cluster on 1 November 2017, and directed her to withdraw the remark. Thereupon the member withdrew the remark. 10. SEVENTH [14:55] Consideration of Budgetary Review and Recommendation Report of Portfolio Committee on Water and Sanitation (Announcements, Tablings and Committee Reports, 10 November 2017, p 90). There was no debate. The Chief Whip of the Majority Party moved: That the Report be adopted.
