THE ARGYLL AND BUTE COUNCIL (VARIOUS ROADS, ISLE OF MULL) (WEIGHT AND LENGTH RESTRICTIONS) AMENDMENTS ORDER 2011 Sandy Mactaggart Executive Director 1A Manse Brae, LOCHGILPHEAD PA31 8RD ARGYLL AND BUTE COUNCIL (VARIOUS ROADS, ISLE OF MULL) (WEIGHT AND LENGTH RESTRICTIONS)(AMENDMENT)ORDER 2011 Argyll and Bute Council in exercise of the powers conferred on them by section 1(1), 1(2), 2(1) to (3), 3(2) and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (“the Act”) and of all other enabling powers, and after consultation with the Chief Constable of Strathclyde Police in accordance with Part III of Schedule 9 to the Act, and having complied with Part II of the Local Authorities’ Traffic Orders (Procedure) (Scotland) Regulations 1999, and being satisfied that the Order is required for avoiding danger to persons or other traffic using the road to which the order relates such that section 3(1) of the Act shall not apply, hereby make the following order: 1. This Order may be citied as “The Argyll and Bute Council (Various Roads, Isle of Mull) (Weight and Length Restrictions) (Amendment) Order 2011” and shall come into operation on the Twenty Sixth Day of August Two Thousand and Eleven. 2. The Interpretation Act 1978 shall apply for the interpretation of this Order and of all Orders revoked by this Order as it applies for the interpretation of an Act of Parliament. 3. No Person shall drive or cause or permit to be driven any vehicle whose maximum gross weight exceeds 33 tonnes on any of the lengths of road specified in Schedule 1 to this Order. 4. No Person shall drive or cause or permit to be driven any vehicle whose maximum gross weight exceeds 26 tonnes on any of the lengths of road specified in Schedule 2 to this Order. 5. No Person shall drive or cause or permit to be driven any vehicle whose maximum gross weight exceeds 18 tonnes on any of the lengths of road specified in Schedule 3 to this Order. 6. No Person shall drive or cause or permit to be driven any vehicle whose maximum gross weight exceeds 13 tonnes on any of the lengths of road specified in Schedule 4 to this Order. 7. Save as provided in Article 8 of this Order no person shall drive or cause or permit to be driven any vehicle the length of which inclusive of any load on the vehicle, exceeds 12 metres on any of the roads or lengths of road specified in Schedule 5 to this Order. 8. Nothing in Articles 3,4,5,6 and 7 of this Order shall prevent the driving upon any of the roads referred to in these Articles of any Emergency Services vehicles or any vehicle which is being used in connection with the removal of any obstructions to traffic or weather emergency on any of the roads or lengths of road so referred to or the laying, erection, alteration or repair in or near to any of the said roads or lengths of roads, of any repairs to Public Utilities apparatus, or of any telegraphic line as defined in the Telecommunications Act 1984. 9. Nothing in Article 3, 4, 5 and 6 of this Order shall prevent the driving of a vehicle of a weight in excess of that defined in these Articles provided the vehicle is unladen and such an exemption is identified as applying to that road by means of a traffic sign prescribed in diagram 627.1 in conjunction with diagram 626.2A of the Traffic Signs Regulations and General Directions 2002. 10. Nothing in Article 3,4,5,6 and 7 of this order shall prevent the driving of a vehicle of a weight or length in excess of that defined in these Articles provided an exemption has been granted by the Network and Environment Manager for Argyll and Bute which exemption shall contain such conditions as the said Network and Environment Manager may deem appropriate including where specified, provision for the indemnification of the Council by the owner or operator of such vehicle against all damage and all claims of any nature which might arise from such use. 11. The restrictions imposed by this Order shall be in addition to and not in derogation of any restriction or requirement imposed by any regulations made or having effect as if made under the Road Traffic Regulation Act 1984 as amended as aforesaid or by any other enactment. 12. The Orders specified in Schedule 6 to this Order are hereby revoked to the extent specified in relation thereto in that schedule.
