Introduction/Summary On 5th December 2007 the Council approved 15 Draft Conservation Area Character Appraisals and Management Guidelines for full public consultation. Consultation ran for a period of six weeks between the 14th December and the 25th January. This report provides members with a briefing on the consultation process and the responses received during that consultation. Over a thousand representations covering a wide range of issues were received from local residents, businesses and other stakeholders. In summary the key messages were: x The aims of preserving and enhancing the character of the Boroughs conservation areas were generally supported. x There was concern regarding the pressure for new development and in particular the way that the scale of this could encroach upon Conservation Areas, even when that development was located outside of the Conservation Area. This was of concern with regard to the Jesus Hospital Conservation Area, St Annes Conservation Area, and the Tower Conservation Area. x A considerable number of comments related to local management issues within Conservation Areas, enforcement issues, tree maintenance issues and highways issues were highlighted. One particular request which was raised repeatedly was the request for more detailed advice regarding alterations. This has been acknowledged and has been identified as a Priority for Action in many of the Conservation Areas. Also expressed was the desire for unsympathetic alterations to unlisted buildings, such as window replacement to be controlled. These matters are permitted development and can only be controlled by the declaration of an Article 4. This has been acknowledged and has been identified as a Priority for Action in a number of the Conservation Areas. This concern reflects the largely unlisted residential character of many of the Conservation Areas which were the subject of Consultation. There was also concern expressed about the limited possibilities for mansard extensions within Bow. This has been addressed with an amendment to the text in the relevant documents and with an Action which notes that the Page 3 Authority will "examine opportunities for the extension of houses as part of the Local Development Framework process". This will allow the current policy context for mansards to be recast where appropriate. Background Section 71 of the Planning (Listed Buildings and Conservation Areas) Act 1990 states that ‘It shall be the duty of a local planning authority from time to time to formulate and publish proposals for the preservation and enhancement of any parts of their area which are conservation areas. Proposals under this section shall be submitted for consideration to a public meeting in the area to which they relate. The local planning authority shall have regard to any views concerning the proposals expressed by persons attending the meeting.’ Drafts for 15 Conservation Areas were prepared, and submitted to Council on 5th December, where approval was given to proceed with the full public consultation. Those Conservation Areas for which guidance was prepared were:- Albert Gardens / Arbour Square, St Annes Church, York Square, Tredegar Square, Stepney Green, The Tower, Jesus Hospital Estate, St Matthias Church, Driffield Road, Carlton Square, Commercial Road, Medway, Fairfield Road, St Peters, and Lansbury Conservation Areas. Summary of Consultation Undertaken The Consultation Plan was prepared in discussions with the Council’s Consultation and Involvement Team. 1. Over 9000 postal addresses (including residential and business addresses) in the 15 Conservation Areas were leafleted, with a map of the relevant Conservation Area, details of the consultation and an invitation to a Public Meeting in their locality. x Three Public Meetings were held 2. The Public Meetings were advertised in East End Life. 3. All of the draft documents, and information about the Public Meetings, was placed on the Tower Hamlets website and Consultation Calendar. A consultation email address was advertised to receive comments. 4. Letters were sent to stakeholders, including public agencies, amenity societies, residents associations and registered social landlords, informing them of the draft documents and seeking their comments. The Tower Hamlets Interfaith Forum, Access Group and LBGT Society were Page 4 contacted in this way. Stakeholders were offered the opportunity of meeting officers. 5. Council Colleagues were consulted internally for their comments regarding the drafts. Summary of Comments Received Comments were received at the Public Meetings, by post and by email. Comments were received from a range of public stakeholders including English Heritage, British Waterways Board, Historic Royal Palaces, and the Port of London Authority General Comments x Many comments at the meetings described qualities of the area which were valued. In some areas, this was a quiet or residential character – in others it was a more lively social mix and mixed-use character. Aspects of the scale and appearance of the buildings were also valued. x Increased traffic in residential neighbourhoods, the proliferation of satellite dishes, repair/refurbishment work which was out of character with the area were all raised as issues. x Several responses asked for more detailed design guidance and policies for works to buildings in specific areas. x The management of open spaces and trees was a frequent concern x Other particular enforcement issues were highlighted, unauthorised works to Listed Buildings, and the introduction of satellite dishes were highlighted. Considering the Representations and Next Steps The Council is required to give regard to the comments made at the Public Meetings under Section 71 of the Planning (Listed Buildings and Conservation Areas) Act 1990. The Development Design and Conservation Team have scheduled and assessed all the comments received. This schedule has informed the amendments to the text of the documents. The comments received have also informed the Priorities for Action section of the documents to be completed. In a number of cases the comments received were not directly relevant to
