SOUTH YORKSHIRE : DONCASTER 1 (03.04.1984) The Freehold land shown edged with red on the plan of the above title filed at the Registry and being 12 Edlington Lane, Warmsworth, Doncaster (DN4 9LS). 2 There are excluded from this registration the mines and minerals excepted by the Conveyance dated 12 December 1920 referred to in the Charges Register in the following terms and the land is also subject to the following ancillary powers of working:- Except and reserving unto the Vendor in fee simple All mines and minerals in and under the said piece or parcel of land with full liberty to work and get the said mines and minerals or any adjoining mines and minerals by underground operations only without being bound to leave support for the surface or for any building thereon. 3 The land has the benefit of the rights granted by but is subject as mentioned in a Conveyance of land in this title dated 6 October 1956 made between (1) Edna Richardson and Irene Brown (Vendors) and (2) George Ellis in the following terms:- "TOGETHER with the benefit of but SUBJECT to all such rights easements quasi easements and privileges (including rights of way over the said back road) as are now used or enjoyed in connection with the property hereby conveyed and the adjoining or neighbouring properties over under or through the other or others of them respectively." 4 The Conveyance dated 6 October 1956 referred to above contains the following provision:- "It is hereby agreed and declared that the garden walls on the North West side are included in and those on the South East side are excluded from the property hereby conveyed and that the main house walls on the North West and South East sides of the property hereby conveyed and all waterpipes spouts drains and inspection chambers carrying water and drainage to and from the property hereby conveyed and the adjoining and neighbouring properties of the Vendors jointly shall be deemed to be party walls water-pipes spouts drains and inspection chambers and be repairable by the joint owners and users thereof accordingly." 1 of 3 Title number SYK189826 B: Proprietorship Register This register specifies the class of title and identifies the owner. Title absolute 1 (22.08.2016) PROPRIETOR: IAN CRAIG GILLEARD and REBECCA JANE BOLTON of 12 Edlington Lane, Warmsworth, Doncaster DN4 9LS. 2 (22.08.2016) The price stated to have been paid on 12 August 2016 was £90,000. 3 (22.08.2016) RESTRICTION: No disposition by a sole proprietor of the registered estate (except a trust corporation) under which capital money arises is to be registered unless authorised by an order of the court. 4 (22.08.2016) The Transfer to the proprietor contains a covenant to observe and perform the covenants referred to in the Charges Register and of indemnity in respect thereof. Schedule of restrictive covenants 1 The following are details of the covenants contained in the Conveyance dated 12 December 1910 referred to in the Charges Register:- "The Purchaser for himself and his assigns and to the intent and so as to bind not only himself personally but also (so far as practicable) all persons claiming title under him doth hereby covenant with the Vendor and the owner or owners for the time being of any hereditaments in the Parish of Warmsworth in the County of York devised or expressed to be devised by the Will and Codicils of the late William Battie- Wrightson which may for the time being remain unsold and any person or persons to whom the benefit of the present covenant may be assigned by her or them to observe and perform the terms and conditions set out in the Second Schedule hereto so far as they are to be observed or performed by the Purchaser And the Vendor doth hereby covenant with the Purchaser to observe and perform the said terms and conditions so far as they are to be observed or performed by the Vendor. THE SECOND SCHEDULE above referred to Particulars of Stipulations covenants and Restrictions 1. The Purchaser shall be bound:- (a) To erect and within eighteen calendar months from the date hereof complete upon the piece of land conveyed by the above written Indenture under the inspection and to the satisfaction of the Surveyor of the Vendor and in accordance with plans elevations and specifications to be first approved by such Surveyor nineteen dwellinghouses (two of which may be used as shops and the remaining houses to be used for private residence only) of the cost value at least of £175 each with outbuildings and appurtenances. (b) Within eighteen calendar months to erect and thereafter maintain 2 of 3 Title number SYK189826 Schedule of restrictive covenants continued on the North East and South boundaries in front of the building line between the points A, B, C and D on the said piece of land a good and substantial brick or stone wall with suitable coping surrounded with or without ornamental iron palisading the uniform height of such wall and palisading (if any) to be Four feet above the level of the adjoining footpath and on the South North and West boundaries behind the building line where not occupied by buildings to erect and thereafter maintain a good and substantial stone or brick wall (with proper coping) or some other suitable fence approved by the Vendors Surveyor such fence to be not less than four feet six inches nor more than seven feet in height above the grounds adjoining. (c) To front the house to the building line shewn on the plan referred to in the above written Indenture and not to erect any building or part of a building except bay windows and porches of ordinary size nearer to Ellington Lane than such building line and will whenever thereunder required by the Doncaster Rural District Council or other Local Authority transfer to them the strip of land between the frontage line and the line of the existing fence as shewn on the said plan for the purpose of widening Ellington Lane and will bear the expense of throwing the said piece of land into the road unless the District Council will agree to bear the same. (d) Not to put out any light or window in any walls or buildings abutting on the North West and South boundaries of the said piece of land. (e) When called upon so to do by the Vendor to well and sufficiently form channel draw make and asphalt to the satisfaction of the Doncaster Rural District Council one half in width of the back road shewn on the said plan so far as the same is co-extensive with the said piece of land and to keep such back road and the sewer and drains thereunder in good repair and condition until the same shall be taken over by the Local Authority. (f) To keep in good repair and condition one half of Edlington Laneso fa r as it adjoins the said piece of land and the footpath thereto and the drains thereunder and (if so required by the Vendor) to flag or asphalt the said footpath. (g) To pay in common with the owners of the adjoining sites his proportionate part of the cost of making up such roads asphalting or flagging the footpaths and of any other work or expense incidental to or connected with the taking over of such roads by the Local Authority the amount payable to be conclusively fixed in each case by the Vendors Surveyor. (h) Not to carry on or permit to be carried on any offensive trade or business on the said piece of land nor do or suffer to be done any act or thing which shall or may be or become a nuisance damage annoyance or inconvenience to the Vendor or other owners or occupiers of adjoining land or the neighbourhood and not to use or allow to be used the said piece of land or any part thereof or any buildings erected thereon for the sale of beer wine spirits or other exciseable liquors.
