Others: Cllr Alan Bowness (CCC) & 3 members of the public attended 138/20 Apologies Cath Johnson (LDNPA) 139/20 Minutes of last Above Derwent Parish Council meeting The Chairman was authorised to sign, as a correct record, the minutes of the Parish Council Meeting held on 18th December 2019 140/20 Declarations of Interest/requests for dispensation None 141/20 Exclusion of Press and Public (Public Bodies Admission to Meetings Act 1960) Item 146.1 142/20 Public Participation Andrew Nelson – Cumbria and Lakes Local Access Forum - regarding the reclassifying of Portinscale Bridge. The history of the issues were reiterated. 143/20 National Trust Representatives No representative attended The Clerk to chase up the cutting of gorse on the Newlands to Braithwaite road 144/20 National Park Representatives Cath Johnson sent her apologies with a report updating the parish council about Whythop Woods, Little Braithwaite to Stair and the Derwentwater Cycle Way which was noted. Style collapsed from Ladstock to Whinlatter 145/20 Ward Representatives To receive reports on issues relevant to the Parish 145.1 Cumbria County Councillor – Allan Bowness. It was agreed to reiterate ADPC’s position supporting the proposed ban of cyclists on Portinscale Bridge. The gritting routes are being updated for winter 2020/2021, school routes are being included in the priority routes, it was noted that the road by Middle Ruddings needs gritted. CCC Highways meeting – Winter Ready – explaining how the system works. CCC receive a weather update at 1pm, and if frost is forecast the gritters will be instructed to grit. It uses less grit to prevent ice forming than curing the ice. Some roads have heat sensors in and there are cameras monitoring the road conditions too. The Working Together scheme will hopefully progress in spring 2020. The road from Newlands – Braithwaite condition was noted again. The continued use of the highways hotline/website was noted as being positive. Double yellow lines towards Catbells and on Whinlatter need repainted on to the road. 3 trees by the primary school are also in need of attention. 145.2 Allerdale Borough Councillor – Carmel Bell did not attend the meeting despite numerous Requests to attend. No responses have been received. The Clerk to contact ABC regarding the non-attendance. The ADPC response to the Budget Consultation was discussed and it was agreed that we were disappointed that Carmel did not attend as discussions with her regarding ADPC’s response would have been beneficial and appreciated. Concerns were raised regarding the lack of consultation with electors. It was agreed to respond stating if a 2% increase ensures that all services will be maintained as currently provided it would be supported, otherwise we do not support the increase. The fence at the bring site recycling centre at Newlands needs repaired, and the bins been to be emptied more regularly. 145.3 LDNPA – the written report from Cllr. Geoff Davies, Parish member North distinctive are was noted 146/20 Consultations/Projects requiring action or decision 146.1 Parish councillor vacancies – It was agreed to co-opt Karen Hind & Jonathan Hill on to ADPC. The Declaration of Acceptance of Office were signed and Register of Interests completed. 146.2 United Utilities – The Clerk advised that due to data protection United Utilities cannot divulge information regarding specific properties. UU have advised that there are some lining works planned to remove surface water infiltration from the sewer at the rear of Howe Lane. The response to be sent to the parishioner to see if this will resolve the issue. JPP to continue to try and contact the parishioner. The Environmental Information Request regarding the Service inlet in Braithwaite has been received and noted. 146.3 Risk Assessments for Defibrillators – To defer to the February meeting due to the absence of Cllr David Sanderson 146.4 Speed issues – It was agreed to inform Cumbrian Police of the following areas which ADPC request speed monitoring: 1. Braithwaite - outside the primary school, with a view to gain 20 mph speed limit. Justification: outside primary school and opposite HPB, no footpaths present up from Middle Ruddings into village, to address pollution, requested as part of the community plan. 2. Portinscale - outside Dorothy Well - past Farmers Arms and at the end of Rickerby Lane - with a view to gain 20 mph speed limit. Justification: no footpaths along this part of the road so lots of pedestrians to and from holiday lets/B&Bs/residents to and from pub, to address pollution, and request as part of the community plan. 3. Thornthwaite - overwhelming evidence that the 30mph speed limit is not adhered to within the village (data gathered from community speed watch organised in conjunction with police in spring 2019). To be sited between the bus shelter and Thornthwaite Grange. Current speed limit is 30mph, with a view to gain 20 mph speed limit. Justification: no footpaths along this part of the road so lots of pedestrians to and from holiday lets/B&Bs/residents and drivers do NOT stick to current speed limit, to address pollution, and requested as part of the community plan. 4. Thornthwaite/gallery A66 junction - deep concern re the junction. Cars overtake from Keswick when driving westwards, when vehicles are slowing to turn left into this junction. The act of overtaking takes them over double white lines, into the red box and into right hand filter lane of oncoming eastbound traffic. Countless residents have cited multiple experiences of the law being breached and personal near misses. Eastbound traffic forced to stay in left hand lane and not turn into right hand filter lane. Residents now drove along old A66 past a nursery to the Middle Ruddings junction to exit onto A66 where it is felt to be safer due to island in middle of road. Linked with this, is the excessive speeds along this strip of A66. There is an issue of speeding from Keswick Junction, past Portinscale to the Thornthwaite/Gallery junction The Clerk to send to Cumbria Police. 146.5 Climate Change working group – No update available 147/20 Action Reports/Updates from Councillors 147.5 Policies – the following policies were adopted: Policy Date of Adoption / Latest Review Date for Review Category Training Policy Jan-18 Jan-20 C 147.6 ADFG – No written report if received. Sub group to meet once more members join. Tree blown down and needs removed at Braithwaite junction – Clerk to report to Highways England. 147.8 Lengthsman report – the report to parish councillors prior to the meeting was noted. 148/20 Applications for Development 148.1 The following application/s for development were considered: Ref no.
