I hereby request that an interim study committee be formed to study data concerning driving under the influence of drugs, which data has become available since HB17-1315 went into effect, during the interim between the 2018 and 2019 legislative sessions. The interim study committee would be named the “Interim Study Committee to Study DUID Evidence”. The policy issue to be studied is whether the DUID evidence that has become available since HB17-1315 went into effect is sufficient and clear enough to demonstrate a need for legislation in the 2019 regular legislative session concerning DUID. The interim study committee would need to meet two times to study the issues. The interim study committee should consist of four members of the General Assembly selected as follows: Two members of the Senate, with one appointed by the President of the Senate and one appointed by the minority leader of the Senate; and Two members of the House of Representatives, with one appointed by the Speaker of the House of Representatives and one appointed by the minority leader of the House of Representatives. The chair of the interim study committee will be the appointee of the Speaker of the House of Representatives, and the vice-chair will be the appointee of the appointee of the President of the Senate. The appointments must be made by June 1, 2018. Two nonlegislative members will assist the interim study committee in analyzing DUID data. Nonlegislative members shall not be permitted to vote on any matter; rather, the nonlegislative members shall use their expertise to inform the interim study committee in its deliberations. The nonlegislative members of the interim study committee shall include: One person who represents a statewide organization that provides research, education, and advocacy concerning drug-impaired driving and who is a parent of a person who was killed in a DUID-related accident, to be appointed by the minority leader of the House of Representatives; and One person representing the Division of Criminal Justice within the Department of Public Safety, to be appointed by the executive director of the Department of Public Safety. The interim study committee may require, at most, one bill to address the issues it studies. Additional Information Related to the Interim Study Committee Request The Division of Criminal Justice within the Department of Public Safety, the Colorado District Attorney's Council, the Colorado Defense Bar, the Colorado Sheriffs’ Association, and the Colorado Association of Chiefs of Police may be called upon to provide assistance or information to the interim study committee.
