ELECTORAL (REVISION OF CONSTITUENCIES) BILL, 1934. BILL entitled AN ACT TO REVISE, IN PURSUANCE OF ARTICLE 26 OF THE CONSTITUTION, THE CONSTITUENCIES (OTHER THAN UNIVERSITY CONSTITUENCIES) BY WHICH THE MEMBERS OF DAIL EIREANN ARE ELECTED 10 AND, IN CONSEQUENCE OF SUCH REVISION, TO ALTER THE NUMBER OF MEMBERS OF DAIL EIREANN, AND FOR THOSE AND OTHER PURPOSES TO AMEND THE LAW RELATING TO THE ELECTION OF MEMBERS OF DAIL EIREANN. 15 BE IT ENACTED BY THE OIREACHTAS OF SAORSTAT EIREANN AS FOLLOWS: The Principal 1. —(1) In this Act the expression “ the Principal Act ” means Act. the Electoral Act, 1923 (No. 12 of 1923). (2) Every word and expression to which a particular meaning 20 is given by the Principal Act for the purposes of that Act has in this Act the meaning so given, save that the word “ pre­ scribed ” means prescribed by order made by the Minister for Local Government and Public Health. Revision of 2.—The Eighth Schedule to the Principal Act is hereby 25 Constituencies. amended as follows, that is to say:— (а) by the deletion of the words “ nineteen hundred and twenty-three ” now contained in rule 2 of the said Eighth Schedule and the insertion in that rule of the words “ nineteen hundred and thirty-four ” in lieu of 30 the words so deleted, and (б) by the deletion of Part I of the said Eighth Schedule and the insertion in that Schedule of Part I of the First Schedule to this Act in lieu of the Part so deleted, and 3f» (c) by the deletion of Part II of the said Eighth Schedule and the insertion in that Schedule of Part II of the First Schedule to this Act in lieu of the Part so deleted, and the Principal Act, and in particular section 50 thereof shall 40 be construed and have effect accordingly. 2 3.—So much of sub-section (1) of section 50 of the Principal Number of Act as enacts that Dail Eireann shall consist of one hundred of and fifty-three members shall cease to have effect on the com ­ mencement of this Act, and in lieu thereof it is hereby enacted 5 that Dail Eireann shall consist of one hundred and thirty-six mem­ bers returned by borough constituencies and county constituen­ cies, together with such number of members (if any) as is for the time being required by law to be returned by university con­ stituencies. 10 4.—(1) The officer specified in the second column of the Second Returning officers Schedule to this Act opposite the name in the first column of the and assistant said Second Schedule of any constituency shall be the returning returning o cers. officer for that constituency. (3) Sub-section (1) of section 23 of the Principal Act is hereby repealed. 2q 5.—The County Constituency of East Galway as defined in Constituency of Part II of the First Schedule to this Act shall be the constituency ^eann N corresponding, for the purposes of Article 21 of the Constitution, ° air e' to the County Constituency of Galway existing at the passing of this Act. 25 6.—Paragraph (b) of sub-section (2) of section 41 of the Prin- Amendment of eipal Act is hereby amended by the deletion of the words section 41 of the “ adjoining the constituency ” now contained therein, and the PrinciPal Act. insertion of the words “ adjoining the county in which the con­ stituency or the greater part thereof is situate ” in the said 30 paragraph in lieu of the words so deleted, and the said section shall be construed and have effect accordingly. 7.—(1) The title-page of every electors list, list of claimants, list Title-page of of objections, and register of electors prepared under the First electors lists, etc. Schedule to the Principal Act after the passing and before the 35 commencement of this Act for a registration unit in a consti ­ tuency existing at the passing of this Act which is not identical in area and name with a constituency defined in the First Schedule to this Act, shall show in the prescribed manner the name of the constituency defined in the First Schedule to this Act in 40 which such registration unit will be situate as well as the name of the said existing constituency in which such registration unit is situate at the passing of this Act. (2) This section shall come into operation immediately upon the passing of this Act. 45 8.—Save as is otherwise provided by this Act, this Act shall ^'f0^^ei^nent come into operation immediately upon the dissolution of the Oireachtas which shall occur next after the passing of this Act. 9.—(i) This Act may be cited as the Electoral (Revision of Short title and Constituencies) Act, 1934. citation. 50 (2) The Electoral Acts, 1923 to 1927, and this Act may be cited together as the Electoral Acts, 1923 to 1934. 3 FIRST SCHEDULE. REVISED CONSTITUENCIES. Part I. BOROUGH CONSTITUENCIES.
