Present: Jim Bailey, Malcolm Bowes, David Chance, Alison Fisher, Janet Frank, Bryn Griffiths, Christopher Massey, Jane Mitchell, Sarah Oswald, Caroline Patmore, Ted Sanderson, Andrew Scott, Hawson Simpson, Helen Swiers, Richard Thompson, Herbert Tindall Apologies: David Jeffels, Bill Suthers, Jeremy Walker Copies of All Documents Considered are In The Minute Book 34/14 Minutes: Resolved: That the minutes of the meeting held on Thursday 15 May2014, having been printed and circulated, be taken as read and be confirmed and signed by the Chairman as a correct record. 35/14 Members Interests Members were reminded of their responsibility to declare any personal and prejudicial interests relating to any agenda item prior to its consideration 36/14 Forestry Design Plan Consultations – East Moors and Riccaldale (FDP15) Considered: The report of the Woodland Officer Recommendation: That: The East Moors and Riccaldale Forest Design Plan is welcomed for the contribution to the National Park Management Plan Officers pass on any other comments to the Forestry Commission which Members may wish to make. Resolved: That the East Moors and Riccaldale Forest Design Plan was welcomed for the contribution it will make to the National Park Management Plan. 37/14 Miscellaneous Items Considered: The report of the Director of Planning. Resolved: That the report be noted. 38/14 Applications for Planning Permission The following members of the public addressed the meeting regarding the Plans List Items indicated: Plans List Item 1 – Rod Hepplewhite spoke in favour of the application, Chris Johnson spoke against the application. Plans List Item 2 – Anthony Laughton spoke in favour of the application. Plans List Item 4 – John Anderson spoke in favour of the application. Plans List Item 6 – Chris Foster spoke in favour of the application. Plans List Item 7 – John Noble spoke in favour of the application and Joan Hall spoke against the application Plans item 8 – Chris Parkin spoke against the item for Helmsley Town Council. Plans List Item 9 – Jennifer Smith spoke in favour of the application, Andrew Chappell spoke against the application. Considered: The report listing applications and the Director of Planning’s recommendations thereon. Members also considered further information circulated on the Members’ Update Sheet at the meeting including; updated recommendations from the Director of Planning and comments received after the agenda was printed from: consultees, objectors and supporters. Resolved: (a) That with regard to all applications listed in the report and subject to: (i) the amendments specified below; and (ii) the imposition of conditions in accordance with the relevant provisions of Sections 91-94 of the Town and Country Planning Act 1990, except in those instances where an alternative condition is contained in the Director of Planning’s recommendation or in an amendment referred to in (i) above; decisions be given in accordance with the Director of Planning’s recommendations: List Plan No and Description of Proposal No 1. NYM/2013/0684/CU – Change of use from car repair workshop to cycle repair, sales and hire shop together with associated café at former Garage on Blackhorse Lane, Swainby for Mr John Nelson, 5 Enterpen, Hutton Rudby, Yarm, North Yorkshire, TS15 0EL Decision Brynn Griffith declared a personal interest in this item as the application is within his county council division. Approved as recommended with an additional condition and an amendment to condition 8. 8. GACS00 No more than six covers shall be provided at any one time within the proposed café element of the development and no tables or chairs shall be provided outside of the building unless otherwise agreed in writing by the Planning Authority. 9. HWAY00 No access shall be provided for any purpose, to or from the site, to the north side of the premises onto the A172 unless otherwise agreed in writing by the Local Planning Authority. 2. Decision Brynn Griffith declared a personal interest in this item as the application is within his county council division. Approved as recommended. 3. NYM/2014/0208/FL – Construction of an extension at 51 Rosedale Lane, Port Mulgrave for Mr & Mrs Gary & Karen Chadfield, 51 Rosedale Lane, Port Mulgrave, Saltburn by the Sea, TS13 5LD Decision David Chance declared a personal interest in this item as the application is within his county council division. Approved as recommended. 4. NYM/2014/0181/FL – Sub-division of dwelling to form 1 no. dwelling and 1 no. holiday cottage (retrospective) at Dale View, Fryupdale, for Mr & Mrs Anderson, Dale View, Fryupdale, Whitby, Y021 2AP. Decision Helen Swiers declared a personal interest in this item as the application is within her county council division. Approved as recommended. 5. NYM/2014/0270/FL – Erection of covered parking area and store at Verdun House, Bank Lane, Faceby for Mr Richard Birch, Verdun House, Bank Lane, Faceby, Cleveland, North Yorkshire, TS9 7BW. Decision Brynn Griffith declared a personal interest in this item as the application is within his county council division. Approved as recommended but delegated to officers to resolve an administrative issue in respect of submitted ownership certificate. 6. NYM/2014/0259/FL – Construction of 1 no. temporary agricultural workers dwelling and 2 no. agricultural buildings together with creation of access road and landscaping works (revised scheme to NYM/2013/0506/FL) at land a Rake Lane, Lealholm for Mr C Foster. Decision Helen Swiers declared a personal interest in this item as the application is within her county council division. Approved as recommended with an amendment to condition 3. 3. TIME00 This consent for a temporary workers dwelling is only valid for five years from the date of this approval. At the end of the five year period, the site shall be completely cleared and restored to its original condition within 1 year of the expiry of the consent. 7. NYM/2013/0763/FL – Change of use of land to form waste transfer station, construction of associated buildings, creation of access road and landscaping works at land adjacent Wilf Noble Building Supplies, Sneaton Lane Ruswarp for Wilf Nobles Limited, Sneaton Lane, Ruswarp, Whitby, North Yorkshire, YO22 5HL. Decision David Chance declared a personal interest in this item as the application is within his county council division and district council division. Consideration deferred to enable a site visit to be undertaken to enable Members to fully assess the access, amenity and privacy impacts of the proposal on the locality, with the attendance of Members being regarded as an approved duty for the purposes of the payment of Members’ allowances. 8. NYM/2012/0355/FL – Conversion of barn to form 4 no. flats together with construction of 17 no. dwellings following demolition of accommodation block and storage barn and extension to Hotel parking area at land to the rear of the Black Swan and Crown Hotels, Swan Way, Helmsley for Kwanani Services Ltd, c/o Westwinds Offshore Ltd, 1st Floor Murdoch House, North Shore Road, Ramsey Isle of Man, IM8 3DY. Decision Approved as recommended but delegated to the Director of Planning subject to the negotiating of a S106 agreement to ensure the four flat properties remain affordable in perpetuity and including an overage provision to reflect any significant changes in affordable housing viability during the construction phase addressed by means of a commuted sum in lieu of providing additional affordable housing. Furthermore that a public open space contribution of £46,370 be provided. 9. NYM/2014/0283/FL – removal of condition 6 of planning approval NYM/2011/0246/FL to allow the range of refreshments and customer base to be unrestricted at Ryedale Folk Museum, Hutton-le-Hole for Ms Jennifer Smith, Ryedale Folk Museum, Hutton-le-Hole, North Yorkshire, YO62 6UA. Decision Jim Bailey declared a personal interest as he knew both speakers. Janet Frank declared a personal interest as the site in her Council ward. Approved as recommended. 10. NYM/2014/0238/FL – Use of land for the siting of 5 no. touring caravans and 7 no. hobbit pods together with associated access and landscaping at Golden Hill Farm, Liverton Road, Liverton for Ms C Hopkinson, Golden Hill Farm, Liverton Road, Liverton, Redcar & Cleveland, TS13 4TJ. Decision Approved as recommended. 11. NYM/2014/0053/FL – Replacement of timber windows and doors with white uPVC at 6 Hall Garth Lane West Ayton for Mr D Rex, 6 Hall Garth Lane, Ayton, Scarborough, North Yorkshire, YO13 9JA. Decision Approved as recommended. 39/14 East and West Ayton Conservation Area Appraisal and Management Plan: Correction to Boundary Map Considered: The report of the Building Conservation Officer Recommendation: Officers request that Members agree that their Resolution of 15 May 2014 incorporates the corrected maps.
