The High Court of New Zealand, in Lyttelton Marinas Ltd v Canterbury Regional Council, has held that these authorisations are now Deemed Coastal Permits for both the structures and the concomitant occupation of space and endure in perpetuity unless specifically limited in the conditions of the Section 178(b) Harbours Act 1950 authorisation. No further consents for the structure or occupation of space are required for these activities as they are lawfully established.
