Introduction and Objectives 1. The World Bank will provide loan of USD 14 Million for the implementation of "Anhui Aged Care System Demonstration Project". Such project will be implemented at Anhui provincial level and in Anqing, Ningguo city and Xuanzhou District of Xuancheng, Wuhu, Lu'an, and Yongqiao District, Xiao County, Dangshan County and Lingbi County of Suzhou. The objective of this project is to support establishment and management of diversified aged care service system of Anhui Provincial Government. Such a system consists of three levels: home-based aged care, community aged care and institutional aged care. 2. Main purpose of formulating this ESMF is to minimize the adverse impact of the project implementation on the environment and society, formulate effective measures to mitigate or eliminate the adverse effect of this project and manage and implement this project in accordance with the environmental and social safeguard policies of the World Bank and relevant policies of China. 3. This ESMF is part of legal agreement of this project, consists of the principal text and two attachments and contains the project objectives, procedures, institutional arrangement and project schedule and identification and management of the project's potential impacts on the environment and society. In addition, this ESMF also includes public consultation, grievance mechanism and recommended applicable screening tools for all sub-projects. II. Project Overview The project scope is located in Anhui Province, including Yongqiao District, Dangshan County, Lingbi County, Xiao County and Si County of Suzhou, various districts of Anqing, Lu'an, Wuhu, and Xuanzhou District and Ningguo City of Xuancheng. This project includes four components: Anhui provincial comprehensive aged-care service support component, community home-based aged care service improvement component, professional nursing service provision component and the component of management capacity, project management, monitoring and assessment and capacity building. The component I includes construction of comprehensive aged-care service information system, capacity and demands assessment system for the aged, construction of standard aged-care service system and cultivation of professional aged-care service talents. The component II includes upgrading of 161 home-based aged care service stations in Anqing and 3 Environment and Social Management Framework (ESMF) World Bank-financed Anhui Aged Care System Project Lu'an (Lu'an will add another 16 stations in the later period); two government-procured services in Anqing and Lu'an. The component III includes construction and upgrading of seven community day-care centers (including the nursing homes), one training center and recreational and sports center for the aged, one kitchen, one big health management information data center in Wuhu; construction of one medical and aged-care institutions in Anqing and Lu'an respectively; relocation and reconstruction of Xuanzhou District Social Welfare Home and construction of one social welfare service center in Ningguo City; upgrading and transformation, upgrading or expansion of 35 rural nursing homes in Yongqiao District, Dangshan County, Xiao County, Si County and Lingbi County of Suzhou. The component IV is project management and capacity building, to ensure effective implementation of the policies and procedures of the World Bank and rules of China and improve the project construction and management level of the PMO and project implementing agency (PIA) and thus ensure the smooth advancement and completion of the project. The project fund mainly stems from loan of the World Bank, allocations of the local government and self-raised fund of the PIA. Of which, the loan of the World Bank is 965,384,000 Yuan (equivalent to 14 million dollars), accounting for 52.49% of the total investment; allocations of the local government is 298,488,600 Yuan, accounting for 16.23% of the total investment; the self-raised fund of the PIA is 2,368,200 Yuan, accounting for 24.6% of the total investment, other funds (include funds for TCM inheritance project and construction for general practitioner training base) 123,000,000 Yuan, accounting for 6.69% of the total investment Most of the project contents have been identified at the project preparation stage. Measures to mitigate the impacts on environment have been included in the EMP. The project may produce a small amount of investment which was not identified at the project preparation stage. However, basically, the investment will be used in the construction and reform of aged-care service institutions and construction of the aged-care service system. For instance, types, scale and contents of the potential sub-projects of home-based aged care service center of Lu'an (16 will be added in the later period) will be basically the same. 4 Environment and Social Management Framework (ESMF) World Bank-financed Anhui Aged Care System Project III. Policy Framework of Environmental and Social Problems This ESMF is prepared in accordance with the following laws and regulations of China and the World Bank's security policies. (1) Laws and regulations of China China has a series of laws, regulations, technical guidelines and standards on environmental protection and environmental impact assessment which must be complied with in project construction, including the technical guidelines for prevention and control of air, noise, water, ecological and solid waste pollution, and for assessment of the air, noise, water and ecological conditions. The main laws and regulations of China related to this project are as follows: 1) Environmental Protection Law of the People's Republic of China (implemented as of January 1, 2015); 2) Law of the People's Republic of China on Prevention and Control of Water Pollution (implemented as of June 1, 2008); 3) Law of the People's Republic of China on Prevention and Control of Atmospheric Pollution (implemented as of September 1, 2000); 4) Law of the People's Republic of China on Prevention and Control of Pollution from Environmental Noise (implemented as of March 1, 1997); 5) Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste (implemented as April 1, 2005); 6) Law of the People's Republic of China on Environmental Impact Assessment (implemented as of September 1, 2003); 7) Law of the People's Republic of China on Water and Soil Conservation (implemented as of March 1, 2011); 8) Water Law of the People's Republic of China (implemented as of October 1, 2002); 9) Regulations on Environmental Protection Management of Construction Projects (implemented as of November 29, 1998); 10) Law of the People's Republic of China on the Protection of Wildlife (implemented as of August 28, 2004); 11) Law of the People's Republic of China on the Protection of Cultural Relics (implemented as of December 19, 2007); 5 Environment and Social Management Framework (ESMF) World Bank-financed Anhui Aged Care System Project 12) Flood Control Law of the People's Republic of China (implemented as of August 29, 1997); 13) Land Administration Law of the People's Republic of China (implemented as of August 28, 2004); 14) Regulations of the People's Republic of China
