##MAILMERGE Do not delete this text or change the colour from white This matter is being dealt with by: Robert Portman Reference: SCR/3648 T 0115 9774291 E [email protected] W nottinghamshire.gov.uk Jenny Salt Fisher German The Estates Office Norman Court Ivanhoe Business Park By E-Mail Only Ashby de la Zouch Leicestershire LE65 2UZ Dear Jenny 4th May 2017 Proposal: EIA Screening Opinion Request - Installation of Sewer Rising Main between Cotgrave STW to Radcliffe STW and Final Effluent/Storm Sewer from Radcliffe STW to the River Trent discharge point Location: Cotgrave Sewage Treatment Works to Radcliffe on Trent Sewage Treatment Works to River Trent I refer to the above screening opinion request received by the Waste Planning Authority (WPA) on the 12th April 2017, as to whether the proposed Cotgrave Sewage Treatment Works (STW) to Radcliffe on Trent STW and Radcliffe STW to River Trent pipelines would necessitate assessment under the EIA Regulations as a proposal likely to have significant effects on the environment. The WPA considers that the proposed development would fall under Schedule 2 of the Regulations (Category 10 (l) Installations of long-distance aqueducts, with an area of works exceeding 1 hectare). Having assessed the proposed development against the selection criteria in Schedule 3 of the Regulations, the WPA considers that the proposed development does not require and Environmental Impact Assessment. The attached ‘Schedule 3 Form’ details how the Schedule 3 selection criteria have been considered against the proposed development. Section 5 (Screening Schedule 2 Projects) of the Planning Practice Guidance (dated 6 March 2014) states that environmental impact assessment will be required for developments which are likely to have significant effects on the environment; and which are located in, or partly in, a sensitive area. It is considered that the proposals for the Cotgrave STW and Radcliffe STW pipelines would not meet these criteria. The WPA acknowledges that the proposed development is classed as permitted development under the Town and Country Planning (General Permitted Development Order) (England) 2015 Part 13, Class B (a) ‘development not above ground level required in connection with the provision, improvement, maintenance or repair if a sewer outfall pipe, sludge main or associated apparatus’. Therefore it does not require an application for planning permission in support of the proposals. The applicant should be aware that, as discussed, along areas in close proximity to and potentially crossing the route of the proposed pipeline there is a lapsed planning permission for a multi-user route along the former Cotgrave Colliery rail line. It may still be the intention of Nottinghamshire County Council (NCC) to complete this route and it is therefore advisable for the developer to discuss this further with NCC estates and NCC Countryside Services.
