Tender should be placed in sealed cover super scribed with the name of work, Serial no. & NIT No. 3. Submitted Xerox copy of all documents duly attested by any Gazeted Officer for verification of documents. 4. Tender documents shall consist of :- a) NIT b) West Bengal Form No. 2911/1 (II) c) Specification. d) Special terms and condition. e) Schedule of quantities and rates. f) Relevant drawing if any. 1) Tender should be placed in sealed cover superscribed with the name of work. Sealed tender only are to be considered and not any other letter or other instrument submitted separately modifying the sealed tender. 2) Tender documents are to be purchased on payment as per attached sheet per set in cash [non refundable]. Before purchasing the tender document formal permission in writing from the tender inviting authority production of necessary valid I.T & S.T clearance certificate in original and credentials in original in support of technical and financial capability for the same type of work, professional tax clearance Certificate in original, other clearance certificate in original under West Bengal State Tax on Professional Trade, without of which no paper will be issued. 3) Intending tenderers shall obtain tender forms well in advance. Dissatisfaction in this respect if any may be brought to the notice of E.I.C. and or Divisional Accounts Officer forthwith individually by the intending tenderers. No complaints afterwards in this regard will be entertained from this end. 4) Intending tenderers must declare, if there is any other farm or farms having common or identical interest with them. 5) No arbitration to the work will be admissible as per Govt. rule 19 part IV of the special P.W.D rules 1987 clause 25 of W.B. Form (ii) / 2911 may be treated as deleted for the instant work/works for Which Tender invited. 6) Attested / photocopy of S.T./I.T./P.T. /Trade License and credentials will not be accepted unless original copies are shown during application for tender. 7) The tenderer shall quote his rate on the basis of percentage i.e. less / at par / above to the schedule of rate. The rate quoted shall be considered as inclusive of sales tax and all other taxes and charges. This should be quoted in figures and words. 8) The intending tenderer shall have to deposit the earnest money as per enclosed statement along with the tender documents in the form of Bank Draft (Any Nationalized Bank)/ Treasury Challan in favour of the Executive Engineer, Birbhum Division, P.H.E. Dte. NSC, KVP etc. will not be entertained as Earnest Money even it is duly pledged. Fixed deposit, if any of the enlisted contractors of this Directorate will be considered on production of documents for the same. However, Fixed Deposit of enlisted contractors will not be accepted as Earnest money in the work where bonafied outsiders as per Tender Rules are also eligible. 9) The proprietor of each agency / Chairman / Secretary have to present during submission of application and purchasing of tender paper. In exceptional cases they may send their authorised person with letter of authority bearing attested signature of the representative in their office pad or they may send their application by post, if otherwise in order which must reach this office within the stipulated date and time. 10) The acceptance of the tender will rest the accepting authority who does not bind himself to accept the lowest or any tender reserves for himself the right to reject in part or in full or all tenders received or split up the work in different group without assigning any reason thereof. 11) Work order shall not be issued to a contractor if he fails to submit the labour license certificate registered under the provision of contract labour [Regulation and abolition] Act 1970 as applicable. This should strictly followed. 12) Under any circumstances, if any of the days or day of application/ purchase/ dropping are declared as holidays, the dates of tender (application, purchasing and dropping) will automatically become the next working date and time will be the same. No separate notification will be issued in this respect. 13) No time extension will be allowed in any ground. 14) The power of attorney, which may be characterised, as an agency agreement should not, as a rule, be accepted without specific sanction of Govt., in such individual case. 15) PWD codes, Special PWD Rules ’87 accepted by P.HE.’D with up to date amendment so far been made in P.H.E.’D will be consulted during entire tender process and binding to tenderer. 16) If any participants who have been allowed to purchase the tender papers does not purchase the tender papers or does not drop the tender papers without assigning satisfactory explanation shall be disqualified to participated in any tender under this Division for a period of 6 (Six) months which may be extended up to 1 (One) year. 17) The tenderers who will sign in tender on behalf of firm must produce the registered documents in respect of their competence. 18) The rates quoted in the tender shall remain open for acceptance for a period of 3 (Three) months from the date of opening of the tender. 19) Payment either R.A. or final will be made to the contractor subject to the availability of L.O.C. for the specific work. This is in supersession of clause 8 and 9 of W.B.F. 2911 to that extent. 20) More detailed information, if necessary, may be had from the Executive Engineer, Birbhum Division, P.H.E. Dte. during office hours. 21) No permission and / or tender papers for tender will be sent by post. 22) 1% (one percent) Cess will be deducted from bill at source over construction cost for “the Building and other Construction works welfare fund” under Section 18(1) of Welfare Cess Act 1998. 23) The construction contractors should registered their farm from the Regional Labour Offices under Section 18(1) of Welfare Cess Act 1998. 24) Regarding engagement of labourer the notification by the Chief Secretary to the Govt. of West Bengal, Labour Department, I.R. Branch, Writers Building, Kolkata – 1 vide no. 1137 – IR IR / MISC – II / 11 dt. 14.11.2011 should be strictly adhere to. It should be ensured that liabilities (Payment of wages) due to engagement of workers are duly met regarding payment of minimum wages according to the rate notified and / or received by the State Govt. from time to time under the minimum wages act 1948 within the specified time as per law. Any violation to the rule, if found, will be taken seriously by allowing him ineligible for the work then and there or at any subsequent stage as may be found convenient. 25) The details of tender will be available in website www.wbphed.gov.in.
