Ardrossan/Saltcoats/Stevenston Local Plan Area N/99/00685/PP: Stevenston: Kilwinning Road: Site to the East of St. John’s Church LIDL UK, Tailend Farm, Deans Road, Livingston have applied for planning permission for the erection of a foodstore and the formation of associated car parking at the site to the east of St. John’s Church, Kilwinning Road, Stevenston. Objections have been received from Somerfield Stores Ltd, per Edmund Kirby, Town Planning & Surveying Consultants, India Buildings, Liverpool; P Sing, Unit 1, Keir Hardie Road; Mr H Carr, 23 Kilwinning Road; Mr R Reid, 25 Kilwinning Road; Mr & Mrs Law, 2 Highfield Drive; J McPherson, 4 Lochlie, Place; St. John’s Pastoral Council, St. John’s Church, Hayocks Road; Mr A Yule, 13a Kilwinning Road; Mr & Mrs T Barbour, 13 Kilwinning Road; Mr R Reid, Mays Corner Shop, 2 Hayocks Road; Dr. R Shuttleworth, 33 Kilwinning Road; May McMail, 5 Lochlie Place; Mr T Melvin, 30 Morrison Avenue; Mrs I Maule, 27 Kilwinning Road, all of Stevenston. In addition a petition of 10 signatures from residents of Morrison Avenue, Stevenston, per Mr & Mrs J Clydesdale, 32 Morrison Avenue and a petition of 67 signatures from residents of Highfield Drive and Kilwinning Road, Stevenston, per Miss D Robinson, 4 Highfield Drive, have been received. Having considered the terms of the objections, the Sub-Committee agreed to refuse the application on the following grounds:- (1) that the proposed development is contrary to Policy L8 of the Ayrshire Joint Structure Plan and Policies COM6 and COM8 of the Ardrossan, Saltcoats and Stevenston Local Plan in that it is a substantial retail development outwith the town centre for which a justification has not been demonstrated. Page 1 2. Arran Local Plan Area N/99/00462/PP: Lamlash: Site to the East of Medical Centre: The Maritime and Coastguard Agency, Bay 1/30 Spring Place, 105 Commercial Road, Southampton have applied for planning permission for a new build training facility and rescue co-ordination centre for use by coastguard employees. Works include the demolition of a dilapidated structure at the north east of site to the east of the Medical Centre, Shore Road, Lamlash, Isle of Arran. An objection has been received from Dr. Tinto, the Medical Centre, Lamlash, Isle of Arran. Having considered the terms of the objection, the Sub-Committee agreed to grant the application subject to the following conditions:- (1) that prior to the development hereby approved coming into use, the existing boundary wall on the Shore Road frontage shall be reduced in height to 1.05 metres above the adjacent road level and shall thereafter be maintained to that height all to the satisfaction of North Ayrshire Council as planning authority; and (2) that foul effluent from the training and rescue co-ordination centre hereby approved shall be directed to the public sewer via a suitably sized septic tank to the satisfaction of North Ayrshire Council as planning authority. 3. Garnock Valley Local Plan Area N/99/02132/PP: Dalry: Kilbirnie Road: Hillview Mr S Crouch, Hillview, Kilbirnie Road, Dalry has applied for a change of use of residential premises to mixed residential and commercial use to allow sale of pet foods and products to the public at that address. This matter was previously considered by the Sub Committee on 25 April 2000 when it was agreed to continue the matter to allow the applicant to provide additional information on the range of products to be sold by the proposed business and its intended customer base. This information had not been provided. The Sub-Committee agreed to refuse the application on the following grounds:- (1) that the proposed development would be contrary to Policies RET 4 and ENV 11 of the Finalised Replacement Garnock Valley Local Plan in that the proposed development would represent an out of centre retail development and in inappropriate development in the countryside respectively; and (2) that the proposed development would be detrimental to the interests of road safety in that the applicant is unable to provide acceptable sight-lines at the vehicular access. 4. Irvine/Kilwinning Local Plan Area (a) N/99/00398/PP: Kilwinning Eglinton Park Factory Unit Eglinton Leisure Ltd, per J W Mair, 25 Woodside Avenue, Kilmarnock have applied for a change of use and alterations to industrial buildings to form a leisure complex including an indoor leisure facility comprising a restaurant, snooker and pool hall, ten pin bowling hall, children’s play area, café/bar and amusement arcade at Eglinton Park Factory Unit, Kilwinning. Objections have been received from J & H Broussard, Eglinton House, Eglinton Park; J & S Hay, Weirston House, Eglinton Country Park; and R Watt, 11 Viaduct Circle, all of Kilwinning. The Sub-Committee agreed to continue consideration of the matter to allow (i) Planning Page 2 Officers and the applicant to discuss the application further; and (ii) the Sub Committee and the local Member to visit the site. (b) N/99/02150/PP: Irvine: Oldhall West Industrial Estate: 1 Murdoch Place Hamilton Irvine Ltd, Unit 1, Murdoch Place, Oldhall West Industrial Estate, Irvine have applied to Modify Condition (1) attached to planning permission 01/98/0595 to delete “1st April 2000” and substitute “1st October 2000”. The Sub-Committee agreed to refuse the application on the following grounds:- (1) that the extension of time requested for compliance with Condition 1 attached to planning permission 01/98/0595 would result in a continuing unsatisfactory method of operation which would be detrimental to the amenity of the surrounding properties by reason of odour problems. 5. North Coast and Cumbraes Local Plan Area N/00/00057/PP: West Kilbride: Portencross: Farland Mr R McKee, Farland, Portencross, West Kilbride has applied for a change of use from agricultural building to form an artists studio and gallery with public access at that address. An objection has been received from Miss E Robertson, Portencross Farm, West Kilbride. Having considered the terms of the objection, the Sub-Committee agreed to grant the application, subject to the following conditions:- (1) that the premises shall be used for the purposes of an artists studio and gallery with public access and for no other purpose; (2) that any retail sales shall be limited to works of art which have been manufactured, repaired, assembled or altered on the premises or other artists’ works of art; (3) that the artist’s studio and gallery shall not be open between the hours of 7 p.m. on one day and 9 a.m. on the following day unless North Ayrshire Council as planning authority gives written permission for any variation to these times; (4) that the roofing material shall be natural or artificial slate, a sample of which shall be submitted for the approval in writing of North Ayrshire Council as planning authority prior to the commencement of any works; and (5) that no vehicles shall be parked on the private access road to the north of the proposed development. 6. Exclusion of Public The Sub Committee resolved, in terms of Section 50A(4) of the Local Government (Scotland) Act 1973, to exclude from the Meeting the press and the public for the following item of business on the grounds indicated in terms of Paragraphs 6, 13 and 14 of Schedule 7A of the Act. 7. Civic Government (Scotland) Act 1982: Application for Licences Submit report by the Assistant Chief Executive (Legal and Regulatory) on applications for the grant or renewal of licences under the Civic Government (Scotland) Act 1982 which require to be determined by the Committee. The Sub-Committee agreed to dispose of these matters as indicated in the attached Page 3 Appendix P&R1.
