Transport NSW Roads & Maritime GOVERNMENT Services Mr Harold Scruby Enquiries: Wayne Kosh Pedestrian Council of Australia Ltd Tel: (02) 8588 4985 PO Box 500 Our ref: 13G1587 Neutral Bay NSW 2089 Dear Mr Scruby Government Information (Public Access) Act 2009 Application 13G1587 Notice of decision - 10 January 2013 On 7 December 2012. the Roads and Maritime Services (RMS) received your access application under the Government Information (Public Access) Act 2009 (GIPA Act). which was in the following terms: 1 Locations of all P2P speed cameras currently operating (i.e. issuing fines and/or capturing data) 2 Locations of all P2P speed cameras planned to be in operation over the next 10 years and the dates when they are expected to be operational. 3 Details of all heavy vehicles detected speeding since the first P2P speed cameras became operational: (a) By Location both directions (b) By month (c) By Speed bracket please ensure you show all brackets even if no fines or warnings were issued (d) Whether a fine or warning was sent or no action was taken 4 Details of all other vehicles detected speeding since the first P2P speed cameras became operational: (e) By Location both directions (f) By month (g) By Speed bracket please ensure you show all brackets even if no vehicles were detected speeding (h) Whether a fine or warning was sent or no action was taken (the requested information) I appreciate your agreement in providing an extension until 14 January 2013 for RMS to make a decision about your application. Searches conducted and Notice of decision I requested and obtained information from the Customer and Compliance Division. which is the area that is most likely to hold the information which is subject to your application. 1 e The following information has been provided to me in response to your request (by reference to the item numbers contained in your application) and as I am authorised under section 9 to decide your access application I have decided, as follows: Item 1: Information setting out the locations of point to point speed cameras is available on RMS' website. To assist you I attach a copy of those details. Please note that Customer and Compliance Division has advised me that the point-to-point cameras at sites 1, 5, 23, 24 and 25 as listed on RMS' website are still under construction and will be completed in 2013. Customer and Compliance Division has advised me that warning letters are currently issued for potential average speeding offences by heavy vehicles for the point-to-point camera at site 17 as listed on RMS ' website as that site was only recently completed. Item 2: I have been advised by Customer and Compliance Division that all information held by RMS about current and proposed speed camera locations is the information I have decided to you release to you. Accordingly, I have decided that RMS holds no further information subject to this item of your application. Item 3: Customer and Compliance Division has provided me with a spreadsheet that sets out the information subject to this item of your application. Please find this spreadsheet on the enclosed CD, which I have decided to release to you. Customer and Compliance Division has advised me that information about whether no action was taken or whether warning letters or fines were issued for potential average speeding offences is not held by RMS and that the State Debt Recovery Office holds such information. I have also decided to release to you a one page A3 sheet setting out details about the 25 point to point sites in NSW to assist your understanding of information I have decided to release to you on the attached spreadsheet. Item 4: have decided that, based on information provided to me by Customer and Compliance Division, that RMS does not hold information subject to this item of your application. With respect to the information you have requested in this item of your application, Customer and Compliance Division has advised me that RMS only holds information showing heavy vehicles that have been detected speeding by point to point cameras. This is for the reason that the Road Transport (Safety and Traffic Management) Act provides that average speeding offences detected by point to point cameras apply to heavy vehicles only. Customer and Compliance Division has advised me that information providing for potential average speeding offences detected by point to point cameras for other vehicles are not processed. 2 I am aware that, in February 2011 , you obtained some information from RMS in the form of statistics setting out potential average speeding offences detected by point to pOint cameras for all vehicles, other than heavy vehicles. Customer and Compliance Division has advised me that such information was available to RMS at that time because potential average speeding offences by all vehicles were captured by point to point cameras at the commencement of the point to point speeding camera enforcement program. Your rights of review If you are aggrieved by either the decision to provide access to the information, or the form of access provided, you may seek review under Part 5 of the GIPA Act. Before you do so you may wish to contact me . For your information, there are three avenues of review: internal review by a senior officer, external review by the Information Commissioner or external review by the Administrative Decisions Tribunal. Attached to this notice is a brochure published by the Office of the Information Commissioner, which details your rights of review under the GIPA Act. You should note that the time for seeking an internal review is twenty working days or, for external review, forty working days after the date you were notified of this decision.
