Earn 2x Bonus Enrich Miles with MASKargo Online Booking & Get Discount up to 60% of Published Rate Campaign Terms and Conditions A. Duration 1. The Earn 2x Bonus Enrich Miles with MASKargo Online Booking & Get up to 60% off Published Rate Campaign (“Campaign”) is organised by Malaysia Airlines Berhad (“MAB”) and MABKargo Sdn Bhd (“MASKargo”) and will run from 18th June 2020 until 17th August 2020 (“Campaign Period”). Booking period (“Booking Period”): 18th June 2020 – 17th August 2020 Departure period (“Departure Period”): 20th June 2020 – 31st August 2020 B. Eligibility and Participation 1. This Earn 2x Bonus Miles Campaign is only applicable to individual members (“Participants”) who book via MASKargo Online for transportation of eligible goods. 2. Any individual person who has fulfilled the criteria below is eligible to participate in this Campaign (“Participant”): a. Be an Enrich member; b. Non-member can register for membership via Malaysia Airlines website at https://www.enrich.malaysiaairlines.com/EnrichWebsite/signup and must register before booking is made during the Campaign Period. 2. The mechanics of the Campaign are as follows: a. Participant must make an online booking with MASKargo at www.fly.maskargo.com within the Booking Period and select departure of goods within the Departure Period to earn Bonus Enrich Miles and discount up to 60% of published rate. b. Online booking is only available for General Cargo, except the following: • Vulnerable item, e.g. fragile goods • Valuable items with high value, e.g. gold, banknotes, jewelry • Dangerous goods or any appliance with batteries, e.g. handphone, computer, power bank • Pharmaceuticals with special handling • Human remains, human organs • Live animals, e.g. live fish, hatching eggs, horse, goats • Perishable items – fresh seafood, frozen seafood, fruits, vegetables, flowers • Vehicle with batteries, e.g. car, motorcycle • Any items that requires special handling – high risk items, temperature-controlled, anti- shock c. Some examples of General Cargo are: • Home appliance: televisions, lamp, etc • Fashion & accessories: clothes, shoes, bags etc • Games & hobbies: chess, ukuleles, etc • Travel & luggage: excess baggages, winter coats, etc • Health & beauty: cosmetics, medicines (that does not require special handling), etc • Others d. The eligible destination for online booking is within Malaysian domestic sectors inclusive of Sabah and Sarawak. Uplift of cargo is subject to space availability. e. Participant is to make the online booking within 2 - 14 days before departure date. The submission of cargo must be completed between 24-48 hours prior to departure at 9.00 am to 5.00pm. f. The online booking is applicable for airport-to-airport only. Participants are required to make their own arrangements to and from the airport and arrange own custom declaration and custom clearance (if applicable) at both origin and destination. g. A complete finalized booking and submission of cargo is eligible to earn 2x Bonus Enrich Miles for every RM1 of total payment (inclusive of taxes). h. Any cancellation to the cargo booking made will not be eligible to earn the 2x Bonus Enrich Miles. i. Only after successful submission and delivery of the cargo at the destination, the Bonus Enrich Miles will be credited into Participant’s Enrich account within 7 to 14 working days. j. The Bonus Enrich Miles earned under this Campaign shall NOT contribute towards the accumulation of Elite Miles required to qualify for or maintain Elite Status. k. The Bonus Enrich Miles cannot be exchanged or sold for cash. l. The Bonus Enrich Miles earned under this Campaign is valid for redemption only and may be redeemed for flight redemption on Malaysia Airlines, oneworld and partner airlines, as top up for Miles + Cash redemption, redemption seat upgrades on Malaysia Airlines operated (tickets issued on a 232 document) flights, Enrich Shopping partners, Golden Lounge Access vouchers and Enrich RM50 vouchers. m. The Bonus Enrich Miles have a 3-year validity term from the date of transaction. Full Terms & Conditions by MASKargo shall apply at_https://fly.maskargo.com/terms-conditions n. ___. o. Other Full Enrich Terms & Conditions by Enrich shall apply at https://www.malaysiaairlines.com/my/en/enrich/about-enrich/terms-conditions.html C. General Terms for Campaign 1. All transportation, accommodation, personal costs and/or any other costs and/or related expenses that are incurred to participate in this Campaign is the sole responsibility of the Participants. 2. MAB reserves the right to use, reproduce, edit and distribute materials submitted for this Campaign for publication and/or display in any media format and any media channels without obtaining further prior permission and payment of any fees or royalty to the Participant. 3. MAB reserves the right to use the Participant’s name, images, comments, materials relating to this Campaign for the purpose of any announcement or promotional or marketing purposes in any media format and any media channels without any fee being paid. The Participant shall hold MAB free and harmless from any claims and/or liabilities whatsoever resulting from the usage or the reproduction of the submitted materials by MAB. This clause shall survive the expiration of this Campaign Period. 4. MAB, at its sole and absolute discretion, reserves the right to disqualify any Participant and revoke or forfeit any Bonus Miles at any stage of the Campaign, without prior notice if: (a) The participant is not an eligible Participant; (b) The Participant fails to fully comply with the Terms and Conditions stipulated herein; (c) Entries are incomplete; (d) The Participant breaches any of the Terms and Conditions or other rules and regulations of the Campaign or violates any applicable laws or regulations; (e) MAB has, at its sole discretion, any reason whatsoever to believe that such Participant has attempted to undermine the operation of the Campaign in any way whatsoever, including but not limited to fraud, cheating or deception. (f) The airline has reason(s) to believe that member(s) create and/or hold multiple membership accounts under different names but ultimately linked to the same member, whether or not such multiple accounts are for the purposes of or has any activity relating to this Campaign (“Multiple Accounts”). 5. Enrich Malaysia Airlines will not be responsible or liable for any disputes on the Cargo bookings or any cargo booking related issues, Cargo charges, damage to goods, loss of goods, delayed delivery by MASKargo’s or its deliverables. Participants are to liaise direct with MASKargo Customer Service Hotline Number, which is 03-87771610, on such matters. 6. The airline reserves the right to recover any damages, losses, costs and expenses from member(s) whom the airline has reasons to believe are directly or indirectly involved in suspicious activities including but not limited to fraudulent activity for which such activity involves transaction(s) using this Campaign. 7. MAB’s decision on matters relating to the Campaign shall be final and absolute. No discussion, correspondence, enquiry, appeal or challenge by any of the Participants in respect of any decision of MAB shall be entertained. 8. MAB, its affiliates, subsidiaries, agents, employees, representatives, retailers, distributors, dealers as well as its advertising, creative, media, digital, design and other creative agencies of MAB, shall not be liable for any loss or damage whatsoever suffered (including but not limited to loss of opportunities and any indirect or consequential losses) or personal injury suffered or sustained in connection with or arising from participation in this Campaign. 9. The Terms and Conditions of the Campaign shall be construed, governed and interpreted in accordance with the laws of Malaysia. 10. All rights and privileges herein granted to MAB are irrevocable and not subjected to rescission, restraint or injunction under any and all circumstances. Under no circumstances shall the Participant have the right to injunctive relief or to restrain or otherwise interfere with the organisation of the Campaign, the production, distribution, exhibition and/or exploitation of the Campaign and/or any product based on and/or derived from the Campaign. 11. MAB reserves the right at its absolute discretion to vary, delete or add to any of these Terms and Conditions without any prior notice. 12. These Terms and Conditions will prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional materials advertising the Campaign. 13. The main language of the Terms and Conditions shall be the English language. Any translation to any other language than English shall be for convenience only. Should there be any discrepancies between the English Terms & Conditions and the translated version, the English Terms & Conditions shall prevail. 14. By virtue of an entry to the Campaign, the Participants signify their absolute and unconditional acceptance and agreement to all the Terms and Conditions stipulated herein. 15. MAB reserves the right to cancel, terminate or suspend the Campaign without any prior notice. For the avoidance of doubt, any cancellation, termination or suspension by MAB of the Campaign shall not entitle the Participants to any claim or compensation against MAB, its agents and employees for any and all losses or damages suffered or incurred by the Participants as a direct or an indirect result of the act of cancellation, termination or suspension thereof. 16. MAB will not be held responsible for any typographical errors or misprint under these Terms and Conditions. .
