Duke Ener Business Services, LLC, Duke Ener Carolinas, LLC, and Duke Ener Pro ress Inc., - No. 5:15-CR-67-H; and 2019 v. Duke Ener Business Services LLC Duke United States March Ener Carolinas, LLC and Duke Ener Pro ress, Inc., No. 5:15-CR-68-H. 4 The charges from the Middle District of North Carolina and 5:21 the Western District of North Carolina have been transferred to PM the Eastern District of North Carolina for purposes of plea - SCPSC pursuant to Fed. R. Crim. P. 20. The Defendants'uilty pleas are to be entered pursuant to the Plea Agreements signed and - Docket dated this same day. # II . OVERVIEW AND BACKGROUND 2018-318-E Dan River Steam Station— Middle District of North Carolina 1. From at least January 1, 2012, DUKE ENERGY CAROLINAS - Page and DUKE ENERGY BUSINESS SERVICES failed to properly maintain 2 and inspect the two stormwater pipes underneath the primary coal of 121 ash basin at. the Dan River Steam Station in Eden, North Carolina. On February 2, 2014, one of those pipes failed, resulting in the discharge of approximately 27 million gallons of coal ash wastewater and between 30,000 and 39,000 tons of coal ash into the Dan River. The coal ash travelled more than 62 miles downriver to the Kerr Lake Reservoir on the border of EXHIBIT DJW - 5.2.1 ELECTRONICALLY Page 3 of 79 Carolina and Virginia. Video camera inspections of the North FILED other pipe, conducted in the aftermath of the spill, revealed - that the other pipe had also deteriorated, allowing coal ash 2019 wastewater to leak into the pipe, and that DUKE ENERGY CAROLINAS March and DUKE ENERGY BUSINESS SERVICES had not taken appropriate 4 action to prevent unauthorized discharges from the pipe. 5:21 Ca e Fear Steam Electric Plant— Middle District of North Carolina PM - 2. DUKE ENERGY PROGRESS and DUKE ENERGY BUSINESS SERVICES SCPSC also failed to maintain the riser structures in two of the coal - ash basins at the Cape Fear Steam Electric Plant, resulting in Docket the unauthorized discharges of leaking coal ash wastewater into # the Cape Fear River. 2018-318-E Asheville, Riverbend, & Lee Steam Stations— Eastern and Western Districts of North Carolina 3. Additionally, DUKE ENERGY CAROLINAS'nd DUKE ENERGY - Page PROGRESS's coal combustion facilities throughout North Carolina unauthorized discharges of pollutants from coal ash 3 allowed of basins via "seeps" into adjacent waters of the United States. 121 Three of those facilities include the Asheville Steam Electric Generating Plant, the H.F. Lee Steam Eleci ric Plant, and the Riverbend Steam Station. At those facilities, discharges from naturally occurring seeps were channeled by DUKE ENERGY CAROLINAS and DUKE ENERGY BUSINESS SERVICES to flow through EXHIBIT DJW - 5.2.1 ELECTRONICALLY Page 4 of 79 drains and ditches into waters of the United States engineered FILED without obtaining or maintaining the necessary permits. - 4. The Defendants'onduct violated the Federal Water 2019 Control Act (commonly referred to as the "Clean Water Pollution March Act," or "CWA"). 33 U,S.C. 55 1251 et seg. DUKE ENERGY CAROLINAS, a North Carolina limited 121 liability company, is a regulated public utility primarily engaged in the generation, transmission, distribution and sale of electricity in portions of North Carolina and South Carol'ina. 8. Progress Energy, a North Carolina corporation headquartered in Raleigh, North Carolina, is a holding company which holds, among other entities, DUKE ENERGY PROGRESS. DUKE ENERGY PROGRESS, a North Carolina corporation, is FILED a regulated public utility primarily engaged in the generation, - transmission, distribution and sale of electricity in portions 2019 and South Carolina. Prior to the July 2, of North Carolina March 2012, merger between Duke Energy Corporation and Progress 4 & Energy, Inc., DUKE ENERGY PROGRESS was known as Carolina Power 5:21 Light, Inc., d/b/a Progress Energy Carolinas. PM 10. "Progress Energy Cazolinas" will refer to DUKE ENERGY - SCPSC PROGRESS before the merger. 11.. DUKE ENERGY BUSINESS SERVICES provides shared services - Docket to all of Duke Energy Corporation's operating utilities nationwide, including: Legal Counsel; Central Engineering a # 2018-318-E Services; Environmental, Health 6 Safety; Ethics and Compliance; and Coal Comb'ustion Products. 12. See Ca e Fear River Watch Inc. v. Duke Ener Pro ress Inc., 25 F.supp.3d 798, 808-809 (2014). The Defendants do not concede that Sutton Lake is a jurisdictional water in this Joint Factual Statement. 6 EXHIBIT DJW - 5.2.1 ELECTRONICALLY Page 7 of 79 COAL COMBUSTION PLANTS AND COAL ASH BASINS FILED 13. Power plants that generate electricity through the - combustion of coal create a number of waste byproducts. Among 2019 waste byproducts are "coal combustion residuals" or those March "CCRs." CCRs include fly ash, bottom ash, coal slag, and flue ash are both 4 gas desulfurized gypsum. Ply ash and bottom 5:21 as "coal ash." Coal ash contains various commonly referred to PM heavy metals and potentially hazardous constituents, including - SCPSC arsenic, barium, cadmium, chromium, lead, manganese, mercury, thallium. Coal ash has not nitrates, sulfates, selenium, and - Docket been defined, itself, as a "hazardous substance" or "hazardous ash waste" under federal law, although some constituents of coal # 2018-318-E may be hazardous in sufficient quantities or concentrations. 14. Coal ash basins (also known as "coal ash ponds," "coal ash impoundments," or "ash dikes") may be part of the waste - Page treatment system at coal-fired power plants. Historically, the ash basins were unlined earthen impoundments 7 Defendants'oal of and typically operated as follows: Coal ash was mixed with 121 water to form slurry. The coal ash slurry was carried through sluice pipe lines to the coal ash basin. Settling occurred in the coal ash basin, in which particulate matter and 'ree chemical components separated from the slurry and settled at the bottom of the basin.
