YOGA IN THE OUTFIELD 2020 WAIVER AGREEMENT 2020 WASHINGTON NATIONALS YOGA IN THE OUTFIELD ATTENDANCE WAIVER I, (“Participant”), hereby acknowledge that my voluntary participation in the “Yoga in the Outfield” postgame event at Nationals Park on July 12, 2020 (the “Event”) may result in personal injury or property damage to me. By participating in, providing services to, attending and/or observing the Event, I acknowledge and assume all risks and danger to me that are incidental to or in any way arise from the Event. I hereby protect, indemnify, defend and hold harmless the Washington Nationals Baseball Club, LLC, Washington Nationals Stadium, LLC, WN Partner, LLC, Nine Sports Holdings, LLC, Lerner Enterprises, LLC, Lerner Corporation together with the owners, partners, shareholders, officers, directors, employees, agents, and sponsors of any of them (the “Washington Nationals”), and Major League Baseball and its member clubs and other affiliated entities (“MLB”), from and against any and all claims, suits, demands (or other legal actions), losses, damages, costs and/or expenses (including, without limitation, reasonable attorney’s fees and disbursements), for personal injury, property damage or any other injury or loss of any kind, whether based in negligence or otherwise (all of the foregoing the “Damages”) brought by me or on my behalf in connection with the Event. I hereby agree not to disclose any “Confidential Information” of the Washington Nationals or MLB to any third party. “Confidential Information” shall include all proprietary information made available in connection with the Event, including, but not limited to, information related to the past, present and future plans, ideas, concepts, impressions, conclusions, theories, business strategies or analyses, baseball strategies or analyses, sales figures or projections, marketing programs, documents and any other information relating to the Washington Nationals and/or MLB. I agree that by signing below, and in consideration of the opportunity to participate in the Event, I authorize MLB, including, without limitation, Major League Baseball Properties, Inc., the Office of the Commissioner of Baseball and all of the Major League Clubs (including the Washington Nationals), to depict, in perpetuity, my likeness, images, name, words, voice, and biographical information (the “Images”) in photographic or other works appearing in any and all media now known or hereafter created for all purposes, including promoting, advertising, or marketing current or future events related to baseball, and I further agree that any and all such Images may be used by them for the foregoing purposes without compensation.
