INTRODUCTION 3. Thereareseveralreasonswhyitmayyetbeprematuretoidentifyina definitivewaythe precisecharacteristicsofalegalframeworkespeciallyadaptedtothecharacteristicsofTK, especiallyifthisistobecapableofbroadapplicationinternationally.Firstly, althoughthe internationaldebateontheneedforthedeve lopmentofmechanismsfortheprotectionofTK startedmorethantwodecadesago,3notenoughexperiencehasyetbeenacquired,bothatthe nationalandtheinternationallevels, toensurethatthefullscopeofoptionsforaworkable andeffectivesystem areavailable.Inpractice,a‘top-down’orapre -emptiveapproachto defining suigeneris protectionataninternationallevelislesslikelytosucceedifitisshaped withoutreferencetotheexperiencegainedfromoperationalnationalsystemsthatpro vide practicalmodelsforfunctioningTKprotection, whetherthroughsuigeneris protectionor applicationofexistingIPsystemstoTKsubjectmatter. 4 4.
