REGISTRAR (LISTING)] HIGH COURT OF DELHI : NEW DELHI NO. 32 /RKD/DHC Dated : 26-03-2011 Public Notice It is circulated for information of all concerned that vide Notification No.32/Rules/DHC dated 24/12/2010 of this Court, Rules 1A and 1B have been inserted after the existing Rule 1 of Part 1 of Part C of Chapter 5, Volume V, High Court Rules & Orders, regarding destruction of records. According to the newly inserted Rules, notwithstanding any period of preservation prescribed in these Rules, any judicial record, book or paper, may be destroyed after being retained in electronic form, in accordance with Section 7 of the Information Technology Act, 2000, ('IT Act') which provides that where any law provides for documents, records or information to be retained for any specific period, then, that requirement shall be deemed to have been satisfied if such document, records or information are retained in the electronic form. It is further provided that the conversion of judicial records, books or papers, in electronic form, shall be carried out from time to time, before their destruction, which shall be supervised by such officer as may be appointed by the Chief Justice for the purpose, and authenticated by affixing his or her digital signatures. The records of disposed of cases till date have been scanned and converted into electronic form. They have been duly certified in terms of the IT Act. Electronic copies have been preserved. Copies as certified in terms of the IT Act can be provided, on request, in accordance with Delhi High Court Rules. In view of the conversion of the old records into digitized/electronic form, litigants/Advocates who have filed any original document in the decided cases upto the year 2000, can apply to the Deputy Registrar (Record Room), for return of such original documents within three weeks from the issue of this notice subject to filing a certified copy thereof as per Rule 3(48) Chapter II, Delhi High Court Rules. If no such application is received, the record of the case shall be liable to be destroyed and no claim whatsoever in respect thereof shall be entertained thereafter.
