Dated the 22nd August, 2003 Subject :- Application of Coastal Regulation Zone Notification, 1991 to Khar Land Development Projects in State of Maharashtra – regarding. Sir, This has reference to the letter received from Ministry of Water Resources vide D. O. No. 11/7/90 –EA (EEC) / 815, dated 10th April 2002 seeking clearance under Coastal Regulation Zone Notification. 1991 for the Khar Land Development Projects Phase- II undertaken by Khar Land Development Circle (KLDC). Thane, Irrigation Department Government of Maharashtra. In order to examine the ground realities existing at the project site the Ministry had constituted a two member Committee to visit the sites and submit a report. The above Committee undertook a site visit on 5th to 8th June 2002 and submitted a report. Based on the recommendations of the above Committee, the Ministry requested the KLDC, Irrigation Department, Government of Maharashtra to provide necessary information along with the approval of the Maharashtra State Coastal Zone Management Authority. The letter No. MCZMA/37, dated 6th March, 2003 from Maharashtra State Coastal Zone Management Authority has been received along with the Coastal Regulation Zone maps of the project site indicating High Tide Line and Low Tide Line demarcated by Space Application Centre, Ahmedabad subsequent letters received from Khar Land Development Circle, Thane, Irrigation Department; Government of Maharashtra vide letter No. KLDC/EEC-2/TB- 1/CRZ/2328, dated 15th July 2003 have been examined. The Ministry after examining the information provided accords environmental clearance to the Khar Land Development Project in the State of Maharashtra from Coastal Regulation Zone Notification, 1991 subject to the following general and specific conditions. SPECIFIC CONDITIONS : q The clearance is accorded to these Khar Land Schemes which have been indicated by Khar Land Development Circle, Thane, Irrigation Department, Government of Maharashtra in their letter No. KLDC/EEC-2/TB-1/CRZ/2328, dated 15th July 2003 (Annexure – I). q The KLDC shall not allow from houses and practice only organic farming and shall not use chemical pesticides and inorganic fertilizers. q Shrimp farming is not permitted in the reclassified Khar Land areas. q The KLDC will preserve, maintain and enhance the existing mangrove areas. In addition, the KLDC will also plant / develop mangroves in potential areas with potential for such vegetation. The Government of Maharashtra shall earmark at least 5% of the Khar Land Project Area and identify suitable bunds along the Khar Land Project for development of mangroves under the project. th q In the project areas which have been developed prior to 19 February 1991 restoration may be undertaken if the High Tide Line coincides with the existing bund. q In the case of breaches as well as in places where sea water has flown over an existing bund, re-constructions/restoration may be allowed subject to causing no damage to mangroves. Sites at which mangroves have come up again would be excluded and categorized as Coastal Regulation Zone-I(I). q The Khar Land should not be used for anything other than agriculture purposes. q Sand dunes if any in the area shall not be disturbed. q No new project should be undertaken in intertidal area. q The conditions stated in the Maharashtra State Coastal Zone Management Authority letter No. MCZMA/37, dated 6th March 2003 shall be implemented. GENERAL CONDITIONS : q All development should be undertaken as per the plans approved by the concerned local authorities / local administration conforming meticulously to the existing local and central rules and regulations. q Appropriate measures must be taken while undertaking agricultural activities to avoid any likely degradation of ground water quality. q The construction material for bunds should be obtained only from approved quarries. In case new quarries are to be opened, specific approvals from the competent authority should be obtained in this regard. q Adequate precautions should be taken during transportation of the construction material so that it does not affect the environment adversely. q Borrow pits and other scars created during the road construction should be properly leveled and treated. q The project-affected-people, if any, should be adequately rehabilitated and the details in this regard should be furnished to the Ministry. q Adequate financial provision must be made in the project to implement the aforesaid safeguards. q The KLDC will set up separate environmental management cell under the project for effective implementation of the stipulated environmental safeguards under the supervision of a Senior Executive. q Full support should be extended to the officers of this Ministry/Regional office at Bhopal by the project proponents during their inspection of the project for monitoring purposes by furnishing full details and action plan including action taken reports in respect of mitigation measures on other environmental protection activities. q A six-monthly monitoring report shall be submitted to the Regional Office of this Ministry at Bhopal regarding the implementation of the stipulated conditions. q The Ministry of any other competent authority may stipulate any other condition or environmental safeguards, subsequently, if deemed necessary, which should be complied with. q The Ministry reserves the right to revoke this clearance if any of the condition stipulated are not complied with to the satisfaction of the Ministry. q In the event of a change in project profile or change in the implementation agency, a fresh reference shall be made to the Ministry of Environment and Forests. q The project proponents shall inform the Regional Office as well as the Ministry, the date of financial closure and final approval of the project by the concerned authorities and the date of start of land development work. q A copy of the clearance letter will be marked to concerned panchayat / local NGO, if any, from whom any suggestion / representation has been received while processing the proposal. q KLDC should display a copy of the clearance letter at the Regional Office, District Industries Center and Collector’s Office/Tahsildar’s Office for 30 days. q The KLDC should advertise at least in two local newspapers widely circulated in the region around the project, one of which shall be in the vernacular language of the locality concerned informing that the project has been accorded environmental clearance and copies of clearance letters are available with the KLDC and may also be seen at Website of the Ministry of Environment and Forests at http//www.envforniain the advertisements should be made within 7 days from the date of issue of the clearance letter and a copy of the same should be forwarded to the Regional Office of this Ministry at Bhopal. q The above mentioned stipulations will be enforced among other under the Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986, the Hazardous Chemical (Manufacture, Storage and Import) Rules, 1989, the Coastal Regulation Zone Notification, 1991 and its subsequent amendments and the Public Liability Insurance Act, 1991 and the Rules made there-under from time to time. The project proponents should also ensure that the proposal complies with the provisions of approved Coastal Zone Management Plan of Maharashtra State and the Supreme Court’s order dated 18th April 1996 in the Writ Petition No. 664 of 1993 to the extent the same are applicable to this proposal.
