Abstract Australian Status As a Developed Country Which Ratified

Abstract Australian status as a developed country which ratified Jeneva Convention 1951 about refugee status and New York Protocol 1967 makes Australia on the top of the list of asylum seeker’s destination. States which ratified Jeneva Convention 1951 and New York Protocol 1967 have obligation in giving asylum and status for asylum seekers who come to the state, including Australia. In the other hand, Australia applied policies called Pacific Solution and Operation Sovereign Borders (OSB) which contradictive with its commitment as a state that ratified Jeneva Convention 1951. Pacific Solution was created by John Howard as a Prime Minister of Australia in 2001, while OSB was created by Prime Minister Tony Abbott in 2013. The core of these pragmatic policies is as the response to stop the asylum seekers wave who come to Australia especially from maritime route. Although got critism from international society from applied Pacific Solution and OSB which connoted failed in handling asylum seekers, Australian Government declares it as the most rational choice. Starting from cost and benefit analyzed in Rational Choice theory, any state in making any decision should make its national interest as the priority and tend to choose the less risk of its choice. In applying Pacific Solution and OSB which contradictive with international instrument like Jeneva Convention 1951 and New York Protocol 1967 was analyzed had the less risk than spending much money to manage the asylum seekers. These policies also considered as borders policy that protect the security of Australia from the asylum seekers as identical with crime such as people smuggling, narcotics and money laundry.
