(formerly CenturyLink, Inc.) or a subsidiary of Lumen Technologies, Inc. and are used herein with express permission. Trademark and service mark designations will not be listed hereafter in this Local Terms of Service. However, the laws regarding trademarks and service marks are applicable. Trade names, trademarks and service marks that are owned by Lumen Technologies, Inc. or a subsidiary of Lumen Technologies, Inc. cannot be used by another party without authorization. CENTURYLINK® CORE CONNECT® SIMPLE CHOICE® AR2021-06 CenturyTel of Northwest Arkansas, LLC d/b/a CenturyLink Local Terms of Service Arkansas Effective: 12-01-2014 Section 2 Original Page 1 GENERAL TERMS AND CONDITIONS 2.1 APPLICATION OF TARIFF A. This tariff contains regulations and charges applicable to the provision of intrastate services and facilities furnished within its operating territory in the state of Arkansas by CenturyTel of Northwest Arkansas, LLC hereinafter referred to as "the Company or the Telephone Company." The regulations specified herein are in addition to the regulations contained in other sections of this tariff. B. When services and facilities are provided in part by the Company and in part by other companies, the regulations of the Company apply to that portion of the service or facilities furnished by it. 2.2 ADVANCE PAYMENTS At the time an application for service is made, an applicant who has a previous balance with the Telephone Company may be required to pay an amount equal to at least one month's service in addition to such special construction and installation charges as are to be borne by the applicant. The amount of the advance payment is credited to the customer's account on the first bill rendered. Advance payments are not deposits. 2.3 ALTERATIONS The customer agrees to notify the Company promptly whenever alterations or new construction on premises owned or leased by him necessitate changes in the Company's equipment; and the customer agrees to pay the Company's current charges for such changes. 2.4 APPLICATION FOR SERVICE A. Application for service may be made orally or in writing. Application for service and requests from customers for additional service, equipment or changes in the grade or class of service become contracts when received by the Company and are subject to the minimum contract term. B. Any change in rates, rules or regulations lawfully made effective by the Company shall, to that extent, act as modification of all contracts without further notice. C. When an application for service and facilities or request for additions, rearrangements, relocation, or modifications of service and equipment is canceled in whole or in part prior to completion of the work involved, the applicant is required to reimburse the Company for all expenses incurred in handling the request before notice of cancellation is received. Such charge is not to exceed the charge(s) which would apply if the work involved in complying with the request had been completed. D. When equipment has been ordered for the specific needs of a customer and the installation thereof is unduly delayed by or at the request of the customer, appropriate charges apply for such equipment for the period of the delay. AR 14-11(NWAR) CenturyTel of Northwest Arkansas, LLC d/b/a CenturyLink Local Terms of Service Arkansas Effective: 12-01-2014 Section 2 Original Page 2 GENERAL TERMS AND CONDITIONS 2.4 APPLICATION FOR SERVICE (Cont’d) When a customer requests a change in location of all or a part of the facilities covered by his application for service or request for additions, rearrangements or modifications to his existing service and equipment prior to completion of the work involved, he is required to pay the difference between the total costs and expenses incurred by the Company in completing the work involved and that which would have been incurred had the final location of facilities been specified initially. 2.5 APPLICATION OF BUSINESS RATES A. Business rates apply whenever the use of the service is primarily or substantially of a business, professional, institutional or otherwise occupational nature or where the listing required is such as to indicate business use. B. Business rates are applicable at the following local exchange locations: 1. At residence locations, when a line termination is located in a shop, office, or other place of business. 2.6 APPLICATION OF RESIDENCE RATES A. Residence rates apply for: 1. In quarters occupied by lodges, clubs and civic organizations where there is only an occasional use for the service, where the principle use is not for administrative purposes and the telephone is not available for use by-the general public. 2. Secretarial line terminations of residence main service terminating as extension lines on the premises of a telephone answering bureau. 3. In Fire Department dormitories or sleeping quarters where the telephone number is not published and the telephone is not available for use by the general public. AR 14-11(NWAR) CenturyTel of Northwest Arkansas, LLC d/b/a CenturyLink Local Terms of Service Arkansas Effective: 12-01-2014 Section 2 Original Page 3 GENERAL TERMS AND CONDITIONS 2.7 CUSTOMER PREMISES INSIDE WIRE A. General 1. Premises inside wire and jacks associated with residence and business exchange telephone services will not be installed or maintained by the Company on a regulated basis after January 1, 1987 except for company owned public access coin sets. 2 Premises inside wire provided by the customer is connected to exchange telephone service at the point of demarcation. 3. The demarcation point is provided as part of exchange telephone service at no additional monthly rate and will be installed on the customer's premises at a location determined by the Company which is accessible to the customer. The location of the receptacle shall be in close proximity to the protector or equivalent. 4. Company-provided stations may be connected to customer-provided inside wire subject to rates and charges filed elsewhere in this tariff, subject to equipment limitations. 5. The customer shall indemnify and hold the Company harmless from any and all liability for damage to property or death or injury to any person or persons directly or indirectly arising out of or caused, in whole or in part, by the customer's acts or those of anyone acting on the customer's behalf in connection with installation or maintenance of inside wire. 2.8 CUSTOMER PREMISES WIRE AND CABLE (CPWC) - CUSTOMER PROVIDED When the customer provides multi-line CPWC, the Telephone Company will not be liable for damages to property, bodily injury, and loss of life caused by the customer's acts, or those of anyone acting on his behalf, while the customer is installing or maintaining customer CPWC. Additionally, the customer is responsible for any loss of telephone service or damage to telephone company-owned equipment caused by customer provided CPWC. The Telephone Company will own and maintain and is responsible for provision of network services up to and including the multi- line jack or its equivalent (entrance facility, which includes protector or its equivalent, multi-line access cable, which includes the multi-line jack or its equivalent). AR 14-11(NWAR) CenturyTel of Northwest Arkansas, LLC d/b/a CenturyLink Local Terms of Service Arkansas Effective: 12-01-2014 Section 2 Original Page 4 GENERAL TERMS AND CONDITIONS 2.9 CUSTOMER SERVICE-USE OF Customer telephone service, as distinguished from public and coin box telephone service, is furnished only for use by the customer, his family, employees or business associates, guests, or persons residing in the customer's household, except as the use of the service may be extended to joint users or to persons temporarily subleasing a customer's residential premises. The Company has the right to refuse to install customer service or to permit such service to remain on premises of a public or coin box character when the station is so located that the public in general or patrons of the customer may make use of the service.
