
ARGYLL AND BUTE COUNCIL STRATEGIC POLICY COMMITTEE COMMUNITY SERVICES THURSDAY 9 SEPTEMBER 2004 ARGYLL AND BUTE COUNCIL’S RESPONSE TO SCOTTISH BORDERS REVIEW 1. SUMMARY 1.1 In April this year a report was produced by the Social Work Services Inspectorate and Mental Welfare Commission following an investigation which they carried out into a Scottish Borders case of a woman with learning disability who had been physically and sexually assaulted by carers. 1.2 The Social Work Service Inspectorate’s report made a number of recommendations which have significant implications for all Local Authorities, Police, Health and other agencies. Argyll and Bute Council will require to consider these recommendations and prepare an action plan in response. 1.3 Community Services has considered these recommendations and formulated an action plan to respond to these recommendations. 2. RECOMMENDATIONS 2.1 Members are asked to agree to a officer working group involving the council and NHS Argyll & Clyde being set up to jointly respond to and address the recommendations contained in the report by Social Work Service Inspectorate and audit the Department’s practice in learning disability cases and report its findings with recommendations to Community Services Management Team, and to Members as appropriate. 3. BACKGROUND 3.1 In April of this year a comprehensive and hard-hitting report was produced by the Social Work Services Inspectorate and Mental Welfare Commission arising out of an investigation which they carried out in the Scottish Borders following the conviction of three men of physically and sexually assaulting a woman with learning disabilities. 3.2 It was found that this woman and others with varying degrees of learning disabilities, physical disabilities and mental health needs had been known to Social Work, Health and Police services over many years and records in each service showed that serious concerns and events had been expressed regarding the behaviour of the carers at the centre of the case, but had not been acted on appropriately. 3.3 The recommendations identified in this report for Councils to address arise from concerns regarding: • lack of information sharing by key agencies • disagreements between agencies • failure to act upon concerns, • lack of understanding of legislation covering intervention and protection. (The full list of Social Work Services Inspectorate recommendations to the Scottish Borders Council is attached at Appendix 1) 3.4 The report identified that the Scottish Executive has the following recommendations to address: • produce a comprehensive Vulnerable Adults Bill to Parliament • give guidance to Health Boards and Local Authorities on the use of the Care Programme Approach for people with learning disabilities who have complex needs • produce guidance for Health and Social Work on how to carry out critical incident reviews where there is multi-agency involvement. 3.5 In recognition of the main findings affecting social work practice, a small working group has been set up to agree a proposed action plan. Use will be made of the checklist of questions offered in the Social Work Inspectorate report (attached at Appendix 2), covering: • risk assessment/care planning • information sharing • experience and training of staff • evidencing contact with vulnerable adult and relevant others 3.6 Officers are also involved in updating the existing Protection of Vulnerable Adults Procedures, in the light of the issues arising from this Social Work Inspectorate report and issues from the Adults with Incapacity and Human Rights legislation. This will be done in a multi-agency group involving Health, Police and the five local authorities within NHS Argyll and Clyde. 3.7 The findings of the group will be presented to Community Services Management Team and a further report prepared for Strategic Policy Committee. 4. STAFFING / TRAINING 4.1 Taking account of the Council’s statutory responsibilities to safeguard vulnerable adults, Community Services has put an appropriate staffing structure in place. This includes: • six dedicated Care Manager Learning Disability posts • four Mental Health Officer posts Scottishbordersreport0.Doc 2 01/09/04 • four dedicated Team Leaders with responsibility for the management of learning disability and mental health. These posts were funded from current post reconfiguration and Mental Health Act funding for this purpose. Through use of the Change Fund – Review of Services for Learning Disabilities – four Local Area Co- ordinators are in place across Argyll and Bute, working with people with learning disabilities and their carers. 4.2 The workload for these staff has increased as a result of policy initiatives such as Supporting People and the Same as You Review. 4.3 Appropriate training in respect of Adults with Incapacity has been made available to staff and further training in the new Mental Health Act will be provided as required from the Audit of Learning Disability Services. 5. CONCLUSION 5.1 Following the publication of the Scottish Borders Report, Community Services have set up a short life working group, in partnership with NHS Argyll &Clyde, to respond to the recommendations therein. An action plan will be prepared and implemented with the agreement of the Departmental Management Team to address these recommendations. This will include a comprehensive audit of all Learning Disability cases known and a review of current policy and procedures relating to vulnerable adults. 5.2 A further report on these actions will be presented to Committee. 6. REPORT 1. The implementation of the recommendations contained in the Chief Social Work Inspectors letter to the Chief Executive of Scottish Border Council dated 6th October 2003 should be continued. [Local authority’s statutory duty to take action to protect the finances of people with a mental disorder unable to do so themselves.] 2. Scottish Border Council should consider making financial restitution to the individual concerned for these debts. 3. Scottish Border Council should review the implementation of its action plan for compliance as an employer with the Scottish Social Services Code of Practice to ensure that it covers all the requirements of the Code and to ensure that implementation will secure the necessary changes in organisational behaviour described in this report, that are intended by the Code and that are essential to the effective functioning of the Department of Lifelong Care. 4. The Department of Lifelong Care should review the expertise of Mental Health Officers operating in management positions and in all service areas to ensure they have up to date knowledge of relevant legislation, particularly as it relates to learning disability, issues of capacity and the protection of individuals and property. Without a more rigorous formalised approach to the assumption of staff’s expertise, this should not be relied upon for critical decision-making. 5. Staff development programmes should include a focus on the complexities of adult protection; the role, purpose and thresholds for statutory intervention; and the duties that are extended and reinforced in the Adults with Incapacity and the Mental Health (Care & Treatment) Acts. 6. The Department of Lifelong Care should develop a system of regular refresher training for Mental Health Officers and should ensure that staff are aware of how to access specialist advice and guidance, including legal advice. 7. The Department of Lifelong Care should carry out a review of all cases of adults with learning disabilities to assess the level of risk and determine the quality of service. The Department should consider the level of seniority of staff conducting the review and may wish to commission the review from an independent source. The Department should use a checklist for this review to ensure a consistent approach across all cases. The checklist should include but not necessarily be restricted to the following critical questions. (see attached Appendix 2) Scottishbordersreport0.Doc 4 01/09/04 8. All allegations of harm or neglect of people with learning disabilities should be allocated to a social worker. Managers allocating cases must be clear as to what has been allocated, what action is required and how that action will be reviewed and supervised. Supervision arrangements should include formal case management, with all decisions clearly recorded by the supervisor and monitored at regular intervals. 9. People with learning disabilities who are the subject of allegations of deliberate harm (regardless of the source of the allegations) must be seen and spoken to alone or with appropriate support within 24 hours of the allegations being communicated to social work. The individual’s living arrangements should be seen. If this timescale is not met, the reason for the failure must be recorded on the case file and countersigned by a manager. This requirement should apply irrespective of whether the case is known to the department. 10. In cases where concerns have been expressed about the safety of a person with learning disabilities (regardless of source), social workers undertaking home visits should be clear about the purpose of the visit, the information to be gathered during the course of it, and the steps to be taken if no-one is at home or if access is denied. Other than in emergencies, visits should not be undertaken without the social worker concerned checking the information known about the individual by other agencies. 11. All allegations of harm or neglect of people with learning disabilities must be subject to a risk assessment. All risk assessments, and any protection plans drawn up as a result, must be approved in writing by the social worker’s line manager.
