WELSH STATUTORY INSTRUMENTS 2011 No. (W. ) ROAD TRAFFIC, WALES The A55 Trunk Road (Eastbound Carriageway Lay-by, Rhuallt, Denbighshire) (Prohibition of Entry to Vehicles) Order 2011 Made 2 February 2011 Coming into force 7 February 2011 The Welsh Ministers, as traffic authority for the A55 Chester – Bangor Trunk Road (hereinafter referred to as “the trunk road”), in exercise of the powers conferred upon them by sections 1(1), 2(1) and (2), and 124 of, and paragraph 27 of Schedule 9 to, the Road Traffic Regulation Act 1984(1) (“the 1984 Act”) and, after consultation with the Chief Officer of Police for North Wales Police, make this Order. 1. This Order comes into force on 7 February 2011 and its title is The A55 Trunk Road (Eastbound Carriageway Lay-by, Rhuallt, Denbighshire) (Prohibition of Entry to Vehicles) Order 2011. 2. In this Order: “authorised vehicle” (“cerbyd awdurdodedig”) means any vehicle used by the emergency services or for the purposes of traffic management. 3. No person shall cause or permit any vehicle proceeding along the trunk road, with the exception of authorised vehicles, to enter into the lay-by described in the Schedule to this Order. 4. The prohibition imposed by this Order is in addition to and not in derogation from any restriction or requirement imposed by any Regulations made or having effect as if made under the 1984 Act or by or under any other enactment. 5. The A55 Trunk Road (Various Lay-bys, Rhuallt – Travellers’ Inn, Clwyd) (Restriction of Waiting) Order 1993(2) is revoked in respect of the lay-by described in paragraph 3 of that Order and referred to in the Schedule to this Order. SCHEDULE That length of the lay-by adjacent to the eastbound carriageway of the trunk road situated 120 metres north of the footbridge constructed on the line of the old Roman Road at Rhuallt in the County of Denbighshire. THE A55 TRUNK ROAD (EASTBOUND CARRIAGEWAY LAY-BY, RHUALLT, DENBIGHSHIRE) (PROHIBITION OF ENTRY TO VEHICLES) ORDER 2011 NOTICE IS HEREBY GIVEN that the Welsh Ministers have made an Order under sections 1(1), 2(1) and (2) and 124 of, and paragraph 27 of Schedule 9 to, the Road Traffic Regulation Act 1984 which comes into force on 7 February 2011. The effect of the Order will be to prohibit vehicles, with the exception of authorised vehicles, from entering the lay-by described in the Schedule to this Notice and to revoke, insofar as it relates to the length of trunk road described in the Schedule to this Notice, The A55 Trunk Road (Various Lay-bys, Rhuallt – Travellers’ Inn, Clwyd) (Restriction of Waiting) Order 1993. During a period of 6 weeks from 3 February 2011, a copy of the Order and plan may be inspected free of charge during normal opening hours at North Wales Trunk Road Agency, Unit 91, Bowen Court, Ffordd William Morgan, St Asaph Business Park, St Asaph, Denbighshire, LL17 0JE or may be obtained from the address below. 2 If any person wishes to question the validity of the Order, or of any provisions contained therein on the grounds: a. that it is not within the powers of the Road Traffic Regulation Act 1984; or b. that his/her interests have been prejudiced substantially by a failure to comply with any of the requirements of the Act, they may, within 6 weeks of 3 February 2011, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
