HOUSE OF ASSEMBLY REPORT OF THE CHIEF ELECTORAL OFFICER ON THE FERRYLAND BY ELECTION FEBRUARY 8, 2007 PUBLISHED UNDER THE AUTHORITY OF SECTION 214, THE ELECTIONS ACT, 1991, CHAPTER E-3.1 July 2, 2007 Honourable Harvey Hodder Speaker House of Assembly Main Floor, East Block Confederation Building St. John’s, NL Dear Speaker: Section 214 of the Elections Act states that “The Chief Electoral Office shall publish within 9 months after each general election and each by election a book containing pertinent statistics of the election, including poll by poll results of each electoral district.” That report with respect to the February 8, 2007 By Elections in the electoral districts of Ferryland, Kilbride and Port au Port is now complete. Section 273(3) states that “The Chief Electoral Officer shall report annually to the Speaker upon the affairs of the Office of the Chief Electoral Officer under this part and the report shall be laid before the House of Assembly at the first convenient opportunity.” I am enclosing at this time copies of the Ferryland, Kilbride and Port au Port By Elections for distribution to Members of the House of Assembly as per Section 19.1 (1) and (2) of the House of Assembly Act as outlined below. 19.1 (1) Notwithstanding another Act, where a report or other document that an officer of the House of Assembly is required to submit to the House of Assembly is submitted to the Speaker or the Clerk of the House of Assembly when the Assembly is not in session, the Speaker or the Clerk shall provide a copy to each member and make it available for inspection by the public immediately after the report or other document is submitted. (2) A report or other document is considered to have been tabled before the House of Assembly when it is submitted to the Speaker or Clerk under subsection (1). I trust this meets with your approval. Sincerely, Paul Reynolds cc: Mr. Bill MacKenzie Chief Electoral Officer Page 1 FERRYLAND BY ELECTION On Wednesday, January 17, 2007 a Writ of Election was issued for a By Election in the Electoral District of Ferryland to be held on Thursday, February 8, 2007. The By Election was called to fill a vacancy created by the resignation of Progressive Conservative Mr. Loyola Sullivan who resigned as Cabinet Minister and MHA on Friday, December 29, 2006. The List of Electors that was printed on January 17, 2007 was used as the Preliminary List and contained 8199 electors. Throughout the election period, updates to the list continued to be made until 4:00 p.m., Monday, February 5, 2007. A revised list containing 7406 electors was subsequently printed which identified electors who applied to vote by special (mail in) ballot, electors who voted at the advance poll and electors who applied to be added as well as other changes such as elector moves or corrections to electors= names and/or addresses. This final revised list was distributed to political parties and candidates on Tuesday, February 6, 2007 and was used by the returning officer for the electoral district and all election officials as the Official List of Electors on polling day. Nomination Day was held on Monday, January 29, 2007 with a total of three candidates officially nominated at the close; namely Kevin Bennett for the Liberal Party, Rick Boland for the New Democratic Party, and Keith Hutchings for the Progressive Conservative Party. The advance poll was held on Saturday, February 3, 2007 in four locations, Goulds, Witless Bay, Ferryland and Trepassey. A total of 69 Special (Mail In) Ballot applications were received and approved with 67 ballot kits returned by the 4:00 p.m., Monday, February 5, 2007 deadline. The preliminary count on election night resulted in 3688 votes cast. There were a total of 135 votes cast at four advance polls; 67 votes cast by special (mail in) ballot and 3486 votes cast at 36 regular polls with a 50% voter turnout. Mr. Bennett received 715 votes, Mr. Boland received 183 votes and Mr. Hutchings received 2770 votes. There were a total of 20 rejected ballots and 6 cancelled ballots. A total of 435 electors were Asworn in@ at the advance, special (mail in) ballot and regular polls. The Official Addition of the votes was held on Sunday, February 11, 2007 at the Office of the Returning Officer. The results confirmed the preliminary results on election night. Mr. Keith Hutchings was declared elected after the Official Addition and was sworn in as a Member of the House of Assembly on Monday, March 5, 2007. The results of this by election together with the Kilbride and Port au Port by elections which were also held on February 8, 2007 left representation in the House of Assembly with 34 Progressive Conservatives, 11 Liberals, 2 New Democrats and 1 vacant seat. The Chief Electoral Officer would like to extend thanks to the Returning Officer, Ms. Geraldine Kavanagh, her election clerk, Ms. Jean Doyle, the election workers from the district and the staff at the Chief Electoral Office for a job well done.
