Chekkilla Anjaiah, s/o.Yellaiah, 55 yrs, Goud r/o.Vadlur, v/o.Bejjanki mandal of Siddipet district. 3. NyalamThirupathi s/o.Laxmaiah, 29 yrs, Goud, r/o.Thimmapur village and mandal of Karimnagar dist. ¼.Petitioners/ Accused No.1 to 3 and The State through Station House Officer, Bejjanki P.S. ¼.Respondent/Complainant. Offences under Sections 307 r/w 34 IPC PETITION FILED UNDER SECTION 439 OF CR.P.C. This petition coming before me on today for hearing in the presence of Sri Y.Srinivas Reddy, Advocate for the petitioners/accused and the learned Public Prosecutor for the state, having been heard and stood over for consideration to this day, the Court made the following: :: O R D E R:: 1. The bail application is filed under Section 439 Cr.P.C., praying the Court to enlarge the petitioners/accused No.1 to 3 on bail pending investigation. 2. Notice given to Public Prosecutor, who strongly opposed the bail application stating that the investigation is pending and some more witnesses are to be examined. 3. Heard both sides. 4. Now the point for consideration is:- Whether the petitioners/ accused can be enlarged on bail ? 2 5. POINT: The learned counsel for the petitioners/accused submitted that on 1-9- 2020 the complainant lodged a report alleging that on 1-9-2020 while he was coming A1 armed with knife, A2 armed with stick assaulted him with intention to kill him by saying that " as to why he gave information to police about their sand lorry, and threatened to kill him" then A3 assaulted him with stone, he received bleeding injuries, raised hues and cries, on that Lw-2 came to his rescue, on that A1 also assaulted Lw-2 with knife as a result he received bleeding injuries on his left hand three fingers and the accused A1 to A3 also threatened to kill him. Thereby, requested to take necessary action. Basing on the above report the police Bejjanki registered a case in Cr.no.122/2020 for the offence under Sec.307 r/w 34 IPC . 6. On the other hand the learned Public Prosecutor strongly opposed the bail application stating stating that the investigation is pending and some more witnesses are to be examined. 7. Perused the record. It is seen that the present crime was set in motion prior to 1-9-2020. C.D. Part I discloses that the alleged offence is under Sec.307 r/w 34 IPC. C.D Part I further discloses that the investigation in the above crime is still pending. In view of the circumstances and the objections raised by the learned Public Prosecutor, as the investigation is pending, I am not inclined to grant bail to the petitioner/accused. The petition is devoid of any merits and there are no bonafides to consider the bail application. 8. In the result, this petition is dismissed.
