MAINTENANCE RESPONSIBILITY CHART 3 This booklet provides an overview of the rights and responsibilities of the Co-owners of Chatham Woods, and some of the rules and regulations that all residents need to follow. If there are any disputes between this booklet and the Master Deed and Bylaws, the Master Deed and By-Laws rule. 4 A. DEFINITIONS Association: The Co-owners of Chatham Woods. Association Fees: Each Co-owners share of the costs of maintaining, repairing, and insuring the shared property. Board of Directors (the "Board"): Ruling body of the Association, as defined in the Bylaws (Article IV). Co-owner(s): A person or entity that owns a unit in Chatham Woods. Common Elements: The clubhouse and pool, sidewalks and paved roadways and parking areas, exterior of all buildings, all grass and landscaped areas, including the plants, trees and shrubs. Limited Common Elements: Items usually owned by the Association but used by just one Co-owner. The maintenance and/or replacement of the Limited Common Elements is shared between the Association and the Co-owners as described in the Rules Section of this booklet. Management Company: The Board has elected to retain a professional management company to handle the day to day operations of Chatham Woods. Contact information is located in the front of this booklet. B. COOPERATION For an Association to work well, it requires cooperation and good will from the residents. It needs a high level of sensitivity concerning the rights of others and understanding that if we overstep our rights at any point, we may be violating or infringing on the rights of our neighbors. Some rights and actions that would be acceptable in a single-family dwelling are inappropriate in a condominium. Condominiums work best when mutual respect for the rights of others is present, and the need for rules and their enforcement is low. 5 C. MAINTENANCE / REPAIRS / ASSISTANCE Each Co-owner is responsible for maintaining, repairing, and insuring everything on the inside of their respective unit. For everything else, Co- owners should contact the Management Company directly; including reporting any maintenance or administrative issues, to make any special requests, or for any of the following: 1. Change of contact information, car/license plate, banking account/direct deposit. 2. Questions about Association Fees and/or your account status. 3. Report a maintenance/repair issue, concern or complaint. 4. Request a modification to your unit. 5. Request Emergency service. 6. Request approval to lease your unit. 7. When planning on selling your unit. 8. Any special request. Co-owners may also contact any Board Member regarding any of the above; however, it could delay your request being forwarded to the Management Company. D. RULES There are two types of rules in this booklet. Type I rules are from the Master Deed and Bylaws, as required by the Michigan Condominium Act. Type II rules have been created by the Board specifically for Chatham Woods. The Board has the power to revise, add, or delete any of the Type II rules. 6 1. Unit Modifications/Alterations a. No exterior alterations or structural modifications may be made to a unit without prior written approval of the Board. b. Modification/Removal of any interior walls requires Board approval to ensure no load bearing walls are affected. c. All work must be performed by a licensed contractor. d. Painting, carpeting of patios/decks is not allowed. e. Installation of wood burning stoves is not allowed for insurance reasons. f. Satellite dishes are to be installed in accordance with Board guidelines, and Board must be notified prior to installation. 2. Occupancy a. Residential occupancy as a single-family residence only. b. Two-bedroom units are limited to 4 occupants. c. Three-bedroom units are limited to 5 occupants. 3. Leases a. No portion of a unit may be rented at any time. b. Leases of entire units require prior written approval of the Board. 4. Signs or Advertising a. No signs or visible advertising may be displayed without prior approval of the Board. 5. Use of Common Elements a. No storage of supplies, personal property, trash or refuse is permitted. 6. Use of Limited Common Elements a. No storage of supplies, trash, refuse, or excessive clutter is permitted. b. During the winter only patio furniture and grills may be stored on decks. 7 7. Pets: a. No more than 1 household pet may be kept in any unit without the prior written consent of the Association. b. Dogs are to be on a leash when outside (per Cascade Ord.) c. Pet waste is to be picked up and disposed of immediately. d. No pets are allowed to roam freely around the Association. e. No savage or dangerous pets are permitted. f. No barking on a frequent or continuous basis is allowed. 8. Trash & Recycling: a. Arrowaste handles the trash pickup at Chatham Woods. b. Trash is picked up on Mondays and Thursdays c. The dumpsters are centrally located within the Association. The dumpsters are for household trash ONLY. Do not place large items in the dumpsters – you will need to contact Arrowaste to arrange a pickup. d. Arrowaste handles the recycling at Chatham Woods. e. Recycling is picked up every other week on Thursday. f. The bins are in two areas: i. Knightsbridge Rd – the same area as the trash dumpsters ii. Chatham Woods St – by Buildings 3 & 4 g. There is one dumpster for corrugated cartons – boxes MUST be broken down. h. Do not recycle plastic shopping bags. Recyclables should be bagged in paper bags or emptied from plastic bags at the bins. Plastic bags are to be put in the trash or recycled at designated sites around the community. 9. Parking: Chatham Woods is a residential neighborhood with limited driving areas and parking spaces. a. Your parking sticker must be placed in your rear window in the bottom right corner. i. This is for identification purposes. If a vehicle doe does not have a sticker, it could be subject to towing at the owner’s expense. 8 a. Parking spaces, including carports, are for registered functioning cars, trucks, and motorcycles only; excluding any vehicle that is longer than a standard carport space (i.e. trucks with extended cabs/beds). No boats, trailers, campers, or commercial or unlicensed vehicles are allowed on the property. Exception: campers may be parked on the property for a period not to exceed 24 hours for loading and unloading, with prior Board approval. b. No parking of any vehicle that is non-operational for more than 7 days is allowed. c. Co-owner is responsible for, and will be assessed for, damage or repairs necessary due to excessive oil leaks. d. Do not park in any cross-hatched areas, or in front of sidewalk access points. e. No parking in the drives or roadways f. Parking spaces and carports are not to be used for extended vehicle repair projects. g. No parking or washing vehicles in any grass covered areas. h. No one other than residents should be utilizing any parking spaces for any extended period of time. i. Carports are not to be used for storage of personal items other than bicycles. j. Any vehicle obstructing traffic, improperly parked, abandoned, and/or non-operational can be towed at owner's expense. 10. Roadways, Parking Areas/Carports Sidewalks: These areas are not to be used as play areas. a. No skateboards, roller blades or scooters may be ridden or operated in any paved area. b. Bicycles may be ridden on paved roadways only, NOT on sidewalks, parking areas, or in carports. ii. Bicycle helmets are required for anyone under 14, per Cascade Township Ordinance. c. All vehicles are required to obey speed limit and traffic signs. 9 11. Visitors: Co-owners are responsible for the actions of their visitors, and for any fines their visitors may incur, including speeding and parking violations. 12. Maintenance and Repair Responsibilities: See chart at back of booklet 13. Maintenance of Grounds a. Anyone damaging the lawn areas by driving or parking on them, or any by other willful or negligent act, is responsible for any repair costs. b. Woodpiles are to be kept at least 3 feet from any building to reduce the threat of termites/pests/rodents. c. Outdoor patios and decks should be maintained and kept clean and free of trash. d. No vegetable gardens are allowed. e. Flower planting is confined to areas immediately adjacent to your unit. f. Co-owners are encouraged, but not required, to water their own areas. Hoses should be rolled up and properly stored when not in use. g. Front doors/Entryways should be kept neat and tidy. h. All lawn care and maintenance is under the supervision of the Board. 14. Clubhouse a. May only be rented to a Co-owner, who must be present at all times during the rental period. b. May not be used for overnight sleeping. c. All vehicles must be parked in a designated parking space, not on grass, along roadways, or in residents’ carports.
