This writ petition is filed under Articles 226 & 227 of the Constitution of India, praying to quash the office note bearing Ref.No.PWPM:ON:204:GM:148:07 dated 27.12.2007 vide Annexure-M and etc. 2 This petition coming on for orders this day, the Court made the following: ORDER 1. In this writ petition, petitioner has challenged Annexure- M endorsement issued by the 2 nd respondent. Petitioner has also sought for a writ of mandamus against the respondent – Bank to release lump sum ex-gratia payment to the dependants of deceased Sri Jagannath O. Kanchan who was working as a clerk at Pedambur Branch of Canara Bank and who died in harness. 2. Both parties have agreed to settle the dispute. Accordingly, a joint memo has been filed. The joint memo reads as under: a) After mutual discussions, the respondent Bank has agreed to pay Rs.6,26,883.49 (Rupees six lakhs twenty six thousand eight hundred eighty three and forty nine paise only) as ex-gratia in lieu of compassionate appointment towards full and final settlement of claim of the family of deceased Sri Jagannath O. Kanchan (staff No.10485) Clerk. b) The petitioner also has agreed to receive the above said amount towards full and final settlement of the entire claim in this regard. 3 c) The petitioner agrees and submits that she has no more claims in the mater of services relating to her husband Sri Jagannath O. Kanchan (Staff No.10485) Clerk with the respondent – Bank. 3. The joint memo has been duly signed by both parties and their learned counsel. Learned counsel for the parties submit that this writ petition may be disposed of in terms of the joint memo. Learned counsel for the Bank submits that the amount as agreed in the joint memo will be paid within fifteen days from the date of receipt of a copy of this order. 4. Placing the joint memo on record and the assurance given by the learned counsel for the Bank that the amount will be paid as agreed in the joint memo within fifteen days from the date of receipt of a copy of this order, this writ petition is disposed of.
