No.PO909- RE: 01, from Mr Michael Meehan to Annyalla Chicks Limited CRO No. 34965 Background Licence Reg. No. P0909-01 was granted to Mr Michael Meehan on the 12/04/2010. Mr Michael Meehan and Annyalla Chicks Limited, applied to the Agency on 3 January 2013, to transfer the licence to Annyalla Chicks Limited. According to the applicants the basis for the transfer application is that the proposed transferee has taken over the lease of this poultry farm. The transfer of the licence will allow Annyalla Chicks Limited to operate the installation, currently operating at Rossarreel and Donagh, Glaslough, County Monaghan, under licence Reg. No. P0909-01. The Agency is informed that Annyalla Chicks Limited is a limited company incorporated under the laws of Ireland and registered in the Companies Registration Office (Registered Number 34965). The directors of this company have over 40 years experience in the poultry industry. Assessment The application was assessed under Section 94 of the Environmental Protection Agency Acts, as amended. It is deemed to comply with the requirements of the above, as follows: Requirements of Section 94(2) and 94(3) 0 The application complies with Subsection (2) having been jointly made by the current licensee and the proposed transferee. The application was made in the form prescribed by the Agency. 0 The application was accompanied by the appropriate fee, in accordance with Article 7(a) of the EPA (Licensing Fees) Regulations, as amended. 1 Such information as may be required by Section 94(3) 0 Any costs associated with the closure of the installation have been fully detailed by the applicants and have been approved by the Office of Environmental Enforcement (OEE). 0 Any costs associated with any environmental event (ELRA, etc.) at the installation have been fully detailed by the applicants and have been approved by OEE. 0 The transferee or any relevant person has not had an application for a licence refused. Requirements of Section 94(5) 0 Information in relation to the status of the proposed transferee as a ‘Fit and Proper Person’ has been provided and, based on a review of the information; the proposed transferee has no relevant convictions and has sufficient technical experience and support. 0 In relation to Financial Provision, a Public Liability Insurance is to be provided for Annyalla Chicks Limited. This Financial Provision has been agreed with the Office of Environmental Enforcement. Approval memo from OEE in relation to ELR/RMP & Financial Provision is attached. Requirements of Section 94(6) 0 The proposed transferee has stated in writing that they accept all liabilities, requirements and obligations provided for in or arising under the licence regardless of how and in respect of what period, including a period prior to the transfer of a licence, that may arise. Recommendation It is recommended that the transfer of IPPC licence Reg. No. P0909-01 from Mr Michael Meehan to Annyalla Chicks Limited, CRO No. 34965, is approved under Section 94 of the Environmental Protection Agency Acts, as amended. No. P0909-01 from Mr Michael Meehan to Annyalla Chicks Limited 1 confirm that OEE has approved the Environmental Liabilities Risk Assessment and Residuals Management Plan for Mr Michael Meehan and the Financial Provision for Annyalla Chicks Limited (our ref: PO909-01/akOlrns). The Financial Provision for the proposed transferee (Annyalla Chicks Limited) takes the form of Public Liability Insurance with a limit of indemnity of €2.6 million for pollution or contamination which is deemed to have occurred during any one period of insurance. A statement from the proposed transferee’s auditors stating that ”the company has substantial retained profits and is financially secure” was also provided to OEE.
