Statutory Document No. 0295/12 Misuse of Drugs Act 1976 MISUSE OF DRUGS (CONTROLLED DRUG SPECIFICATION) (METHOXETAMINE) ORDER 2012 Approved by Tynwald: Coming into Operation: 1 July 2012 The Department of Health makes the following Order under section 2(3) of the Misuse of Drugs Act 19761. 1 Title This Order is the Misuse of Drugs (Controlled Drug Specification) (Methoxetamine) Order 2012. 2 Commencement If approved by Tynwald, this Order comes into operation on 1 July 2012. 3 Specification of substance as a controlled drug (1) The following substances (commonly known as methoxetamine) are specified as controlled drugs under the Misuse of Drugs Act 1976— (a) 2-(ethylamino)-2-(3-methoxyphenyl)cyclohexanone, also known as MXE, mexxy, 3-MeO-2-Oxo-PCE, 2-(3-methoxyphenyl)-2- (ethylamino)cyclohexanone and other synonyms, having the empirical chemical formula C15H21NO2; (b) any stereoisomeric form of the substance specified in paragraph (a); (c) any ester or ether of a substance specified in paragraph (a) or (b); (d) any salt of a substance specified in any of paragraphs (a) to (c); and (e) any preparation or other product containing a substance specified in any of paragraphs (a) to (d). 1 1976 c. 21 Section 2(3) of the Act provides that the Advisory Council must be consulted MADE 5TH MAY 2012 DAVID M ANDERSON Minister for Health EXPLANATORY NOTE (This note is not part of the Order) This Order specifies 2-(ethylamino)-2-(3-methoxyphenyl) cyclohexanone (commonly known as methoxetamine) and its derivatives as listed in article 3 as a controlled drug which is to be treated as if it was a Class C drug for the purposes of the Misuse of Drugs Act 1976 (“the Act”) (see section 2(3) and (7) of the Act). This Order automatically ceases to have effect at the end of the period of 12 months beginning with the day on which it comes into operation (see section 2(4) of the Act). If the substance specified in this Order is subsequently specified in Part I, II or III of Schedule 2 to the Misuse of Drugs Act 1971 (an Act of Parliament), it ceases to be specified in this Order (see section 2(6) of the Act). 2 .
