Appendix VIII: Environmental and Socio-economic Impact Assessment for the Suncor Lateral Replacement Construction and deactivation activity will take place within the existing Enbridge easement, the existing Suncor custody transfer metering facility and the Suncor take-off located on Enbridge property. Additional temporary working rights will be acquired adjacent to the west side of the easement. Enbridge submits that any potentially adverse environmental or socio-economic effects arising from the Project will be temporary, insignificant and outweighed by the benefits of the Project. But for the fact that the Project will be carried out near a water body, it would otherwise fall within the Exclusion List Regulations of the Canadian Environmental Assessment Act. Because of the location of the lateral in relation to LaSalle Line, the confluence of two creeks, the Aamjiwnaang Reserve, an environmental reserve and other utilities, Enbridge initiated an early public notification program relating to the Project in accordance with Part II of Guidelines for Filing Requirements. To date Enbridge has held a public open house, made contact with representatives of area stakeholders and has been in contact with representatives of the Aamjiwnaang First Nation on a number of occasions. To date no party has expressed concerns about the Project. Enbridge will be continuing to make information about the Project and its potential impacts available to stakeholders. Enbridge is in the process of finalizing an agreement with the Aamjiwnaang for access to a working rights area adjacent to Enbridge’s existing easement for the purposes of carrying out the Project and will continue to work with the Aamjiwnaang to finalize that agreement. The Project will be designed and constructed in accordance with the Onshore Pipeline Regulations, 1999, CSA Z662-03 (July 2003 Edition), Enbridge's Engineering Standards, Enbridge’s Environmental Standards and Guidelines for Pipeline and Facility Construction (1997), and measures as identified in the environmental and socio-economic impact assessment. Furthermore, Enbridge will follow and comply with the contingency practices and guidelines contained within both its Waste Management Plan (June 2002 revision) and its Emergency Response Plan (May 31, 2002 revision), on file with the National Energy Board. Enbridge identified the need to repair or replace the Suncor Lateral as a result of its lateral integrity program. For all the reasons set out in the body of the Application, Enbridge determined that replacement was the only practicable alternative. Having made that determination, and in order to minimize the risk of a leak and of an interruption in service to the Suncor refinery, Enbridge would prefer to replace and deactivate the existing lateral sooner rather than later, ideally before the end of December 2003 and so Enbridge respectfully requests that the Board consider this application as expeditiously as possible. Application for Replacement and Deactivation Pursuant to Section 58 of the National Energy Board Act and Section 44 of the Onshore Pipeline Regulations: Suncor Lateral Replacement DETAILS OF PROJECT GROUP A – PIPELINES Project Name: Suncor Lateral Replacement Project Project Reference: AFE # 0341144A04 and AFE # 0341144N01 Project Cost: $2,920,000 / $337,000 GENERAL PROJECT DESCRIPTION Enbridge applies to replace and deactivate approximately 1.7 km of 24-inch lateral pipe that is the sole source of supply to the Suncor Energy Products refinery in Sarnia, Ontario. The deactivation will consist of excavating, cleaning, sealing and removing all of the existing lateral pipe except for that segment under the watercourse which will be cleaned and grouted. Carrying out the project in that order, that is replace and then deactivate, will minimize the resulting interruption of service to the Suncor refinery which has a capacity of approximately 70,000 barrels of crude oil per day and serves approximately 17% of the Ontario refined products market.1 The new lateral pipe will be installed within Enbridge’s existing easement in the utility corridor that runs from LaSalle Line in a northeasterly direction parallel to the Canadian National Railway right-of-way to the take off point at the Suncor refinery. EARLY PUBLIC NOTIFICATION PROGRAM Enbridge has initiated a public information program to explain the Project to the public including its potential environmental and socio-economic effects. In addition, Enbridge has commenced a consultation process specifically with the Aamjiwnaang First Nation as the Project passes through Aamjiwnaang reserve land. EARLY PUBLIC NOTIFICATION 1. Goals and Objectives of Program Enbridge has implemented an Early Public Notification (“EPN”) program to ensure that local landowners, residents and the community were thoroughly informed of the Project prior to the filing of this Application with the National Energy Board (the “Board” or “NEB”). Enbridge utilized both internal and external consulting resources to develop and implement this program according to the Board’s Guidelines for Filing Requirements – Part II – Early Public Notification (“Guidelines”). The following EPN program goals and objectives were developed by Enbridge for the Project: 1 Suncor Energy website and annual report. Application for Replacement and Deactivation Pursuant to Section 58 of the National Energy Board Act and Section 44 of the Onshore Pipeline Regulations: Suncor Lateral Replacement DETAILS OF PROJECT S to provide to stakeholders in the vicinity of the Project, or who may otherwise be affected by the Project with sufficient information about the Project, and its potential environmental and socio-economic effects to allow stakeholders to raise any questions or concerns they may have; S to identify and resolve issues that might be identified by local stakeholders; and S to assist in gaining support for the Project from stakeholders in the vicinity of the Project 2. Program Overview Stakeholders in the vicinity of the Suncor Lateral pipeline and the city of Sarnia were advised of the Project by way of: S a letter to landowners S an advertisement in the local paper (“Public Notice”) S an Open House meeting in Sarnia to discuss the details of the Project and potential issues of interest S one-on-one discussions and written notifications to other stakeholders, including MPs, MPPs, and city officials S a direct consultation program with the Aamjiwnaang First Nation, whose reserve land forms part of the Project’s right-of-way corridor The public was encouraged to provide comments or concerns to an Enbridge contact person at the company’s Sarnia Terminal. A total of two calls have been placed to the Enbridge Sarnia contact; all were related to general project information such as anticipated construction schedule and employment/contract opportunities available. To date, no concerns have been raised through the telephone contact 3. Communication Tools 3.1 Letter of Notification Appendix I includes an example of the typical letter that was sent to area stakeholders to advise them of the project, and to obtain temporary working rights and/or crossing permits. These letters were supplemented by telephone calls to these stakeholders, who largely consisted of utilities and refineries. A complete list is included below: Bell Canada Ltd. On October 11, 2003, the advertisement was placed in the local newspaper, The Observer, which has a circulation of 23,500 that covers the local area in and around Sarnia. The advertisement outlined the nature of the Project and provided a local contact at the Enbridge Sarnia Terminal from whom interested stakeholders could receive additional information. The advertisement also provided advance notice and details of the Project Open House, which was held on October 21, 2003. To date, Enbridge received one phone call in response to its newspaper advertisement to solicit general project information such as anticipated construction schedule and employment/contract opportunities available. 3.3 Public Open House Meeting Appendix III is a copy of the Project information posters that were used on October 21, 2003 at an Enbridge-hosted Open House meeting to present project details and discuss any issues or concerns raised by anyone interested in the Project. There was limited public interest in the Project information presented at the Open House, and no concerns or issues were raised during the event. To date no telephone inquiries have been received as a result of the Open House. 3.4 Discussions and Notifications to Other Stakeholders Appendix I includes a copy of the letter sent to the Mayor of Sarnia, the local Member of Parliament and local Member of Provincial Parliament. The letter provided an overview of the rationale, location, construction details and socio-economic assessments of the Project. To date no inquiries have been received as a result of the
