Jenkins, indicated that this would be last meeting of the Planning Committee with its present members. He paid tribute to the help and assistance given by his Vice-Chairman, Councillor L.R. Rees and fellow Members. He also thanked the Chief Planning Officer and his staff for the help and assistance during his term of office. 2369 MINUTES RESOLVED that subject to Councillor E.G. Morgan’s name being deleted from the list of those present and the reference in minute 2295 being to ‘8 flats’ and not ‘9 flats’, the minutes of the last meetings of the Committee held on 25th February 1999 (minute nos 1972-2019, page nos. 539-548), 18th March 1999 (minute nos 2127-2161, page nos. 577-585) and 15th April 1999 (minute nos. 2284 - 2309, page nos. 620 - 626) be approved as true records and signed by the Chairman. 638 Planning - 29.4.99 PLANNING APPLICATIONS UNDER THE TOWN AND COUNTRY PLANNING ACT 1990 AND ASSOCIATED LEGISLATION 2370 Application Ref. P/99/0061 - Conservatory to Rear of Property at 73 Cwrt Nant y Felin, Castle View, Caerphilly This application was reported to the Planning Committee on the 18th March 1999 and was deferred for a site visit. Following the report of the site visit to the Planning Committee on the 15th April determination of this application was again deferred for a report outlining conditions if the application was to be approved. RESOLVED that subject to the following conditions application no. P/99/0061 be granted. (1) the development hereby permitted shall be begun before the expiration of five years from the date of this permission; (2) notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 1995 (or any order revoking or re-enacting that Order with or without modification), the conservatory windows on the north- western elevation shall be fitted and maintained thereafter with fixed and obscure glazing. Reason: (1) to comply with the provisions of Section 91 of the Town and Country Planning Act 1990; (2) in the interests of residential amenity. P/99/0193 be refused. 2376 Code No. P/99/0213 - Erect 25 Metre High Lightweight Lattice Tower with Two Dual Polar Antennae and 2 x 0.6 Metre Microwave Dishes and Integrated Equipment Cabinet at Land at Pen-yr-Heol Las, Manmoel, Blackwood RESOLVED that subject to the conditions contained in the officer’s report and the following additional condition, application no. P/99/0213 be granted. “Condition 2 If the telecommunications mast hereby approved becomes inoperative for a period in excess of six months, the said structure and any ancillary equipment shall be dismantled down to ground level and removed from the site, and the site restored in accordance with a scheme to be agreed with the Local Planning Authority, unless the Local Planning Authority agrees in writing that this condition need not be applied. P/99/0217 be granted; (ii) the comments of the Chief Environmental Health Officer be forwarded to the agents. 640 Planning - 29.4.99 2378 Code No. P/99/0222 - Change the Use of Vacant Shop to Take-Away Hot Food Shop (Use Class A3) at 49 Maindee Road, Cwmfelinfach, Newport RESOLVED that for the reasons contained in the officer’s report, application no. P/99/0222 be refused. 2379 Code No. P/99/0226 - Instal 3 No. 6.5 Metre Floodlights for Training Area at Treowen Stars AFC, The Uplands, Newbridge RESOLVED that:- (i) subject to the conditions contained in the officer’s report, application no. P/99/0226 be granted; (ii) the advice of the Chief Environmental Health Officer be forwarded to the applicant. 2380 Code No. P/99/0273 - Convert Garage at 9 St. Cenydd Close, Pontllanfraith, Blackwood RESOLVED that provided no material planning objections are received by 3rd May 1999, application no. P/99?0273 be granted subject to the conditions contained in the officers report. 2381 URGENT ITEM The Chairman, Councillor S. Jenkins, certified that because of the need to determine this matter as soon as possible to allow works to commence on site, this was an urgent item under the terms of Section 100(B)(4) of the Local Government Act 1972 and should be dealt with at this meeting. 2382 DEVELOPMENT AT LAND AT BEDWAS RUGBY CLUB, NEWPORT ROAD, BEDWAS (MINUTE 1992, PAGE 543) At a previous meeting the Committee considered a planning application for the construction of an office building on land at Bedwas RFC's ground off Bedwas Road, Bedwas (application no. P/98/1100). Granting permission was deferred pending the developers entering into an agreement under Section 106 of the Town and Country Planning Act 1990 designed to secure a contribution of 50% or £75,000 whichever was the greater towards the cost of the design and construction of the traffic signalled control junction required as part of the development. It was considered that there was a need to clarify the meaning of the resolution since it was not clear as to whether the contribution was to relate to the estimated or actual cost of the works to the junction. The estimated cost of the works was £250,000 and a contribution of £175,000 of that sum had been negotiated with the developers which taking into account finance from other sources was considered a satisfactory contribution. Condition 8 attached to the consent required the temporary access to be located at the permanent access point. The construction phase of the office development and the highway works now overlaped the close season at the rugby club. It was considered beneficial, to take advantage of this and allow construction traffic related to the office development to gain access, when appropriate, via the rugby club access to the east of the site. This would minimise potential disruption to the progress of the highway works. 641 Planning - 29.4.99 RESOLVED that:- (i) minute 1992(i) on page 543 be amended to read:- “the granting of permission be deferred pending the developers entering into an agreement under Section 106 of the Town and Country Planning Act 1990 designed to secure a contribution of £175,000 towards the cost of the design and construction of the traffic signalled control junction required as part of the development”.
