(“Acronis”), alleges as follows: 4 INTRODUCTION 5 1. This is an action brought by Symantec against Acronis for Acronis’ infringement of 6 Symantec’s patents. In particular, Symantec seeks remedies for Acronis’ infringement of 7 Symantec’s U.S. Patents Nos. 7,565,517 (“the ‘517 patent”) and 7,266,655 (“the ‘655 patent”) 8 (collectively, “the Asserted Patents”). 9 PARTIES 10 2. Symantec Corp. is a corporation organized and existing under the laws of the State 11 of Delaware, having a principal place of business at 350 Ellis Street, Mountain View, California 12 94043. 13 3. Upon information and belief, Acronis, Inc. is a corporation organized and existing 14 under the laws of the State of Delaware, having a principal place of business at 300 Trade Center, 15 Suite 6700, Elm Street, Woburn, Massachusetts 01801. Upon information and belief, Acronis 16 sells backup, recovery and security software both directly and indirectly through partners, resellers 17 and retailers. 18 JURISDICTION AND VENUE 19 4. This lawsuit is a civil action for patent infringement arising under the patent laws 20 of the United States, 35 U.S.C. § 101, et seq. Accordingly, this Court has subject matter 21 jurisdiction pursuant to 28 U.S.C. §§ 1331 and 1338(a). 22 5. This Court has personal jurisdiction over Acronis for at least the following reasons: 23 (i) Acronis has designated an agent for service of process in the State of California; (ii) Acronis 24 has committed acts of patent infringement and/or contributed to or induced acts of patent 25 infringement by others in this District and elsewhere in California and the United States; (iii) 26 Acronis regularly does business or solicits business, engages in other persistent courses of 27 conduct, and/or derives substantial revenue from products and/or services provided to individuals 28 -1- Case No. 3:11-cv-05310 EMC AMENDED COMPLAINT FOR PATENT INFRINGEMENT AND DEMAND FOR JURY TRIAL Case3:11-cv-05310-EMC Document54 Filed03/02/12 Page3 of 9 1 in this District and in this State; and (iv) Acronis has purposefully established substantial, 2 systematic and continuous contacts with this District and expects or should reasonably expect to 3 be haled into court here. Thus, this Court’s exercise of jurisdiction over Acronis will not offend 4 traditional notions of fair play and substantial justice. 5 6. Venue is proper in this judicial district pursuant to 28 U.S.C. §§ 1391(b)-(c) and 6 1400(b) because Acronis does business in the State of California, has committed acts of 7 infringement in this State and in this District, a substantial part of the events or omissions giving 8 rise to this claim occurred in this District, and Acronis is subject to personal jurisdiction in this 9 District. 10 INTRADISTRICT ASSIGNMENT 11 7. Pursuant to Civil L.R. 3-2(c), this case is appropriate for assignment on a district- 12 wide basis because this is an Intellectual Property Action. 13 FACTUAL BACKGROUND 14 Symantec’s History 15 8. Since its inception, Symantec has been providing software products to enhance its 16 customers’ computing productivity, security and reliability. Symantec was founded in 1982 by 17 computer scientist Gary Hendrix with a grant from the National Science Foundation. Originally 18 focused on natural language processing and artificial intelligence-related products, Symantec grew 19 throughout the 1980s through organic growth and strategic acquisitions in the computer software 20 field. In 1990, Symantec merged with Peter Norton Computing, a developer of various consumer 21 antivirus and data management utilities. At the time, Symantec was already a market leader for 22 Macintosh antivirus and utilities software and had already begun development of a DOS-based 23 antivirus program, making the merger with Norton strategically advantageous. “Norton 24 Antivirus” was launched in 1991. By 1993, the Norton product group accounted for 82% of 25 Symantec’s total revenues. 26 9. Among other areas of expansion, Symantec sought to develop and acquire more 27 products for corporate customers. Specifically, Symantec sought to offer products that would 28 serve enterprise environments in which desktop computers were connected with local and other -2- Case No. 3:11-cv-05310 EMC AMENDED COMPLAINT FOR PATENT INFRINGEMENT AND DEMAND FOR JURY TRIAL Case3:11-cv-05310-EMC Document54 Filed03/02/12 Page4 of 9 1 networks. Symantec was determined to achieve its goal of providing integrated, platform- 2 independent and centralized network administration solutions. Symantec’s investment and 3 innovation led to the launching the Norton Enterprise Framework in 1996. 4 10. By the late 1990s, Symantec was marketing three major product lines. The first 5 covered security and assistance products, consisting mainly of Norton AntiVirus and Norton 6 Utilities products to keep personal computers protected and reliable. The second line included 7 remote productivity solutions, which enabled telecommuters, mobile professionals and workers in 8 remote offices to access information, applications and data on-demand from any location. The 9 third line included internet tools, primarily for Java programmers. Symantec expended 10 tremendous resources in research and development to create the intellectual property upon which 11 these products are based. 12 11. In 2005, Symantec merged with Veritas Software Corporation (“Veritas”), a 13 pioneer and market leader specialized in storage management software. With the addition of 14 Veritas, Symantec doubled its size to more than 15,000 employees. More importantly, the merger 15 of Veritas and Symantec brought with it a vast amount of additional expertise and talent upon 16 which the new joint venture could build. Indeed, with the merger, Symantec also acquired the 17 know-how and intellectual property developed by Veritas through Veritas’ own extensive research 18 and development investments. As a result of the merger, Symantec established itself as a leader in 19 the enterprise software market, enabling Symantec to address and solve an expansive spectrum of 20 security and data management challenges. 21 12. Since 2005, Symantec has continued its innovation in the enterprise field helping 22 customers from consumers and small businesses to the largest global organizations secure and 23 manage their information. Today, Symantec offers state-of-the-art products such as Enterprise 24 Vault 7.0 which provides companies a comprehensive system to store, manage, backup and 25 archive critical business information. In addition, Symantec provides other leading end-to-end 26 enterprise solutions such as Backup Exec, Symantec Endpoint Protection, NetBackup, and Storage 27 Foundation. 28 -3- Case No. 3:11-cv-05310 EMC AMENDED COMPLAINT FOR PATENT INFRINGEMENT AND DEMAND FOR JURY TRIAL Case3:11-cv-05310-EMC Document54 Filed03/02/12 Page5 of 9 1 13. One of the major keys to Symantec’s success has been its substantial investment in 2 research and development which has enabled Symantec to offer its users the most innovative 3 technologies on the market. Symantec has invested more than $5 billion in research and 4 development since 2005. Indeed, Symantec’s patent portfolio includes over 1,900 issued patents 5 and more than 1,900 pending patent applications, including over 1,700 patent applications filed 6 since 2005. 7 14. As a result of Symantec’s investments, Symantec has become one of the largest and 8 most successful computer software companies in the United States. This success, in turn, has 9 helped thousands of Symantec customers increase their own productivity through more secure and 10 reliable computer systems and networks. 11 Symantec’s Patents-in-Suit 12 15. The Patents-in-Suit are a reflection of Symantec’s research and development 13 achievements. To enable an enterprise to securely and reliably backup and recover its critical 14 business data, certain functionality relating to the saving and recovery of data is essential. Among 15 the features necessary to perform state-of-the art backups and recoveries include imaging of 16 physical and virtual machines and restoring imaged data to various computer hardware 17 configurations. These features involve use of Symantec’s innovations. 18 16. In many circumstances, a user will find it necessary or desirable to modify the 19 backed-up data or software.
