Episode #259 “The Phantom Menace” At the Now Wear This boutique, Matt comes dashing in, having heard the gun shot from his law office upstairs. He finds Kelly nearly hysterical, staring at the apparently dead body of Joe Patch, the rapist. Matt rushes to Kelly’s side, telling her not to answer any questions other than the fact that this man had locked the door and threatened her. The police arrive and order both Kelly and Matt to lie on the floor as their wrists are cuffed behind them. Matt protests that Kelly is the victim. She says that he was the one who raped her. .A paramedic verifies that the attacker is dead of gunshot wounds. Kelly questions Matt as to whether he knew Joe Patch. Matt says that he was a client , charged with robbery, that he defended and kept out of jail. The anguished couple is escorted to a waiting police car. At the beach apartment, Wayne has arrived back in town. Donna expresses concern that he has given up his volleyball career to come home and be with her. After a brief kiss, she says that she just came off an intense relationship, and is not sure she is ready to plunge right into another one. Wayne covers by answering that all he expects is for her to join him in having fun. The ringing phone interrupts the conversation. Matt tells her about the shooting and that Kelly has been arrested. At the After Dark club, Noah is tending bar, as cocktail waitress, Cherise, comes over and turns in an order. She lets him know that she is very interested in him. Noah brushes her aside, maintaining a strictly business attitude. Donna telephones from her car, saying she needs to talk to him about a very serious problem. Noah refuses to talk and hangs up, still hurt from discovering that she spent the night with Wayne. He turns back to Cherise and asks if she has plans after work. Donna telephones Dylan at the bungalow to tell him about the shooting at the boutique. Dylan answers that he’ll meet her at the Beverly Hills Police Station in ten minutes. He turns to Gina and invites her to come along with him. At the station, Kelly, with Matt present, is being interrogated by Detective Hayes. She tells him that Joe Patch locked the boutique door and pulled a knife. When he keep coming toward her, she fired the gun. Hayes asks if she told the attacker to halt. Kelly answers that he was the one who had raped her a month ago. Hayes tries to be gentle, but repeats his question, as to whether Kelly told the man to stop, before she fired the gun. Episode 259 – Page 2 In the police waiting room, Kelly’s friends have gathered. When Dylan says he is going to find out the details, David bristles, snapping that he doesn’t belong here. The two square off, but Steve steps between them and they are separated to opposite sides of the room. Dylan settles on a bench with Gina. David, standing with Donna, glares at him. In the Interrogation Room, Detective Hayes continues his questioning of Kelly, asking where she obtained the unregistered hand gun. Matt answers that he has advised his client not to answer that question. Hayes adds that it is a felony to purchase, acquire or use, an unlicensed firearm. In the waiting room, a pushy television reporter approaches Dylan for a comment, but he pushes the camera aside. When she persists, David unplugs the microphone and tosses it across the floor. Everyone is tense, as Gina excuses herself to get a coffee at the machine in the hallway. Steve scoffs that reporters like that give the whole business a bad name. Janet reminds him that is the same business they’re in. In the hallway by the coffee dispenser, Gina is approached by the same woman reporter. Gina , hesitates, then shrugs and makes a statement. Detective Hayes asks Kelly as to how Joe Patch knew where to find her. Matt speaks up saying that he was in his office upstairs and Joe mentioned that he wanted to buy a gift for his girlfriend. He sent him down to the boutique. Matt adds that he had no idea that Patch was the rapist, and he had been assigned to him by the court, on a different charge. Matt comes to the waiting room to advise the group as to what is happening. He says that for the present, Kelly is involved in a homicide shooting, resulting in a death. He adds that she knows that they all came to the station, and appreciates their support, but there is really no reason to hang around. He promises to let them know of any new developments. He then pulls Dylan aside and asks if he knows where Kelly obtained the hand gun. Dylan answers that he gave it to her. Matt snaps that the gun was unlicensed. Dylan says that he’ll confess that he provided her with the weapon, after she was attacked and raped. Matt tells him that, with his past record, he’d go to jail. Dylan protests that why can’t they see that Kelly is the victim. Matt sighs, that the complication is, that Kelly also committed a felony. Episode 259 – Page 3 At the After Dark. the group sit around glumly, mulling over the charges against Kelly. Steve suggests that what Kelly did was justified, but Janet reminds him that even scum like Joe Patch, have the right to a trial. David spots Noah across the room with Cherise. When he asks Donna if she has told Noah, she lies, saying that she couldn’t reach him. David points toward Noah, saying that now’s her chance. Noah sees Donna approaching and purposely gives Cherise a sexy kiss. Donna pushes forward anyway and tells him about Kelly’s trouble. Noah brushes past her and crosses to the rest of the group asking for details, ignoring her. At the bungalow, David is having breakfast as Dylan comes from his bedroom saying he is going to the Police Station to check on Kelly. David ignores him. Dylan then says that he is sorry about taking Gina away from him, and that it just happened. David flares in anger telling Dylan not to give him this bull. He adds that Dylan is just a spoiled, selfish pig, and he wants him to move out. Dylan starts for the door answering that he’ll be moving to a hotel tonight. At the Police Station, Matt has arranged for Kelly to be released from custody, but the ruling about her having an unregistered hand gun has not been decided. Kelly protests to Detective Hayes, that she was handcuffed and treated like a common criminal, when all she did was defend herself against a rapist who came at her with a knife. Hayes apologizes for any lack of consideration by his department, but they have to follow the rules, since she is involved in a homicide killing. Donna arrives and rushes to give Kelly a comforting hug. Kelly and Matt walk toward the exit, as Donna asks Hayes about the cleanup of the shattered glass and blood stains. Hayes answers that the department has no funding for that sort of job, but he can recommend a private company to her. At the Beverly Beat newspaper office, Steve tells Janet they have to get back to the business of setting up the next issue of the paper. Janet protests, saying that somehow to be doing stories about “Stars who binge”, and “Hermaphrodites in Hollywood”, seems unimportant, after what Kelly has been through. Steve counters that even with all the serious crime around them, people still need some escape from reality. Janet answers the telephone, then has the caller hang on for a moment. She explains to Steve that she would like some privacy for the call, and reminds him that he promised to put a partition around her desk, for just this reason. Steve grumbles but heads off to the Peach Pit, telling her to join him after her “private” phone call. Episode 259 – Page 4 Janet talks to the caller as Steve leaves. She reacts with delight as the party tells her they liked her resume and want to see her for an interview. Janet tells them she’ll be happy to come, but she’ll have to do it on her lunch hour. Matt and David are clearing up the broken glass at the boutique and scrubbing up the floor. Donna is having a difficult time coping with what has happened. She tells them that Dylan is keeping Kelly busy until they get the place cleaned up. David comments that he hopes that she is helping him find a new place to live, because he kicked him out of the bungalow. Noah shows up, and Donna crosses to him, relieved that he has responded to her message. She pulls him aside and says that she needs to talk to someone about all the troubles. Noah says that he is sorry about the tragedy, and all her worries, but he can’t spend the time with her right now, because he is meeting Cherise for lunch. He walks away leaving Donna more despondent than ever. At the Peach Pit, Nat and Steve are discussing the shooting with Kelly and Dylan. Nat advises her not to let the fact that she defended herself from this animal, make her feel that she has done something wrong.
