He was not present during the discussion of this item. 2 Minutes The Minutes of the Meetings held on 2 and 9 March 2011 were agreed as correct record and signed by the Chairman. 3 School Admission Arrangements September 2012 and Beyond Key Decision Cyps/2/11 The Cabinet considered a report of the Corporate Director, Children and Young People’s Service that proposed admission arrangements for Community and Voluntary Controlled Schools for the 2012/2013 academic year and beyond (for copy see file of Minutes). Resolved:- That the recommendations contained in the report be approved. Page 1 4 Revised Proposal to Create One New Secondary School in Spennymoor Key Decision (CYPS/06/09) The Cabinet considered a report of the Corporate Director, Children and Young People’s Service that provided an alternative proposal to create one school in Spennymoor in accordance with the recommendations agreed by Cabinet on 21 July 2010 and which sought approval on all matters related to the new proposal (for copy see file of Minutes). Resolved:- That the recommendations contained in the report be approved. 5 Declaration of Air Quality Management Area –Durham City Key Decision NS/02/11 The Cabinet considered a report of the Corporate Director, Neighbourhood Services that sought approval to declare an Air Quality Management Area (AQMA) within Durham City and to the making of an Order designating the defined area (for copy see file of Minutes). Resolved:- That the recommendations contained in the report be approved. 6 Bereavement Services: Draft Cemetery Policies Key Decision: NH/NS/15/10 The Cabinet considered a report of the Corporate Director, Neighbourhood Services relating to new draft policies for consultation for the management of the Council’s cemeteries (for copy see file of Minutes). Resolved:- That the recommendations contained in the report be approved. 7 Review of Charging Policy – Day Care Services Key Decision – AWH 27/09 MTFP – AWH6 The Cabinet considered a report of the Corporate Director, Adults, Wellbeing, and Health that set out the results of the consultation exercise on proposals to charge for day care services and to make recommendations that day care services, including related transport and alternatives to traditional day care, are included in the calculation of the contribution service users make towards the packages of care they receive (for copy see file of Minutes). Page 2 Resolved:- That the recommendations contained in the report be approved. 8 Gypsies and Travellers – Stopovers, Events and Related Issues The Cabinet considered a report of the Corporate Director, Adults, Wellbeing, and Health that set out a revised approach to the management of Gypsy and Traveller encampments and events, and provided an update on the refurbishment of the permanent sites managed by the Council (for copy see file of Minutes). Resolved:- That the recommendations contained in the report be approved. 9 Annual Enforcement Programme Children and Young Persons (Protection from Tobacco) Act 1991 and Anti Social Behaviour Act 2003 The Cabinet considered a report of the Corporate Director, Neighbourhood Services that reviewed enforcement activities under the Children and Young Persons (Protection from Tobacco) Act 1991, the Anti-social Behaviour Act and the Licensing Act 2003 for the period April 2010 to March 2011 and sought approval of a new enforcement programme for 2011/12 (for copy see file of Minutes). Resolved:- That the recommendations contained in the report be approved. 10 Primary Authority Responsibility for Environment, Health and Consumer Protection The Cabinet considered a report of the Corporate Director, Neighbourhood Services on the provisions of new legislation, the Regulatory, Enforcement and Sanctions Act (RES Act), which have an impact on the administration of the County Council’s enforcement functions in respect of Environment, Health and Consumer Protection matters (for copy see file of Minutes). Resolved:- That the recommendations contained in the report be approved. 11 Introduction of a Countywide Allotment Lettings Policy The Cabinet considered a report of the Corporate Director, Neighbourhood Services that sought authorisation for the introduction of a countywide allotment Page 3 lettings policy . The policy will be subject to a 12 week consultation process during which existing tenants will be invited to comment on the content of the policy (for copy see file of Minutes). Resolved:- That the recommendations contained in the report be approved. 12 Annual Review of the Constitution The Cabinet considered a report of Corporate Director, Resources that sought agreement for revisions to the Constitution following an annual review (for copy see file of Minutes). The Head of Legal and Democratic Services circulated an additional paper that set out a revision relating to the delegations to the Corporate Director, Regeneration and Economic Development (for copy see file of Minutes). Resolved:- That the recommendations contained in the report, together with those in the additional paper, be approved. 13 Exclusion of the Public Resolved: That under Section 100 A (4) of the Local Government Act 1972, the public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraph 3 of Schedule 12A to the said Act. 14 Former Pelton Infants School Site- Proposed Community Building and Health Centre The Cabinet considered a joint report of the Corporate Director, Resources and Corporate Director, Adults, Wellbeing, and Health regarding the proposed Community Building and Health Centre at the Former Pelton Infants School Site (for copy see file of Minutes). Resolved:- That the recommendations contained in the report be approved.
