Recommendations It is recommended that the Finance and Resources Committee: 1) Grants leases of areas of land to Scottish Power Energy Networks or their nominees to install substations and associated equipment, and grant servitude rights for vehicular and pedestrian access and cables to be laid, on land at Drumgelloch Railway Car Park, Airdrie: Sir Matt Busby Sports Centre, Bellshill: Time Capsule Car Park, Coatbridge: Drumpellier Country Park Car Park, Coatbridge: Summerlee Car Park, Coatbridge: Broadwood Stadium, Cumbernauld: School Road Car Park, Wishaw: Glebe Street Car Park, Bellshill and Burnhead Community Centre Car Park, Viewpark. 2) All other terms and conditions, including varying the location of the substations, the route of the servitudes rights of access and cables, to be adjusted by the Head of Asset and Procurement Solutions. Background 1.1 Transport Scotland working with Scottish Power Energy Networks (SPEN) have provided funding for a pilot scheme to be run in two Local Authorities in Scotland, North Lanarkshire Council (NLC) and South Lanarkshire Council (SLC). The pilot scheme has a target of providing 220 EV charging points over 30 - 40 sites. Both Councils are working with SPEN to provide these EV charging points across the county. This report follows on from the previous report submitted to the Environment and Transportation Committee on the 12th Feb 2020 titled EV Charging Infrastructure Strategic Partnership. 1.2 Working in partnership with the Scottish Government, Transport Scotland, SPEN and SLC, the proposals will be developed and will result in an efficient network of community chargers across Lanarkshire. 1.3 In order to facilitate these EV charging points SPEN require a number of new substations to be built. SPEN have identified nine potential locations within North Lanarkshire where these sub stations are to be located, these, along with the servitudes are shown in Appendix 1. Transport Scotland have imposed a very tight timescale for the construction of the substations which can only be done when the leases have been agreed. 1.4 The provisional position of the substation, the servitude rights for vehicular and pedestrian access and route of the cables for each location are shown in Appendix 1. These are indicative at this stage and the positions may change once further detailed technical investigations have been undertaken. In order to meet the tight timescales for this project it is necessary to seek committee approval at this time and it is recommended that the Head of Asset and Procurement Solutions be granted authority to vary the locations as required. 1.5 SPEN have requested a formal lease term of 99 years which is required for standard installations. 1.6 Four of the proposed sites are currently leased to Culture and Leisure NL Limited therefore it will be necessary to amend the various agreements with this company before we can lease the sites to SPEN. 2. Report 2.1 Lease Proposals Provisional agreement has been reached with SPEN on the following terms and conditions for the various substation leases: (i) Date of Entry: Upon conclusion of missives or as agreed between the parties. (ii) Term: Term of 99 years from the date of conclusion. (iii) Legal Fees: Both parties shall bear their own legal fees relating to this transaction. (iv) Rent : The rent shall be the sum of £1 per annum if asked. All other terms and conditions to be agreed by the Head of Asset & Procurement Solutions. 3. Equality and Diversity 3.1 Fairer Scotland Duty There is no requirement to carry out an assessment in this regard 3.2 Equality Impact Assessment There is no requirement to carry out an assessment in this regard. 4. Implications 4.1 Financial Impact The loss of potential revenue due to loss of land is negligible. The Council will be responsible for their Legal costs. 4.2 HR/Policy/Legislative Impact There are no known HR/Policy/Legislative impacts to be considered. 4.3 Environmental Impact It is anticipated that with the increase in EV charging points, which is as a consequence of the new substation leases being granted, and the change to electric cars there would be a positive Environmental Impact. 4.4 Risk Impact There is a risk that the timescale imposed by Transport Scotland is too short for resolving all the Legal matters which need to be tied up. There is a risk that Transport Scotland will withdraw the funding for this project. 5. Measures of success 5.1 The lease of the nine substation sites is the first stage to enabling the roll out of EV Charging points across North Lanarkshire. 6. Supporting documents 6.1 Appendix 1 shows an indication of where the potential nine sub-station sites may be located.
