[Agricultural Tenancies Amendment Bill] RONDA MILLER, Clerk of the Legislative Assembly NEW SOUTH WALES GOVERNMENT GAZETTE No. 24 2 March 2012 LEGISLATION 573 Orders New South Wales Fisheries Management (Continuation of Activities in Snowy River Catchment) Interim Order 2012 under the Fisheries Management Act 1994 I, the Minister for Primary Industries, in pursuance of section 221IG of the Fisheries Management Act 1994, make the following Order. Dated, this 10th day of February 2012. KATRINA HODGKINSON, M.P., MinisterMinister for Primary Industries Explanatory note The aquatic ecological community in the catchment of the Snowy River in NSW is listed as an endangered ecological community under the Fisheries Management Act 1994 (the Act). However, the Act enables the Minister to make an order authorising a class of persons to carry out an activity that may result in harm to a threatened species, population or ecological community or damage to its habitat. While such a proposed order is being assessed under the Act, the Minister may make an interim order lasting up to 6 months to allow an existing activity to be continued. The object of this interim Order is to allow recreational fishing in the Snowy River catchment to continue for a period of 6 months, subject to compliance with any applicable fishing regulatory controls imposed by or under the Act. This Order is made under section 221IG of the Fisheries Management Act 1994. s2011-409-25.d08 Page 1 NEW SOUTH WALES GOVERNMENT GAZETTE No. 24 C:\Docs\si\s2011-409\d08\s2011-409EXN.fm 19/12/11, 10:14 am 574 LEGISLATION 2 March 2012 Fisheries Management (Continuation of Activities in Snowy River Clause 1 Catchment) Interim Order 2012 Fisheries Management (Continuation of Activities in Snowy River Catchment) Interim Order 2012 under the Fisheries Management Act 1994 1 Name of Order This Order is the Fisheries Management (Continuation of Activities in Snowy River Catchment) Interim Order 2012. 2 Commencement This Order: (a) commences on the day on which it is published in the Gazette, and (b) has effect for 6 months, and (c) is repealed at the end of the last day on which it has effect. 3 Continuation of recreational fishing (1) A recreational fisher may, subject to compliance with any applicable fishing regulatory controls, take or possess fish, or carry out any routine activity in connection with the taking or possession of fish, from the Snowy River Catchment. (2) In this clause: applicable fishing regulatory controls means requirements imposed by or under the Fisheries Management Act 1994 that apply to or in respect of the activities concerned. Snowy River Catchment means the catchment of the Snowy River in NSW as described in the final determination of the Fisheries Scientific Committee to list the aquatic ecological community in that catchment as an endangered ecological community.
