Case Officer Name & Number: Richard Redford, ext 3625 The Proposal; The proposal as a whole comprises the demolition of a barn along with the partial demolition of a second barn, the construction of a marina comprising 550 non­ residential berths with associated marina services including service docks, amenities buildings and boat repair facility, with associated car parking and service areas, publically accessible landscaped areas including meadows, wetlands, woodlands and games areas as well as provision of a shop, café, restaurant and marina centre with minor works to adopted and un-adopted roads. Located across the administrative boundaries of Rugby Borough Council and Daventry District Council the lion share of the development is situated within Daventry District Councils area. The elements within Rugby Borough include 78 berths at the southern end of the south pool, amenity building, parking spaces and landscaping as well as wetland and meadow areas of public open space and highway works to the A45/Onley Lane junction. The application was presented before the Planning Committee on 7th November 2012 with a recommendation for approval subject to conditions and the applicant entering into a Section 106 Legal Agreement relating to the provision of open space. The Committee resolved to grant planning permission subject to the applicant entering into the Section 106 legal agreement and the conditions detailed in the committee report. Following this resolution further discussions have taken place between the applicant, their agent and officers from both Councils in respect of both the legal agreement and conditions resulting in changes to both the legal agreement and conditions being sought. In respect of the Section 106 agreement, Members were advised at the November Committee meeting the agreement would relate to the provision of open space of public use based on a plan contained within the Design & Access Statement that separated publically accessible areas from private areas for use by canal boat users only. The discussions subsequent to the Planning Committee resolution and production of a draft legal agreement highlighted that, as indicated in sections of the supporting text in the submission, it was intended that only the footpaths within the site would be the subject of the legal agreement for their use on a permissive basis only (excluding existing established public rights of ways). All other areas indicated on the submitted plan for public use would be done through appropriate conditions. 3 Turning to the conditions contained in the resolution by Rugby Borough Council, given the sites location across the 2 administrative boundaries the agent is seeking alterations to a number of existing conditions, the addition of a number of conditions to mirror those contained in the list of conditions attached by Daventry Council to their resolution and the removal of one condition with its inclusion within another existing condition. The re-ordering and subsequent re-numbering of the conditions is sought. A similar request has been made to Daventry District Council in respect of their involvement in the legal agreement as well as their conditions including the incorporation of conditions within Rugby Borough Councils resolution. The application is brought before your committee in order to seek authorisation for the changes indicated above to the Section 106 Legal Agreement and the conditions from those previously agreed by the Committee. Consideration; The issues for consideration relate to the proposed changes to the Section 106 legal agreement, alterations to conditions, insertion of addition conditions and the re­ organisation / re-numbering of conditions. Given that the development proposed is not being changed all matters previously considered remain valid with the proposal being acceptable subject to the legal agreement and conditions. With regards to the legal agreement, the original resolution related to a significant proportion of the site being made available to public access with the marina berth pools and areas immediately around them being for use by boat users only. The change to the legal agreement sought will provide public access to the site via a number of permissive footpaths throughout the site in
