RESTRICTED W.19/19 GENERAL AGREEMENT ON 8 December 1961 TARIFFS AND TRADE Limited Distribution CONTRACTING PARTIES Nineteenth Session NEWLY-INDEPENDENT STATES Recommrendation of 18 November 19.30 (Note by the Executive Secretary) The Recommendation of' 18 November 1960(9S/16) provides for the de facto application of the CATT between contracting parties and territories which acquire fully autonomy in the conduct of their external commercial relations and to which the GATT wasformerly applied by the metropolitan power. The period of de facto aapplication ends two years after the date of independence. This Recommendation is at present applicaible in respect of the following States until the dates indicated: Cameroon-1 (1 January 1962) Ivory Coast (7 August 1962) Central African Repoublic (141 August 1962) Madagascar (25 June 1932) Chad (11 August 1932) Mali ( 20 June 1932) Congo (Brazzaville) (15 August 1962) Mauritania (28 November 1962) Congo (Leopoldville (50 June 1932) Niger (3 Augzust 1962) Cyprus (16 Auguust 1932) Senegal (20 June 1962) Dahomey (1 August 1)932) Togo (27 April 1962) Gabon (17 August 1932) Upper Volta (5 August 1962) The Governments of the Rei:ublic of Camersoen (L/1653) and the Republic of' Congo (Lecocidville) (L/1563) have requested an extension of the time-limit, a.s it will not be possible for them to take decisions in this matter within the two-yearperiod. Other States may also wish to have a longer period in which to decide upon their future relations with the GATT. It is therefore suggested, for consideration by the CONTRACTING PARTIES, that the Recomniendation of 18 November 1960 might be extended for one year for any State which requests an extension, In the event that the CONTRACTING PARTIES wish to actupon this suggestion the following text of a decision miht be considered: W.19/19 Page 2 DRAFTDECISION CONSIDERING that the CONTRACTING PARTIES recommended on 18 November 19(0 that contracing parties should continue to apply de factor the Ceneral Agreement in their relations with any territory which acquires full. autonemy in lthe conduct of its external commercial relations and of other mattsers provided for in the General Agreemen for a period of two yearsfrom the date on which such autonomy is acquired, provided that the State in question continues -to apply de facto the Agreement to them; CONSIDERING thatthegovernments of some of the States to which the said Recommendation is at presnt. applicable have requested more time to consider theirfuture commercial policy and The question of their relations with the General Agreemont, and. that others, to whichthe Recommendation is at present applicable or may in future be applied, may makesimilar requests before the expiry of the period of two years:and CONSIDERING that it is desirable that', during such an extended period the provisions of the Gencral Agreement should continued to be applied to trade between the territories of such.States and the territories of contractin- parties to GATT; The CONTRACTING PARTIES RECOMMEND that contractcing parties should continue to act upon the, Recommendation of 18 November 1960 for a further period of one year with respect to any State to which the said Reconmmiendation is applicable and which before the expiry of its two-year period requests an extension of the time-limit, provided that such Sta to continues to apply de factor the Agreement to them; and REQUEST the Executive Secretary to notify the conitraeting parties promptly of all requests for such extension..
