All references to the Police Services Act will reflect the current legislation including the appropriate sections and subsections. b) "Association" means the Cobourg Police Association. c) "Board" means the Cobourg Police Services Board. d) "Chief' means the Chief of Police of the Cobourg Police Service or his/her designate. e) "Civilian" means a member of the civilian and clerical staff of the Cobourg Police Service including special uniformed Court and Security Officers and the Court Services Officer sworn in as a "Special Constable". f) "Corporation" means the Corporation of the Town of Cobourg. g) "Member" means all members of the Service, save and except the Chief of Police, the Deputy-Chief of Police, Senior Officers (Inspector and above), Administrative Assistant, Finance Budget Coordinator, and Director of Corporate Services, and those excluded pursuant to the Police Services Act, 1990 or as set forth in this agreement. h) "O.M.E.R.S." means the Ontario Municipal Retirement System. i) "Service" and/or "Police Service" means the Cobourg Police Service. ARTICLE 1 - RECOGNITION 1.01 The Board recognizes the Association as the exclusive bargaining agent for all members of the Cobourg Police Service in accordance with the terms of the Police Services Act, 1997. As referred to in this agreement, the term "member" shall mean all civilian members of the Service, save and except sworn police officers, the Chief of Police, the Deputy Chief of Police, Senior Officers (Inspector and above), Administrative Assistant and those excluded pursuant to the Police Services Act, 1990 or as set forth in this agreement. 1.02 Whenever applicable in this agreement, the singular number shall include the plural and the masculine shall include the feminine. ARTICLE 2- MANAGEMENT RIGHTS 2.01 The Association recognizes that, subject to the provisions of the Police Services Act, 1990 and the Regulations made there under by the Lieutenant Governor in Council, it is the exclusive function of the Board to: (i) maintain order, discipline and efficiency; (ii) hire, discharge, direct, classify, transfer, promote, demote or suspend or otherwise discipline any member. The Board agrees that no member will be dealt with adversely without reasonable cause and that it will exercise the functions outlined in paragraph (i) in a fair and reasonable manner and without discrimination, consistent with this Agreement, the Police Services Act, 1990, and the Regulations made there under by the Lieutenant Governor in Council, and the Ontario Human Rights Code. If a member claims that the board has exercised any of the functions outlined in paragraph (ii) in violation with this agreement, then such claim may be the subject of a grievance under the grievance procedure outlined in this agreement, or dealt with under the procedures within the exclusive jurisdiction of the Police Complaints Commissioner, reporting to the Ontario Attorney General, as prescribed in the Police Services Act, 1990, as the case may be. 3 ARTICLE 3- ASSOCIATION RIGHTS 3.01 The Board agrees that there will be no discrimination, harassment, restraint, interference, intimidation, coercion or threats, directly or indirectly, by any of its representatives against any member of the Association in respect of the member's employment because of the member's membership or activity in the Association, or as a representative of the Association acting on behalf of a member. 3.02 There will be no discrimination, harassment, restraint, interference, intimidation, coercion or threats, directly or indirectly, by the Association or by any member or representative of the Association with respect to any member of the Town of Cobourg Police Service who is not a member of the Association.
