CONTRACT SPECIFICATION 6. Nature of contract Global price 7. Contract description The assignment considers a number of activities, including but not necessarily limited to: optimization of the alignment recommended in the preliminary (conceptual) phase of design, update of traffic study, preparation of preliminary and main design including required August 2018 Page 1 EC/BiH/TEN/18/016 Design and studies for betterment of road on SEETO Route 2a, section Banja Luka – Ugar (IEBL) - Lašva geotechnical and geodetic surveys, environment impact assessment, feasibility study, road safety audit, and tender dossier for works for betterment interventions recommended by conceptual design. Betterment interventions are foreseen on territories of both Entities of Bosnia and Herzegovina, Federation of BiH and Republika Srpska. Due to reasons of practicality of implementation, the project is split into 2 balanced lots referring to the respective components, as presented below: 1. Lot 1: Road section South end of Banja Luka Bypass – Ugar (IEBL) – Donji Vakuf, of which 54km in Republika Srpska and 32km in Federation of BiH, l = 86.0 km 2. Lot 2: Road section Donji Vakuf –Travnik – Vitez – Lašva, cca. 84km, with exclusion of Vitez Business Zone PC 96 sub-section of indicatively 4km, all in Federation of BiH, l = 80.0 km Indicative total: L = 166.0 km The contractor is expected to deliver, as a minimum: a. Analyses of the conceptual design / preliminary solutions checking the compliance with the legal framework, b. Optimisation of the alignment, connections of the road to the existing network, and adjusting of the network colliding with the road, c. Related studies, in particular updates of technical study and traffic study, d. Excerpts needed for issuance of urban conditions and obtaining the urban conformity, e. Preliminary design for proposed betterment, and for maintenance interventions on intermediate sub-sections, at the appropriate level of detail, f. Environment impact assessment, feasibility study and road safety audit report, g. Main design for proposed betterment, and for maintenance interventions on intermediate sub- sections, at the appropriate level of detail, h. Official reviewers' reports, as required by the applicable Laws in FBiH and RS, i. Tender dossier for works execution, j. Excerpts from the design required for applying and obtaining of construction permits, with an ultimate objective is to enable tendering of works in line with the applicable legislative and regulatory framework of the two Entities and BiH. 8. Number and titles of lots 2 (two) Lots: 1. Lot 1: Road section South end of Banja Luka Bypass – Ugar (IEBL) – Donji Vakuf; 2. Lot 2: Road section Donji Vakuf –Travnik – Vitez – Lašva. 9. Maximum budget 1. EUR 3 500 000 for Lot 1, 2. EUR 3 500 000 for Lot 2. 10. Scope for additional services The contracting authority may, at its own discretion, extend the project in duration and/or scope subject to the availability of funding up to the estimated amount of approximately offered Contract Price. Any extension of the contract would be subject to satisfactory performance by the Contractor. Eligibility Participation is open to all natural persons who are nationals of and legal persons (participating either individually or in a grouping – consortium – of tenderers) which are effectively established in a Member State of the European Union or in a eligible country or territory as defined under the Regulation (EU) No 236/2014 establishing common rules and procedures for the implementation of the Union's instruments for external action (CIR) for the applicable instrument under which the contract is financed (see also heading 29 below) . Participation is also open to international organisations. Please be aware that after the United Kingdom's withdrawal from the EU, the rules of access to EU procurement procedures of economic operators established in third countries will apply to candidates or tenderers from the United Kingdom depending on the outcome of negotiations. In case such access is not provided by legal provisions in force at the time of the contract award, candidates or tenderers from the United Kingdom could be rejected from the procurement procedure. 2. Candidature All eligible natural and legal persons (as per item 11 above) or groupings of such persons (consortia) may apply. A consortium may be a permanent, legally-established grouping or a grouping which has been constituted informally for a specific tender procedure. All members of a consortium (i.e., the leader and all other members) are jointly and severally liable to the contracting authority. The participation of an ineligible natural or legal person (as per item 11) will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded. 13. Number of applications No more than one application can be submitted by a natural or legal person whatever the form of participation (as an individual legal entity or as leader or member of a consortium submitting an application). In the event that a natural or legal person submits more than one application, all applications in which that person has participated will be excluded. The candidates may submit an application for one lot only, several lots or all of the lots, but only one application per lot. Contracts will be awarded lot by lot and each lot will form a separate contract. 14. Shortlist alliances prohibited Any tenders received from tenderers comprising firms other than those mentioned in the short- listed application forms will be excluded from this restricted tender procedure unless prior approval from the contracting authority has been obtained (see practical guide – PRAG – 2.6.3.). Short-listed candidates may not form alliances or subcontract to each other for the contract in question. Grounds for exclusion As part of the application form, candidates must submit a signed declaration, included in the standard application form, to the effect that they are not in any of the exclusion situations listed in Section 2.6.10.1. of the PRAG. Candidates included in the lists of EU restrictive measures (see Section 2.4. of the PRAG) at the moment of the award decision cannot be awarded the contract. 16. Sub-contracting Subcontracting is allowed. 17. Number of candidates to be short-listed On the basis of the applications received, between 4 and 8 candidates will be invited to submit detailed tenders for this contract. If the number of eligible candidates meeting the selection criteria is less than the minimum of 4, the contracting authority may invite the candidates who satisfy the criteria to submit a tender. PROVISIONAL TIMETABLE 18. Provisional date of invitation to tender June, 2019 19. Provisional commencement date of the contract December, 2019 20. Initial period of implementation of tasks 24 months SELECTION AND AWARD CRITERIA 21. Selection criteria The following selection criteria will be applied to candidates. In the case of applications submitted by a consortium, these selection criteria will be applied to the consortium as a whole unless specified otherwise. The selection criteria will not be applied to natural persons and single- member companies when they are sub-contractors. 1) Economic and financial capacity of candidate (based on item 3 of the application form). In case of candidate being a public body, equivalent information should be provided. The reference period which will be taken into account will be the last three years for which accounts have been closed. a. Average annual turnover of the candidate for the previous three financial years shall be at least EUR 3 000 000.
